Staff Present: Amy Usowski, Conservation Agent, Shana Brogan Administrative Assistant.
Also Present: Neil Andres DPW superintendent, Stephanie Sequin of Ryder & Wilcox, Tim Brady of East Cape Engineering, Deputy Foley of the Eastham Fire Department, Don Munroe of Coastal Engineering.
Stephen Smith opened the meeting at 6:00PM.
Request for Determination of Applicability filed by the Town of Eastham.~Applicant proposes removal of remains of concrete and asphalt from ramp and to replace with native crushed stone where necessary and patch parking lot with hot mix asphalt concrete. At Collins Landing, Map 20, Parcel 113. Neil Andres of the Eastham DPW represented the project and said the ramp is barely usable and needs repair as well as the potholes in the parking area need to be fixed, and they may use a hydraulic excavator or a bobcat. He continued saying it would be done soon, early in the morning, timed to a low tide.

Request for Determination of Applicability filed by the Town of Eastham.~Applicant proposes installation of a dry hydrant for Eastham Fire Department at Great Pond at property located at 185 Great Pond Road, Map 14, Parcel 097. Mark Foley of the Eastham Fire Department along with Neil Andres of the Eastham DPW represented the project. Mark Foley explained the dry hydrant would provide easier water access to Great Pond throughout the year and instead of using a hose directly in the pond to get water they would use the dry hydrant as it is their primary drafting site. Amy Usowski said her only concern was the use of PVC pipes. Mark Foley said they would look for an alternative for the pipe that is in contact with water, but not the 90º L pipe as it is manufactured using PVC.

Request for Determination of Applicability filed by the Town of Eastham.~Applicant proposes installation of double chip seal surface treatment on sections of: Governor Prence Road, Hay Road, South Eastham Street. North West Street. Foxwood, and East Street.
Neil Andres of the Eastham DPW represented the project who explained the roads specified are in bad condition, and they cannot afford to repave them. The chip seal will last about seven years and will allow the roads to be passable, and that nothing would be put down the drains. Stephen Smith asked if the project would be like the recent one on Schoolhouse Road. Neil Andres responded that it would not look like Schoolhouse road which was recycled tires and a much heavier traffic area. Sandra Larsen said that she would like more information about the project and asked if the town would be doing the work. Neil Andres replied that it will be All States Asphalt who was given the project through a bidding process, and they will not do the work much past early September as it is weather dependent and if the project is done incorrectly in any way,
it will likely have to be done over completely, so the company is careful to do it in the right conditions.
Stephen Smith asked what would happen if it did rain and Neil Andres replied they would put booms on the roads and drains which they have and the alternatives to the project would be concrete or reverting to gravel. Sandra Larsen said it should be a Notice of Intent filing as the project will have an impact.

Notice of Intent Filed by Paul Dinto.~Applicant proposes repairs to stone revetment, nourishment, and re-vegetate a coastal bank at property located at 1 West Shore Drive, Map 7A, Parcel 2. Tim Brady of East Cape Engineering explained that the applicant’s revetment is regularly overtopped and eroding likely due to a neighbor’s revetment that is not well maintained and the applicant has been nourishing beyond their annual requirement. Tim Brady continued saying so they would like to increase the height and reshape the return, and afterwards replant the bank and begin work in the fall from the bottom of the bank. Amy Usowski said she would calculate the nourishment amount.

Notice of Intent filed by Josephine Fellers. Applicant proposes removal of existing cesspools and installation of two septic systems at property located at 255 Higgins Road, Map 4, Parcel 455.
Stephanie Sequin represented the applicant and explained that the property contains three cottages and one is close to the top of a capital bank, which use cesspools that will be filled and abandoned and new septic tanks installed well out of the 100’ buffer zone and the applicants would like to have a permit in place when the cesspools fail. Stephen Smith requested that a mini excavator be used to avoid damaging or taking down any cedars on the property to the north and snake the piping through. Amy Usowski said silt fence at the 100’ buffer mark would not be necessary if a mini excavator is used.

Request for Amended Order of Conditions Filed by Cliff Cottage Trust.~Applicant proposes repairs to exposed fiber rolls and reconstruction of existing portion of a revetment at property located at 7 Memory Lane, Map 7, Parcels 501 and 496.
Don Munroe of Coastal Engineering represented the applicant and explained the details of the fiber roll repairs and incorporating stone work at the top of the revetment to elevate it 1‘ to 1.5’ in an attempt to address one area and said the applicant has intentions to continue nourishment. Amy Usowski noted the applicant has been diligent with annual beach nourishment. Fred Rollinson asked about the original revetment and Don Munroe replied that it was first constructed in the mid 1980s and was reconstructed about 2005. Amy Usowski said the applicant will have to file for an extension permit for their open Order of Conditions.

Request for extension permit filed by Susan Brownsburger DEP SE 19-756. Amy Usowski stated the applicants want to extend their permit to continue nourishing their revetment. The Commission agreed the ongoing bank vegetation and nourishment was very successful.

Untreated Wood Policy Discussion
Amy Usowski gave Commissioners a written policy and asked for comments or input. Vivien Cook said there needed to be clarification of “shorefront” because some might assume it only means ocean buffer zone and not ponds as well. Amy Usowski said she would add the words buffer zone and accessory structure and would create a list of possible alternatives for applicants to consider which would include recycled lumber products, or timbersil and the Commissioners agreed that they would accept certain types of sealants. Stephen Smith said this would also apply to anyone who wants to add a shed, and pre-fabricated ones would have treated parts. Stephen Smith asked if this new policy would apply to the town of Eastham as well, Amy Usowski replied the policy would apply to all applicants.
Sandra Larsen MOVED to approve the untreated wood policy, Vivien Cook SECONDED.
Fred Rollinson Abstained.
