CALL TO ORDER AND ATTENDANCE

        The Special Meeting of the Police Commission was called to order at 7:00 p.m. by Chairman Sherman.  Commissioners Barton, Devanney, Simmons and Sinsigallo were present along with Chief DeMarco and Attorneys Penny and Hawkes-Ladd.

EXECUTIVE SESSION

A)      Litigation Update

        A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons to go into Executive Session - Item A - at 7:02 p.m. to include Chief DeMarco, Atty’s Penny and Hawkes-Ladd.

        The Chief returned from the closed portion of the Executive Session at 7:41 p.m.

        A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons to come out of Executive Session - Item A - at 8:05 p.m.

NO ACTION TAKEN

B)      Reopening and deliberation of Internal Investigation 05-13-IA and 05-15-IA.  Reopening in open session - deliberations in closed session.

        A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons to go into Executive Session - Item B - at 8:07 p.m. to include Atty. Penny as needed.

        A tty. Penny was requested to enter  the closed portion of Item B at 8:41 p.m.
A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons to come out of Executive Session - Item B - at 9:11 p.m.

At this time, Chairman Sherman stated that although Sgt. Drolett is on paid medical leave, he was in attendance at the meeting.

FINDINGS:       In the matter of 05-13-IA, we find that these charges are substantiated by the fact that Sgt. Drolett made disparaging remarks about another employee to a member of the public.  We find that Ms, Barlow’s testimony to be credible and the conclusion of the investigating officers, that Sgt. Drolett was being untruthful and evasive are valid based upon their training and experience.

        These actions by Sgt. Drolett constitute conduct unbecoming an officer.

        In the matter of 05-15-IA , we find that based on evidence presented, Sgt. Drolett made false statements against other personnel within the department.  He could not have heard all these remarks while passing them briefly in the hall.  These individuals have no history with racial incidents.  We find their testimony to be credible.

        We have found that Sgt. Drolett has violated his previously imposed probation on both counts.

MOTION:  A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons for the following:

        We adopt the preceding findings and conclusions and, therefore, take the following disciplinary action:

        Sgt. Drolett will be demoted immediately to Patrol Officer and be placed on one (1) year’s probation.  Any further violations may result in further action or demotion.

ADJOURNMENT

        A motion was made by Commissioner Sinsigallo, seconded by Commissioner Simmons to adjourn the Special Meeting of the East Windsor Police Commission at 9:15 p.m.
