TOWN OF EAST WINDSOR – ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
JANUARY 8, 2007


The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, January 8, 2007 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut.  The following members were present: Regular Members Michael Ceppetelli, Mary Buckley, Cliff Nelson and Stan Paleski; and Alternate Members Tom Arcari and Dan Leone.   

The meeting was called to order at 7:34 p.m. by Chairman Michael Ceppetelli.  A quorum was established as 4 regular members and 2 alternates were present.  Mr. Ceppetelli noted that Mr. Leone would be voting on ZBA #2006-16 and Mr. Arcari would be voting on ZBA #2007-01.  Mr. Nelson read the Legal Notice as it appeared in publication.    


CONTINUED HEARING:

ZBA #2006-16 – Application of Nancy Mazza, for property located at 13 Prospect Hill Drive, for a variance of Section 18 Residential Bulk and Area Requirements, to allow a variance for lot coverage for a proposed shed and garage.   [R-3 zone]

Nancy Mazza came forward, along with her son and daughter.  Mr. Ceppetelli said that there were some issues brought up at the last meeting.  It had been brought up that the piers had already been dug for the shed.  It was noted that a building plan showing the pier locations for the shed had been included in the meeting packet.  Mr. Ceppetelli also noted that the matter of the grading for the garage was discussed at the last meeting.  Mr. Nelson said that the Building Department will deal with that situation when it arises.  Mr. Nelson read into the record a letter from Peter Olson, Jr., of 15 Prospect Hill Drive, the abutting neighbor, which stated that he had no problem with them constructing a garage at that location.  Mr. Ceppetelli indicated that they meet all setback requirements and only need the variances for lot coverage.

Mr. Ceppetelli opened up the hearing to the public.  No one came forward to speak.

MOTION: To close the hearing on ZBA #2006-16.

Discussion and Vote:
Mr. Ceppetelli said this predates zoning.  They have had a number of variances in this neighborhood.  Mr. Paleski said they brought back a plan that answered questions raised at the previous meeting.  He said the Building Department will deal with it.

MOTION: To approve ZBA #2006-16 with the stipulation that the Building Department is aware that there might be a problem with the eastern side grade.

NEW HEARING:

ZBA #2007-01 – Application of Bob Stern and Kathryn Roloff, for property located at 40 Pond Street, for a variance of Section 18 Residential Bulk and Area Requirements, to allow a variance for lot coverage for a proposed addition to an existing house.   [B-1 zone]

Mr. Stern and Ms. Roloff came forward.  Ms. Roloff referred to plans of the property and explained that there is an existing 11’ x 11’ structure that is not heated.  They want to take down that structure and build a 16’ x 16’ entryway room with a full bathroom, and off of that add a 3-season room, also 16’ x 16’.  Mr. Ceppetelli noted that it is not a setback issue, just coverage.  Mr. Rudek indicated that this is in a B-1 zone which follows the R-2 requirements for residential use.

Mr. Ceppetelli opened up the hearing to the public.  No one came forward to speak.

MOTION:         To close the hearing on ZBA #2007-01.

Discussion & Vote:
Mr. Nelson said he looked at the site and noted that this is a private road.  He said this addition conforms with the other houses in the area.  They are all older houses.  He felt that they have proven their hardship. Mr. Ceppetelli indicated that this predates zoning and is definitely a hardship.

MOTION:         To approve ZBA #2007-01.        Nelson / Arcari / Unanimous


OTHER BUSINESS:

Alternate Members Participation:
Ms. Rudek noted that there was some additional legal information included in the packet regarding alternate members participating in discussion.  She pointed out that according to case law it looks like it is not appropriate for alternate members to participate in discussion when they are not voting members.  Ms. Rudek said they are looking into having a training session for all land use boards some time in the next few months, and she will bring that up for discussion.

Resignation of Pete Pippin
Mr. Ceppetelli noted that they have received a resignation letter from Pete Pippin.  He said that hopefully they can fill that position on the board with one of the alternates.

Location Approval for Motor Vehicle Licensing
Mr. Ceppetelli said that the procedures have changed again for location approval for motor vehicle licensing.  It gives the authority back to the Zoning Board of Appeals for towns having a population of under 20,000.
