CALL TO ORDER

Chair Kehoe called the meeting to order at 7:43 p.m.  The Chair announced the exit locations in accordance with
Connecticut General Statutes §29-381, after which the Council joined him in the pledge of allegiance.


OPPORTUNITY FOR RESIDENTS TO ADDRESS THE COUNCIL ON AGENDA ITEMS

Todd Matthews, 81 Central Avenue, stated that the noise, racing cars and drug issues in his neighborhood are ongoing and demanded a resolution to this problem immediately.  Chair Kehoe suggested a meeting with the police department would be helpful and will contact Mr. Matthews regarding the date and time of the meeting.

Lee Griffin, 31 Heritage Lane, thanked the Councillors for their commitment to the town.  Mr. Griffin supports the Raymond Library Expansion project and urged the Council to do the same.

Susan Kniep, 44-46 and 50 Olde Roberts Street, (1) was empathetic to the residents of Central Avenue; (2) believes that the town’s contract with MDM Golf LLC should be referred to the Council’s Investigation & Audit Committee; (3) delay approving any contract for the Mayor to negotiate due to the country’s poor economic conditions; (4) questioned how the closure of the Raymond Library while it undergoes its renovations impact the town’s residents; (5) asked where the money is coming from and going to for the renovation of the Raymond Library; (6) suggested that settlements discussed in Executive Session should be brought before the public at a regular Town Council and voting on those matters should be delayed until the public has a chance to comment on the settlement; and (7) believes the contract with Billy Casper Golf LLC should go to a referendum.

The Council gave the following individual, who is not an East Hartford resident, the opportunity to speak:
Bob Brass, Treasurer of the East Hartford Senior Men’s Golf League and a resident of Glastonbury, is in favor of the East Hartford Golf Course being managed by Billy Casper Golf LLC and suggested a few different ways the course could bring in revenues.

Frank Leone, 40 Knollwood Road, spoke in favor of the Raymond Library Expansion project.

Charles Cassella, Jr., Chair of the Library Commission, spoke in favor of the Raymond Library Expansion project.

Raymond Tubbs, 135 Central Avenue, who is the Library’s cultural assets consultant, spoke in favor of the Raymond Library Expansion project.  Mr. Tubbs gave the Council a sampling of the assets that will be housed in the Library.

Anita Morrison, 47 Woodbridge Avenue, stated that (1) the town should ensure that accountability is a main factor in the proposed contract with BCG to manage the golf course; and (2) the Raymond Library Expansion project would put a financial strain on the town’s budget, and therefore, a strain on the taxpayers.

Travis Simpson, 119 Naubuc Avenue, is concerned about the noise issues on Central Avenue as it affects the quality of life of those residents. Mr. Simpson suggested contacting state legislators and/or agencies to help resolve this problem.

Lorraine Orsini, 65 Elm Street, said that she has also witnessed the noise and racing car issues on Central Avenue.

Mike Vengruskas, 517 Hills Street, (1) suggested that the town install cameras on Central Avenue to capture whatever racing issues there are in real time; (2) is against the 5-year BCG contract for management of the golf course; and (3) suggested a bond referendum for financing the golf course.


Mayor Leclerc (1) supports the Billy Casper Golf LLC contract with the Town Council’s approval; (2) urged the Council to approve the Raymond Library Expansion project as it appears on the agenda; (3) stated that the Library will be closed approximately 18 months as the bulk of the books will be relocated to the East Hartford Community Cultural Center; (4) backs the CCM Energy Purchase Program; and (5) agrees with the Chair that a discussion with the police department on the Central Avenue issues would be beneficial to all involved.

COMMUNICATIONS AND PETITIONS

Responses to Questions Asked of Administration – Central Avenue Issues

Chair Kehoe stated that in response to Councillor Harmon’s concerns on the Central Avenue issues discussed at the October 1st Town Council meeting, the Mayor had passed along to the Council a six-month report of 911 calls placed to the police department from Central Avenue residents. Councillor Harmon reiterated the seriousness of the issues outstanding in that neighborhood, stating that she also had requested a 12-month report from the police department.  A hard copy of both reports is on file in the Council packet.


United Way Campaign Kick-off

Marc Bassos, Youth Outreach Coordinator, who is spearheading this year’s United Way Campaign, urged all town employees and town residents to participate in this worthwhile cause.  Mr. Bassos highlighted four agencies that he feels are particularly close to the East Hartford community: ChildPlan, Food Share of CT, East Hartford YMCA and the CT Rivers Council of the Boy Scouts of America.


National Prescription Drug Take-back Day

Chair Kehoe announced that the next National Prescription Drug Take-back Day will be Saturday, October 26th at the Public Safety Complex from 10AM to 2PM.



NEW BUSINESS

East Hartford Golf Course:

Authorization to Enter into a Contract

to authorize the Mayor to enter into a five-year contract with Billy Caspar Golf LLC (BCG) in accordance with the provisions of BCG's response dated June 14, 2013 to the town's Request for Proposal, Bid #13-22 provided that:

  • the town has the right to cancel such contract at the end of the third year;
  • the contract shall provide a financial incentive for BCG to exceed the annual financial
                performance measures mutually agreed upon in such contract;
  • on January 15, 2015 and annually thereafter, the Mayor shall provide the Town Council
                        with a financial statement containing revenues and expenses for the preceding calendar
                        year for the golf course operations;  
  •         after receiving the January 15, 2017 financial statement, the Town Council shall assess
                the financial viability of continuing the golf course operations; and
  • the town shall appoint a designee to regularly monitor course conditions and compliance with contract provisions.

Transfer from Fund Balance/Supplemental Budget Appropriation

                to adopt the following resolution:

RESOLUTION CONCERNING A SUPPLEMENTAL BUDGET APPROPRIATION AND FUND BALANCE TRANSFER FOR THE FISCAL YEAR ENDING JUNE 30, 2014 TO FUND THE BILLY CASPER GOLF, LLC MANAGEMENT CONTRACT

WHEREAS, the Town of East Hartford intends to execute a five-year contract with Billy Casper Golf, LLC for the operation of the East Hartford Golf Course, and

WHEREAS, with respect to the contract, the Town must budget for the payment of a pro-rated management fee and expected operating expenses in excess of revenue.

NOW THEREFORE BE IT RESOLVED, that the East Hartford Town Council does hereby approve this Supplemental Budget Appropriation of funds in the amount of $160,000 from the Town’s Undesignated Fund Balance and to reflect the addition of the attached Supplemental Revenue Appropriation and Expenditure Appropriation.

Raymond Library Expansion and Renovation Project

Update:

Susan Hansen, Library Director, briefly summarized the progress on the expansion project for the Raymond Library.  Ms. Hansen stated that Raymond Library will close to the public on Saturday November 2nd and temporarily relocate to the East Hartford Community Cultural Center. Additionally, the Wickham Library will have expanded hours for the entire time the renovation project is underway. Also, Ms. Hansen invited the Councillors and residents to attend the ceremonial groundbreaking ceremony to be held on Thursday, October 31st from 1:30PM to 2:30PM in front of the Library.

Bruce Tuthill, Tuthill & Wells Architects, reviewed the drawings with the Council on the expansion project.

Mary Martin, Project Manager, went over the expenditures and revenue side of the expansion project.


Raymond Library: Municipal Tax Exempt Lease Purchase Financing Agreement

                to adopt the following resolution:
                
RESOLUTION TO AUTHORIZE A MUNICIPAL TAX-EXEMPT
LEASE PURCHASE FINANCING AGREEMENT

WHEREAS, the Town of East Hartford intends to purchase capital equipment as part of the Raymond Library expansion including building-wide HVAC equipment, shelving, furniture, and information technology equipment; and

WHEREAS, the cost of the capital equipment designated for lease-purchase financing totals $1,500,000; and

WHEREAS, the Town will budget $232,000 in fiscal years 2016-2017 through 2022-2023 in the General Operating Fund to pay principal and interest on the purchases.  

THEREFORE BE IT RESOLVED, that the Mayor of the Town of East Hartford is authorized to enter into a master lease purchase agreement and related documents with TD Equipment Finance, Inc. in the principal amount not to exceed $1,500,000.  The interest rate, payment schedule and other details of the financing shall be mutually determined between the company and the Mayor, whose signatures will indicate approval of specific terms and conditions.

BE IT FURTHER RESOLVED, that the Town declares its intent to be reimbursed for any temporary advances from the General Fund to pay for any part of the equipment from proceeds of the lease financing in accordance with Treasury Regulation 26 CFR 1.103-18 and/or 26CFR1.150-2.

Recommendation from Real Estate Acquisition and Disposition Committee re: Raymond Library Lease

                that the Town Council authorize the Town to enter into a 99-year lease
                with the Raymond Library Company of East Hartford and the Village
                Improvement Society of East Hartford, as outlined and presented to the
                Real Estate Acquisition & Disposition Committee at its September 16,
                2013 meeting and unanimously approved, for the use of 840 Main Street,
                and associated parking, as the Town’s Public Library, and given the     
                Town’s current historical use and control of said premises as the Town’s
                library, waive the Real Estate Acquisition requirements set forth in §10-18
                (b) of the East Hartford Code of Ordinances.

CCM Energy Purchasing Program Participation Agreement

                to adopt the following resolution:


RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE THE CCM ENERGY PURCHASING PROGRAM PARTICIPATION AGREEMENT

WHEREAS, the Town of East Hartford desires to explore the competitive market for financially appropriate virtual net metering (VNM) solar projects, and

WHEREAS, the Connecticut Conference of Muncipalities (CCM), an organization to which East Hartford belongs, is exploring the VNM solar market on behalf of Connecticut Municipalities, and

WHEREAS, the VNM solar market will soon be very competitive pending the public auction of $8 million of Zero Emission Renewable Energy Credits (ZEREC) by order of PURA (Public Utility Regulatory Agency), and

WHEREAS, the Town desires to participate in a VNM solar application coupled with the execution of a VNM agreement to purchase net metering credits for five beneficial accounts.

NOW THEREFORE BE IT RESOLVED, that the Mayor of the Town of East Hartford is authorized to enter into a CCM Energy Purchasing Program Participation Agreement.  The details of the agreement shall be mutually determined between the Mayor and CCM, whose signatures will indicate approval of specific terms and conditions.

OPPORTUNITY FOR COUNCILLORS TO DIRECT QUESTIONS TO THE ADMINISTRATION

Pat Harmon (1) inquired on when the reconstruction of the Town Hall parking lot will begin.  The Mayor responded that the contractor hired recommended waiting until Spring 2014. (2) asked what is planned for the theaters on Silver Lane. The Mayor stated that there is a viable plan, but cannot comment further since the interested developer is performing their due diligence.

Ram Aberasturia appreciated Councillor Thompson’s remarks on the East Hartford Golf Course issue.

                $114,180 which shall generate a reduction of $2,218.46 in property taxes;
                and involving 275 Park Avenue from the fair market value of $1,558,050 to
                the fair market value of $675,000, which shall generate a reduction of
                $26,450.01 in property taxes.

Travis Simpson, 119 Naubuc Avenue, thanked the administration for delaying the demolition of the fire station on Bissell Street and renewed his request for a study on the town’s physical assets and a maintenance plan for those buildings.

Robert Donlon, 305 Main Street, West Haven, a private investor in the apartments located at 74 Central Avenue, expressed his concerns on the noise and racing cars issues that have been ongoing in the Central Avenue neighborhood.  Mr. Donlon believes that the administration could do more to alleviate the problem.

Mayor Leclerc stated that a meeting with all involved parties on the Central Avenue issues would be advantageous to shed some light on the matter.

Marc Weinberg wished Ram Aberasturia a Happy Birthday.
