TOWN OF EAST WINDSOR – ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
MAY 7, 2007
The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, May 7, 2007 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut. The following members were present: Regular Members Michael Ceppetelli, Tom Arcari, Mary Buckley, Cliff Nelson and Stan Paleski; and Alternate Members Kathy Bilodeau and Tom Gudzunas.
The meeting was called to order at 7:30 p.m. by Chairman Michael Ceppetelli. A quorum was established as 5 regular members and 2 alternates were present. Mr. Nelson read the Legal Notice as it appeared in publication.
NEW HEARING:
ZBA #2007-02 – Application of J. Michael and M. Patricia Roehl for property located at 47 Harrington Road, for a variance of Section 18 Residential Bulk and Area Requirements to allow a proposed shed within the front yard setback in the A-1 zone.
Mr. and Mrs. Roehl came forward. Mr. Roehl referred to plans of the property and explained that they have two frontages, Harrington Road and Bridle Path, each requiring a 50-foot setback. They are asking for a 44-foot setback. They feel this is the best spot to locate the shed. Mr. Roehl noted that the land slopes quite a bit and if they were to move it further back it would be at the side of the hill and they didn’t know if that would be feasible.
Ms. Rudek explained that the regulations are vague regarding corner lots and different planners have interpreted the regulations differently, so some of the subdivisions differ for corner lots. Ms. Buckley asked what the size of the shed was. Mrs. Roehl responded that it is 10’ x 20’.
Mr. Ceppetelli opened up the hearing to the public. No one came forward to speak.
MOTION: To close the hearing on ZBA #2007-02. Nelson / Paleski / Unanimous
Discussion and Vote:
Mr. Nelson felt that they had a legal hardship with two frontages and he didn’t see any problem with it. Mr. Arcari indicated that Bridle Path was put in after their house was built. Mr. Paleski noted that the land does drop down. Ms. Buckley pointed out that on one came forward to speak against this.
MOTION: To approve ZBA #2007-02. Nelson / Arcari / Unanimous
In summary, Mr. Ceppetelli said that they have setbacks of two frontages and the road (Bridle Path) was put in after the fact and there wasn’t anything they could do about that.
