Approved Minutes

1.      Call to Order:  Vice Chairman Flannery called the ZBA Meeting of April 14, 2008 to order at 7:00PM
Members Present: Vice Chairman Flannery; Members Sharon Ives-Lawson, Suzanne Redfield, Willie Fuqua
Alternate Members Present: Vincent Jacobson, Brian Spack, Linda Dart
Absent: Chairman Charles Nichols
Staff Present:  James Carey, Building, Planning & Zoning Administrator

2.      Seating of the Alternates:  Linda Dart was seated

3.      Legal Notice:  Mr. Carey read the legal notice.

4.      Approval of Minutes
        a.      March 13, 2008 Regular Meeting
Ms. Redfield moved and Mr. Fuqua seconded, to approve the minutes of March 13, 2008 regular meeting as submitted.  The motion carried unanimously.

5.      Application of David Potter & Tanya Havlir, 33 Day Point Road, requesting variances of the East Hampton Zoning Regulations, Section Nos. 6.1 and 20.2.1 to construct an accessory building with a setback of 0 feet and a lot coverage increase from 21.3% - M 10A/B 83/L 38.

Mr. Potter was presented his request to build a 12 x 12 gazebo between the property lines located at 33 Day Point Road.  There was discussion of a tree that would need to be removed in order for the structure to be built and the proposed location is on an existing rock.  The commission requested pre and post construction photos with the dimensions be provided.

Ms. Lawson moved, and Mr. Fuqua seconded to approve the application of David Potter & Tanya Havlir, 33 Day Point Road, requesting variances of the East Hampton Zoning Regulations, Section Nos. 6.1 and 20.2.1 to construct an accessory building with a setback of 0 feet and a lot coverage increase from 21.3% - M 10A/B 83/L 38 with the condition of photographs of pre and post construction be submitted to the building department.  The motion carried unanimously.

6.      Application of Jeffrey A. Chase, 15 Dogwood Drive, requesting a variance of the East Hampton Zoning Regulations, Section No. 6.1 to construct an accessory building/garage with a side yard setback of 15 feet and a rear yard setback of 25 feet.

Mr. Chase presented the commission with a proposal to build a 24 x 40 garage.  Due to the size of this structure it would need to be presented as two applications with various requests.  The commission asked Mr. Chase to schedule an appointment with the building department and this item will be discussed at the next regular scheduled meeting.  

Ms. Lawson made a motion to table the application of Jeffrey A. Chase, 15 Dogwood Drive, requesting a variance of the East Hampton Zoning Regulations, Section No. 6.1 to construct an accessory building/garage with a side yard setback of 15 feet and a rear yard setback of 25 feet. Motion was seconded by Mr. Fuqua.  Motion passed unanimously.
