EASTHAM COMMUNITY PRESERVATION COMMITTEE
Meeting: September 21, 2006

The meeting started off with a discussion of the ability to assist in funding for the bridge over the stream in Wiley Park. Glenn and Sheila noted that Article 20 of the 1998 Annual Town Meeting provided a fund for open space acquisition and maintenance which has an approximate balance of $75,000.00. It may be necessary for the CPC to appropriate funds for planning the completion of such projects in future years.
The minutes of August 17, 2006, were approved as written.
The needs assessment process shall be the culmination of the last three (3) meetings and a draft document shall be prepared for the next meeting on October 12, 2006, at 5:30 p.m. with the public information meeting to take place at 7:00 p.m., October 26, 2006. The October 26th meeting should be posted in the Town Hall and published in "The Cape Codder" on October 6th and October 13th. Mary Elizabeth Burgess, as Town Planner, shall be asked to affect the publication in the newspaper for those hearings.
The subsequent meeting of the CPC shall 5:30 p.m. on November 16, 2006, with a deadline for this year's CPA projects to be November 30, 2006.
David shall draft a housing needs profile; Kathryn shall draft a historical needs profile; Liz shall draft a recreation profile; and Glenn and Sue shall draft an open space profile.
Glenn reported that CPA fund accounts have been set up for projects approved at the 2006 Eastham Town Meeting. Glenn and Peter have reviewed letters from applicants requesting funding.
David attended the Cape Cod Commission Roundtable discussion on September 19th relative to deed restrictions. Copies of the open space and affordable housing deed restriction parameters were circulated. The format for historic deed restrictions may be based upon the Nantucket deed restriction, which may be available at CommunityPreservation.org. It was agreed that deed restrictions must be in place before funding should take place on projects where a real property interest as defined in the statute is being acquired. It also was noted that the historic restrictions might need to go before the Massachusetts Historical Commission, which process may take several months.
With regard to the Eastham Schoolhouse Museum project, the CPC shall ask the Town Administrator for a copy of the contract between the Town and the applicant pursuant to the terms of the Town Meeting warrant. Furthermore, the Historical Society needs to proceed on the deed restriction for approval.
No information is available on the progress of the Neighborhood Gas Station project on Route 6 for affordable housing. Glenn shall check with the Town Administrator. It was further agreed that administrative funds might be used for legal ads and supplies for the Clerk of the CPC.
Glenn raised a potential request for the elementary school playground proposal, and the members concurred that a playground would be an appropriate use of CPA funds for "recreational use" under the statute.
Sue noted Chapter 34 of the Massachusetts Building Code allows for reconstruction/renovation with requirements less stringent than those for new construction.
Glenn mentioned that he will contact the local newspapers relative to the upcoming CPA hearings and deadlines and that the projects other than the Schoolhouse Museum and the Neighborhood Gas Station renovation are proceeding.
