Minutes

Present:  Chairperson Melissa Engel and Council Members Chatham Carillo, Thomas Cordeiro, Christopher Goff, Barbara Moore and Susan Weintraub.  Also present were Interim Town Manager John Weichsel, Town Attorney Jean D’Aquila, Recording Secretary Cathy Sirois, members of the press and citizens.

Not Present:  Vice Chairman John Tuttle

Call to Order & Pledge of Allegiance
Chairperson Engel called the regular meeting to order at 6:30 p.m. in the Eaton E. Smith Meeting Room at the Town Hall.

Approval of Minutes  
A motion was made by Mr. Goff, seconded by Ms. Moore, to approve the minutes of the June 14, 2011 Special Meeting as written. Voted (6-0).

A motion was made by Mr. Goff, seconded by Ms. Carillo, to approve the minutes of the June 14, 2011 Regular Meeting as written. Voted (6-0).

Special Presentation  
East Hampton Boys Baseball Team – Class S State Champions
The East Hampton High School Boys Baseball team was honored after winning the Class S State Championship.  The members of the team include Spencer Daly, Ben Fortin, Marvin Gorgas, Zak Harrington, Nate Heroux, Alex Iannone, Ryan Massie, Alex Meeker, Adam Michaud, Zack Plitt, Brian Roberson, Matt Sevigny, Austin Shumbo, Joe Tuxbury, Austin Wosleger, Team Manager Lauren Lysak, Head Coach Scott Wosleger, Assistant Coach Gregg Johnson and Assistant Coach Shaun Russell.

The Council presented proclamations to each member and Senator Eileen Daily and Representative Gail Hamm had citations prepared for the coaches from the General Assembly.  Coach Wosleger thanked everyone and presented the Town with a framed photograph of the team.

Public Remarks
Angela Sarahina, 37 Old Middletown Avenue, commented on investigations targeting Chief Reimondo and asked if an FBI investigation was being conducted.

Lori Weech, 41 Cone Road, commented on the draft ordinance for no smoking in town parks.

Kyle Dostaler, 56 William Drive, commented on rumors of an FBI investigation being conducted.

William Marshall, Fairlawn Avenue, commented on the settlement for Chief Reimondo.

Mary Ann Dostaler, 56 William Drive, commented on the settlement for Chief Reimondo.

Camille Christy Barber, Moodus Road, commented on the settlement for Chief Reimondo.

Jon March, Mountainview Road, commented on the neighbors of Angelico’s and home values.
Fran Klein, Bellevue Street, commented on a noise ordinance.

Ms. Engel addressed questions regarding the settlement documents for Chief Reimondo noting she did not have a copy of the settlement document after the negotiation session. She noted the document was not available for review until June 14th.  She also noted that the Town Council is not aware of an FBI investigation.

New Business
Review Draft Ordinance for No Smoking in Town Parks
The Council discussed the draft ordinance for No Smoking in Town Parks.  Suggestions were made for designated smoking areas.  Parks & Recreation Director Ruth Plummer will review other town’s regulations and discuss the subject with the Parks & Recreation Advisory Board.  She will come to a meeting later in the summer with suggestions for East Hampton’s parks.

Old Business
Update on Senior Center Addition/Renovation
Facilities Manager Frank Grzyb provided an overview of the Senior Center Addition/Renovations.  Construction for the new addition has started. The chiller unit has been relocated and is back up and running. Excavation for the foundation is in progress and concrete has been poured for the footings.  The foundation hole is very wet and pumps are running continuously.  Demolition work is scheduled to start the second week of July in the existing building. The seniors will be utilizing the Congregational Church for their activities.

Update on Gazebo at Sears Park
Mr. Cordeiro noted his initial concerns regarding the band shell changing to a gazebo. In discussions with the Arts & Cultural Commission, they thought the venue would be conducive to theater productions. Ruth Plummer reviewed the agenda report, which will be included with the minutes, explaining the budget and the sound study.  Various designs were discussed for gazebos that are not the traditional gazebo design and could support theater productions. A new bid package will be prepared and sent out for design firms.

Update on Noise
The Council reviewed a report of noise complaints from May 27th to present prepared by Chief Reimondo.  Ms. Weintraub distributed a new draft of a Noise Control Ordinance.  The Council discussed their thoughts on the noise ordinance.  Attorney D’Aquila noted that if an ordinance is considered it should work in conjunction with the citation hearing process ordinance (Chapter 16 of the Town Ordinances).  Attorney D’Aquila also noted that  Assistant State’s Attorney John Cashman feels the noise issue should be handled on a local level, if tickets were issued under the state statute they would not prosecute and in his view he doesn’t think the statute was meant to deal with a situation like this.  Council members will review the draft and send concerns to the entire Council so they can be reviewed at the next meeting.  Attorney D’Aquila reminded the Council that a draft ordinance would need to go to the State prior to going to a public hearing.

Resolutions/Ordinances/Policies/Proclamations  
A proclamation was prepared for Nate Abraham who won the Class S State Championship for the East Hampton High School Track Team in the pole vault.

A motion was made by Ms. Moore, seconded by Mr. Goff, to approve the town paying the cost of police overtime coverage for Old Home Days and that the town provide an insurance rider.  Voted (5-0).

Bids & Contracts
Approval of Contractor for Company #2 Firehouse
A motion was made by Mr. Cordeiro, seconded by Ms. Moore, to award a bid to Higgins Enterprises, Inc. of East Hampton in the amount of $31,997 to upgrade the generator at the Cobalt Co. #2 Firehouse. Voted (6-0).

Financial Statements and Transactions
None

Tax Refunds
A motion was made by Mr. Goff, seconded by Ms. Carillo, to approve tax refunds in the amount of $64.97.  Voted (6-0).  

Communications/Correspondence/Announcements
Ms. Engel asked Mr. Weichsel to contact the DEP regarding assistance with enforcement on the lake.

The Yellow Ribbon Committee will have their first service member homecoming celebration on Thursday, June 30, 2011 at 6:00 p.m. on Chatham Fields Road.  Navy Commander Michael Flately will be honored.

Old Home Days will take place July 7th through the 9th.  The parade is Saturday, July 9th.  Marchers should line up in front of the High School at 10:30 a.m. that morning.  The parade begins at 11:00 a.m.

Ms. Weintraub noted that a local business in the Village Center requested that the East Hampton sign that was moved to the Village Center be updated to include the original “Village Center” portion of the sign.  Mr. Weichsel will handle this.

Maureen Hawkins, Colchester Avenue, asked for a clarification on the time for the Yellow Ribbon Ceremony.  Mr. Goff confirmed the time of 6:00 p.m.

Lori Weech, Cone Road, commented on a designated smoking area in the parks.

A motion was made by Ms. Moore, seconded by Ms. Carillo, to adjourn the regular meeting at 8:00 p.m. to enter the recessed meeting from June 27, 2011.  Voted (6-0).
