TOWN OF EAST WINDSOR – ZONING BOARD OF APPEALS
MINUTES OF REGULAR MEETING
OCTOBER 3, 2005
The East Windsor Zoning Board of Appeals held a Regular Meeting on Monday, October 3, 2005 at the East Windsor Town Hall, 11 Rye Street, Broad Brook, Connecticut. The following members were present: Regular Members Thomas Arcari and Stan Paleski; and Alternate Members Mary Buckley and Dan Leone. Nancy Rudek, Zoning Enforcement Official, was also present.
The meeting was called to order at 7:30 p.m. by Mr. Arcari, as Acting Chairman Mr. Paleski read the Legal Notice as it appeared in publication. It was noted that four members were present; therefore the vote must be unanimous to approve the variance application.
NEW HEARING:
ZBA #2005-15 Application of Steven Tacey for property located at 11 Cricket Road, for a variance of Section 18 Residential Bulk and Area Requirements (front and side setbacks) to allow an addition to the front of existing house to be located 27’ from the front property line where 50’ is the minimum required, and 8’6” from the side property line where 10’ is the minimum required. [R-3 zone]
Steven and Catherine Tacey came forward. Mr. Tacey said that the house is already 31 feet away from the front property line. The way the house now sits it is 10 feet from the side property line at one point due to the angle of the property line. Mr. Tacey explained that they had bad ice damage to the roof during the winter and the entire roof structure has to come off. They want to add 4 feet to the front of the house and put the roof back on.
Mr. Arcari opened up the hearing to the public. No one came forward.
MOTION: To close the hearing on ZBA #2005-15. Paleski / Leone / Unanimous
Discussion and vote:
Mr. Paleski said the house itself is nonconforming and was built before zoning regulations. Ms. Buckley said as long as the neighbors are not complaining she has no problem. She said the house is on a corner and it is difficult to put anything there. Mr. Leone said since no one came forward to show any disparity he did not have a problem. Mr. Arcari said it is typical for that area.
