TOWN OF EAST WINDSOR – ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
MAY 1, 2006
The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, May 1, 2006 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut. The following members were present: Regular Members Mary Buckley and Stan Paleski; and Alternate Members Tom Arcari, Tom Gudzunas and Dan Leone. Nancy Rudek, Zoning Enforcement Official, was also present.
The meeting was called to order at 7:34 p.m. by Acting Chairman Stan Paleski. A quorum was established as two regular members and three alternates were present. Mr. Leone read the Legal Notice as it appeared in publication.
NEW HEARINGS:
ZBA #2006-04 Application of Sharon Brown for property located at 7 Rockville Road, for a variance of Section 18, Residential Bulk and Area Requirements (side yard setback) to allow a 10’ x 14’ shed with attached 10’ x 14’ screened porch to be located 6’ from the side property line where 10’ is the minimum requirement. [R-3 zone]
Ms. Sharon Brown came forward to explain her application. Mr. Paleski asked about the location of the septic. Ms. Brown referred to plans of the property and pointed out that the septic and fields are located to the rear of the property. She explained that there is an 8-foot fence that goes around the property. If they were to locate the shed in the back, they would have to remove the fence. Ms. Brown noted that there is an existing deck that is located 6 feet from the property line. They will be removing a portion of the deck and the screened porch will occupy that space. The shed portion will be located at the end of the driveway. Ms. Brown pointed out that the shed will be located further back from the front property line than
the existing house.
Mr. Paleski opened up the hearing to the public. No one came forward to speak.
Ms. Rudek noted that they might have overlooked something in the office regarding the front setback. Because this is an old house it may not have the required 50 feet of front setback. Mr. Paleski questioned whether they should postpone this to the next meeting. Ms. Rudek suggested that they could vote on this variance tonight. They will have to determine the exact front setback and notify the office.
MOTION: To close the hearing on ZBA #2006-04.

Discussion and Vote:
Ms. Buckley said that the existing deck is already 6 feet away. The neighbors don’t object. Mr. Gudzunas stated that this is a nonconforming area; it is a pre-existing building. He felt that this will conform with the other houses in the area. Mr. Arcari said they are not changing the footprint of the existing deck. Mr. Paleski noted that they are not coming out any further than the existing house. The septic is to the rear and the house was built before zoning. Mr. Leone agreed and said he had no problem with it.
MOTION: To approve ZBA #2006-04 with the stipulation that they bring in the measurement to clarify the front setback.

ZBA #2006-05 Application of Steven King for property located at 190 Depot Street, for a variance of Section 18, Residential Bulk and Area Requirements (front yard setback) to allow the removal of existing house and rebuilding of new house on existing foundation, located 20’ from a public right-of-way, and addition of attached 2-car garage to be located 29’ from a public right-of-way, where 50’ is the minimum requirement. [R-3 zone]
Mr. Steven King came forward. He referred to plans of the property and explained that they are looking at what is the back of the house but because it is a town right-of-way it is considered a front setback. He noted that the house was built in 1933. There is an existing foundation where the garage had burnt down. He would like to get rid of the foundation and build an attached 2-car garage. He pointed out that the new garage location would be located further back from the right-of-way. He said that because of the extensive fire damage to the house, it would be best to tear it down and rebuilt it on the existing foundation. He said moving the house is not a good option because the septic system is in the front and the reserve area is in the far
corner of the lot. Mr. Gudzunas questioned whether the Building Official would be inspecting the foundation when they rebuild the house. Ms. Rudek pointed out that the building official has been out there and is in favor of this.
Mr. Paleski opened up the hearing to the public.
Tammy and David Lucey, of 186 Depot Street, came forward to review the plans. They wanted to clarify what the applicant was doing and had no specific comments either for or against the application.
MOTION: To close the hearing on ZBA #2006-05. Leone/ Arcari / Unanimous
Discussion and Vote:
Mr. Arcari said he is moving it further away from the property line and felt that he will be cleaning up a mess that is there now. Mr. Gudzunas agreed. He said he was concerned about the foundation but as long as the Building Official gave his OK he had no problem with it. Ms. Buckley also saw no problem. He is moving it further in. Mr. Paleski noted that it was built before zoning regulations. He said there is a hardship with the location of the septic system and reserve. Mr. Leone was also in favor of this.
