TOWN OF EAST WINDSOR - ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
JULY 6, 2009


The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, July 6, 2009 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut.  The following members were present:  Regular Members Michael Ceppetelli, Tom Arcari and Cliff Nelson.  Regular Member Mary Buckley arrived at 7:48 p.m.  Also present was Robin Newton, Zoning Enforcement Official.

The meeting was called to order at 7:48 p.m. by Chairman Michael Ceppetelli.  A quorum was established as 4 regular members were present.  Mr. Ceppetelli explained that with 4 members, it would require a unanimous vote to grant a variance.  


CONTINUED HEARING:

ZBA #2009-09 - Application of Leontine Tougas for property located at 268 South Main Street, for a variance of Section 502 (6) Permitted Uses in Business & Industrial Districts and Section 903.4 Additional Requirements for Use Variances to allow the conversion of a first floor commercial unit into a residential unit.  [B-2 zone]

No one was present to represent the applicant.  Mr. Ceppetelli noted that on one was present to represent the applicant at the previous meeting.  The applicant was given 2 meetings.  Mr. Ceppetelli asked if anyone in the audience wished to speak for or against this application.  No one came forward.  

MOTION: To deny without prejudice ZBA #2009-09 because the applicant again has not shown up.                                    Arcari / Gudzunas / Unanimous


OTHER BUSINESS:

Discussion – Revay’s Gardens
Ms. Newton said at the last meeting Revay’s got a variance for the use of a propane filling station.  She referred to plans and pointed out that the original location of the filling station that was presented to the board was in front of the parking area, next to the sewer manhole.  She said the board expressed concern about this location and asked them to revise the plans and come back the following month.  They came back with revised plans that met the approval of the Fire Marshal.  The variance was granted based on the revised plans.  A zoning permit also was issued based on that location.  Ms. Newton said that since then the applicant has asked for a new location.  She said she felt that it was essentially the same location as what was originally proposed and she felt that the board should make the determination.  She said the applicant had indicated that the family members wanted this location and they felt that the Fire Marshal would approve this location.  After some discussion the board members agreed that they should come back to the board with a new application and a letter from the Fire Marshal stating that he approves this location.
