Minutes

Present: Chairperson Melissa Engel, Vice Chairman Thomas Cordeiro and members, William Devine, Christopher Goff, John Tuttle and Susan Weintraub. Also present were Town Manager Jeffery O’Keefe, Public Utilities Administrator Vincent Susco, Building Official James Carey and Town Attorney Janet Brooks.

Not Present:  Scott Minnick

Chairperson Engel called the special meeting to order at 6:00 p.m.  

A motion was made by Mr. Devine, seconded by Mr. Tuttle, to enter Executive Session at 6:00 p.m.  Voted (6-0). Mr. Carey, Mr. Susco and Ms. Brooks were present in Executive Session.

The Council exited Executive Session at 6:20 p.m.

Chairperson Engel reviewed the motion made at the October 30, 2008 special meeting which included discharging the water pumped from the wells into the town sewer system.  This is a violation of state statute to discharge clean water into a sewer system.  The new negotiated language states that the five wells will be pumped simultaneously during an aquifer stress test for 120 hours.  The water will released to a location that minimizes any effects on the monitoring of the 89 surrounding wells and will be at least 100 ft down gradient of the wells being tested and 1000 feet of the nearest next house.  There was also clarification that the wells of the surrounding 89 homes that can join the monitoring will not be pumped, only monitored.

Public Comments:
Rob Lazor, South Main Street, asked for clarification on the changes being proposed.  Chairperson Engel provided an overview.

A motion was made by Mr. Cordeiro, seconded by Mr. Devine, to rescind his motion from the meeting of October 30, 2008 which included discharging the water into the sewer system.  Voted (6-0).

A motion was made by Mr. Cordeiro, seconded by Mr. Goff, to sign the proposal of Milone & MacBroom, Inc., as negotiated by the town attorney and town staff, to provide an aquifer stress test for the Belltown Place proposal located off South Main Street; and to sign the agreement, as negotiated by the town attorney and town staff, to own and operate the public water system at Belltown Place designed to serve the number of occupants which can be adequately supplied with water without unreasonably impacting neighboring wells as recommended by Milone and MacBroom, Inc.  Voted (6-0)

A motion was made by Mr. Devine, seconded by Mr. Tuttle, to adjourn the meeting.  Voted (6-0).
