TOWN OF EAST WINDSOR – ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
APRIL 3, 2006


The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, April 3, 2006 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut.  The following members were present: Regular Members Michael Ceppetelli, Cliff Nelson and Stan Paleski; and Alternate Members Tom Gudzunas and Dan Leone.  Nancy Rudek, Zoning Enforcement Official, was also present.

The meeting was called to order at 7:30 p.m. by Chairman  Michael Ceppetelli.  A quorum was established as three regular members and two alternates were present.  Mr. Nelson read the Legal Notice as it appeared in publication.

NEW HEARING:

ZBA #2006-03  Application of Denise Sabotka for property located at 73 Miller Road, for a variance of Section 18 Residential Bulk and Area Requirements (front setback) to allow an 8’ x 30’ front porch to be located 41’ from the front property line, and a 24’ x 36’ attached garage to be located 37’ from the front property line, where 50’ is the minimum requirement [A-1 zone]

Denise Sabotka came forward along with Dave Menard, her fiancé.  She referred to plans and explained that they want to add some living space.  They want to convert the existing garage to a living room and add a new 2-car garage.  Ms. Sabotka referred to an architectural drawing of the house and proposed garage.  She  submitted a certificate of mailing as proof that the abutters have all been notified.  She also submitted letters from 7 neighbors stating that they didn’t have a problem with this application.  

Mr. Ceppetelli noted that the house is nonconforming in that it is located 49’ from the front property line, and the lot doesn’t meet the area requirements for the A-1 zone.  Ms. Sabotka explained that they could have made the garage 49’ from the property line  That would have made it one long ranch.  She felt this would be more attractive and more in the character of the neighborhood.  

Mr. Ceppetelli opened up the hearing to the public.  No one came forward to speak.

MOTION: To close the hearing on ZBA #2006-03.

Discussion and vote:
Mr. Nelson said that the back of the property slopes down; there is a walk-out basement.  He said there was no other way to do this.  This definitely creates a hardship.  It is an older, nonconforming house.  Mr. Gudzunas pointed out that other houses in the area have done similar things.  Mr. Leone noted that there are some houses on the same side of the street that are closer.  Mr. Ceppetelli said the nonconforming lot size creates a hardship.  Also they have letters from the abutters that have no problem with this.  Mr. Paleski said it is a non-conforming lot.  They had a similar variance in the area.  

MOTION: To approve ZBA #2006-03.                Nelson / Leone / Unanimous

        
        OTHER BUSINESS:

        The Board had a brief discussion regarding 2 Board members (Pete Pippin and Mary Buckley) who haven’t been attending meetings.  A letter has been sent to Mr. Pippin and a letter will be sent to Ms. Buckley.
