Regular Meeting Minutes
February 1, 2006


I.      CALL TO ORDER

Chairman, Linda Kehoe called the meeting to order at 7:30 p.m. at the East Windsor Town Hall, 11 Rye Street, Broad Brook, CT.

II.     ESTABLISHMENT OF QUORUM

MEMBERS PRESENT:        Linda Kehoe, Michael Ceppetelli, Michael Koczera, John Malin, and alternates Richard Osborn and Janice Warren,

UNABLE TO ATTEND:       Michael Sawka and Rene Thibodeau.

ALSO PRESENT:   Nancy J. Rudek, Zoning/Wetland Enforcement Official


III.    APPROVAL OF MINUTES

MOTION: To table the approval of minutes of January 4, 2006 to the next meeting.
Made by Mr. Osborn and seconded by Mr. Malin

IV.     AGENDA ADDITIONS

RECEIPT OF APPLICATIONS
   ?   INLAND WETLAND PERMIT TO CONDUCT REGULATED USES

A.      11 Rolocut Road – Application of Mangiafico Builders, LLC, to conduct regulated activities associated with the construction of a single family residential house.  Total parcel is 2.96 acres, served by private well and septic system.  Total wetland disturbance is 0.05 acres.

B.      19  Rolocut Road – Application of Mangiafico Builders, LLC, to conduct regulated activities associated with the construction of a single family residential house.  Total parcel is 2.28 acres, served by private well and septic system.  

C.      41 East Road – Application of Sonia Guzie to conduct regulated activities associated with a 2-lot subdivision with the construction of one single family residential house.  Total parcel is 12.8 ±  acres, served by private well and septic system.

D.      250 Main Street – Application of Two Fifty Main EW LLC, to conduct regulated activities associated with the construction of a 4,630 s.f. warehouse addition to an industrial building. Total parcel is 3.05 acres, served by public water and septic system.  

MOTION: To approve the added agenda items.

V.    PUBLIC HEARINGS  (on Inland Wetland applications)

A.  22 Wagner Lane (Wagner Terrace) – Application of White Pine, LLC to conduct regulated
activities associated with the development of 12 single family detached condominiums. Total
parcel is 20.34 acres, served by public water and sewer. (35-day deadline to close hearing ends 2/8/06)
           
        Ms. Rudek read the legal notice as it appeared in publication.  Representing the applicant were Attorney Mark Barbieri and Dave Erlandson, Civil Engineer and Casey Mrachek, Soil Scientist, both of Megson & Heagle.  Atty. Barbieri noted that Mrs. Farmer, the owner of the adjacent property, was also in the audience.  

        Atty. Barbieri explained that the site is located at 22 Wagner Lane, between Route 5 and South Water Street and it accesses both Route 5 and South Water Street.  He said there is no proposed development in any wetlands.  They are within the regulated area in one section and the wetlands there have been created; it is a detention basin on an adjacent storage facility.  They are proposing drainage from the site down to the Connecticut River and there will be disturbance down in the flood plain.  The drainage will go to a plunge pool and an outfall.  Atty. Barbieri said that all other alternatives have been explored with regard to the drainage.  

        He said the proposal for the site is for a common interest community.  He said there was a question as to who will maintain the drainage.  When you have a common interest community there is one entity that has control.  He suggested having a requirement on the association that there be an inspection quarterly and also that they put into the condo documents that the association would report to the Commission as to the status.  That could be done as a condition of approval.

        Atty. Barbieri referred to a revised drainage easement, with Mr. and Mrs. Farmer, and presented copies to the Commission members.  He said that as long as this is a condominium form of ownership the Farmers are willing to do this.  

        Atty. Barbieri submitted signed green cards as proof of notification by certified mail to the adjacent property owners.  He noted that an application is currently before the Planning and Zoning Commission to subdivide the property, to separate the storage facility from the rest of

        the property.  They are also before the PZC to change the property to an SDD (multi-family) zone and obtain site plan approval.  

        Mr. Erlandson referred to plans of the property and gave a recap from the previous meeting.  He explained that there are two wetlands systems associated with this project, one on the northeast corner which is the existing man-made detention pond, and the other is on the southwest corner.  That is the disturbed wetland, which was disturbed in 1976 with the installation of the sewer main that runs along the bank of the Connecticut River.  Mr. Erlandson pointed out that the stormwater systems and wetlands systems are thoroughly described in documents contained in the packet “Proposed Stormwater System” and “Wetland Narrative”.  He explained that test pits were done on the site and it was determined that there was a clay layer throughout the entire site.  Mr. Erlandson referred to his letter dated 1/25/06 in which he explains how he has addressed the concerns of Len Norton as well as David Askew of the North Central Conservation District. Casey Mracheck, Soil Scientist, described the soil types throughout the site.

        Ms. Kehoe questioned why test pits were only done in certain areas.  Mr. Erlandson explained that if they were proposing septic systems they would be doing test pits all over the property.  The test pit data was to determine where the ground water elevations would be and potential infiltration.  Mr. Erlandson described the location of the plunge pool and noted that riprap would be going over the sewer line and the pipe would be protected.  Ms. Kehoe expressed concern about ice sheets that come through and asked what would prevent the ice sheets from taking the riprap down the river.  Mr. Erlandson said someone who is qualified will inspect on a regular basis and report to the condo association.  Atty. Barbieri said they can set up a schedule that will satisfy the commission.  

        Ms. Kehoe asked if anyone in the audience wished to speak.

        James McKnight, of 2 South Main Street, was concerned about the storm water on Wagner Lane.  Mr. Erlandson said that no water from this entire site is proposed to cross Wagner Lane.

        Noreen Farmer, of 247 South Water Street, talked about the drainage easement.  She said that she signed a letter of intent which says that they intend to do this based on receiving approvals from the Planning and Zoning Commission, Wetlands, the DEP, etc.  She said they will allow them to have access to maintain and repair.  She said their main concern was the environmental issues.  

MOTION: To continue the hearing until the March 1, 2006 meeting.

        Ms. Rudek said that the Planning and Zoning Commission needs a ruling that this commission  has no problem with the subdivision.  A brief discussion was held on this matter.


MOTION: The East Windsor Inland Wetlands Commission has no objection to Planning & Zoning’s consideration and approval of the subdivision of property, as noted on plans entitled “Overall Boundary Map, Wagner Terrace Phase 1, prepared for White Pine, LLC, East Windsor CT, prepared by Megson & Heagle, Civil Engineers and Land Surveyors, LLC, 81 Rankin Road, Glastonbury, CT 06033, 860/659-0587, dated 9/15/05, last revised 1/12/06, scale 1” = 80’.”  This jurisdictional ruling is for the subdivision of land only.  Any proposed activities and/or development on this property must be reviewed by this Agency.

Jay Ussery, of J. R. Russo & Associates came forward.  He explained that this property is located on the north side of Rolocut Road.  It is a lot of record.  They have a wetland area in the front of this lot.  They will be doing a crossing to get access with the driveway.  Ms.
Kehoe asked how much of the property is wetlands.  Mr. Ussery noted that approximately 0.72 acre is wetlands and the disturbance will be about 0.11.

VIII.  MISCELLANEOUS     

 A.  Main Street & Highland Avenue – Pre-application meeting to informally discuss an 11-unit
      Townhouse development to be known as Sambre Village.   

Jay Ussery, of J. R. Russo & Associates came forward along with Dave Monaco and Glen Grobard.  Mr. Ussery referred to plans of the property and outlined their proposal for a development of the Adam’s Den property.  He said the property is close to 2 acres in size.  This will be a condominium/common interest type of development.  The majority of the development will be within the existing building and within the bituminous parking area.  Ms. Rudek said she would recommend that the Commission members look at the site.  Ms. Kehoe said she didn’t like the dumpsters located up against the wetlands.  Mr. Monaco said they will figure out a better place for them.  Ms. Kehoe suggested having an informal discussion at the next meeting for the Commission members to provide any comments to Ms. Rudek to relay to the engineer.

    
B.      130 Newberry Road (BT Properties) – Review of conservation easement boundary.

Mr. Ussery, of J. R. Russo & Associates, said they have redrawn what they originally had and made several changes.  He noted that the previous conservation easement boundary location restricted any opportunities for further development.  He said they are willing to mark the entire limit of disturbance with conservation easement disks.  There are no proposals in the near future.

MOTION: To accept the conservation easement boundaries as outlined on plan submitted at tonight’s meeting.
