CALL TO ORDER

Chair Kehoe called the meeting to order at 7:35 p.m.  He announced the exit locations in
accordance with Connecticut General Statutes § 29-381, after which the Council joined him in the pledge of allegiance.


AMENDMENTS TO AGENDA

OPPORTUNITY FOR RESIDENTS TO ADDRESS THE COUNCIL ON AGENDA ITEMS

Mayor Leclerc (1) stated that the first three items on the agenda under New Business are the funding vehicles for the town’s capital improvement plan, which was approved by the Council for the 2011-2012 budget; (2) supports the waiver of the educational qualifications for the acting Town Clerk and urges the Council to do the same; (3) announced that the town has recently received two grants; a $4000 grant to purchase canoes for use on the Hockanum River and a grant for approximately $19,000 for a lawn equipment exchange program; and (4) encourages the Council to support the amusement permits that are on tonight’s agenda.

NEW BUSINESS

State of Connecticut LoCIP Grant Application

                to authorize the Mayor to submit an application to the State of
                Connecticut to secure Local Capital Improvement Plan funds
                (LoCIP) in the amount of $424,000.00 for projects listed in the
                approved 2011 municipal capital improvement plan.  
The projects will be:

  • Town Hall Parking Lot           $330,000
2    Bike Trail II                              $  12,500
  • Tennis Court Repairs            $  81,500

Municipal Tax-Exempt Lease Purchase Financing Agreement re: 5-year Capital Improvement Plan

                to adopt the following resolution:

RESOLUTION TO AUTHORIZE A MUNICIPAL TAX-EXEMPT
LEASE PURCHASE FINANCING AGREEMENT

WHEREAS, the Town of East Hartford intends to purchase various capital equipment as part of the Town of East Hartford’s Approved 5-Year Capital Improvement Plan for the Years 2011-2012 through 2015-2016; and

WHEREAS, the cost of the various capital equipment and replacement furniture designated for lease-purchase financing totals $563,198; and

WHEREAS, the Town will budget $85,000 in fiscal year 2012-2013 and $216,000 for three years beginning in fiscal year 2013-2014 in the General Operating Fund to pay principal and interest on the purchases.  

THEREFORE BE IT RESOLVED, that the Mayor of the Town of East Hartford is authorized to enter into a master lease purchase agreement and related documents with Chase Equipment Finance, Inc. in the principal amount not to exceed $563,198.  The interest rate, payment schedule and other details of the financing shall be mutually determined between the company and the Mayor, whose signatures will indicate approval of specific terms and conditions.

BE IT FURTHER RESOLVED, that the Town declares its intent to be reimbursed for any temporary advances from the General Fund to pay for any part of the equipment from proceeds of the lease financing in accordance with Treasury Regulation 26 CFR 1.103-18 and/or 26CFR1.150-2.

Supplemental Budget Appropriation & Fund Balance Transfer re: Capital Equipment Purchases

                to adopt the following resolution:
                
APPROPRIATION AND FUND BALANCE TRANSFER FOR THE FISCAL YEAR ENDING JUNE 30, 2011 TO FUND CAPITAL EQUIPMENT PURCHASES

WHEREAS, the Town of East Hartford intends to purchase a replacement for Fire Engine #5 and a roll-off truck as part of the Town of East Hartford’s Approved 5-Year Capital Improvement Plan for the years 2011-2012 through 2015-2016; and

WHEREAS, the cost of these two pieces of equipment designated for purchase totals $785,000.

NOW THEREFORE BE IT RESOLVED, that the East Hartford Town Council does hereby approve this Supplemental Budget Appropriation of funds in the amount of $785,000 from the Town’s Undesignated Fund Balance for the purpose of transferring it to the Town’s Capital Reserve Fund to be used as the source of funds to pay for the equipment and to reflect the addition of a Supplemental Revenue and Expenditure Appropriation.

Outdoor Amusement Permit Applications:

Gengras Harley-Davidson Spring Open House

to approve the outdoor amusement permit application of Gengras Harley-Davidson
to conduct a Spring Open House with stunt rider shows, vendors, sales, live music and
a BBQ at Gengras Harley-Davidson Motorcycles, at 221 Governor Street on Saturday, April 30th
from 9AM to 4PM with live music from 9AM to 4PM and on Sunday, May 1st from 10AM to 3PM with
live music from 10AM to 3PM, subject to compliance with adopted codes and regulations of the
State of Connecticut, the Town of East Hartford, and any other stipulations required by the Town
of East Hartford or its agencies.

Margaritas Restaurant: Cinco de Mayo

                to approve the outdoor amusement permit from Matthew Nord,
                General Manager of Margaritas Restaurant to conduct outdoor
                bottled beer and Margarita serving station to celebrate Cinco de
                Mayo at Margarita’s Restaurant located at 330 Roberts Street on
                Thursday, May 5th from 12PM to 12:30AM on Friday, May 6th,
                subject to compliance with adopted codes and regulations of the
                State of Connecticut, the Town of East Hartford, and any other
                Stipulations required by the Town of East Hartford or its agencies.

Riverfront Recapture, Inc.: Riverfest 2011

to approve the outdoor amusement permit application, Riverfest 2011, filed on behalf of
Riverfront Recapture, Inc. by Jessica Leone, its Public Events Manager, to conduct outdoor
musical performances on Saturday July 9, 2011 – with a rain date of Sunday, July 10th – between
the hours of 4PM and 9:30PM, with music occurring between the hours of 4PM and 9PM,
and a fireworks display occurring between 9PM and 9:30PM, in the vicinity of Founders Plaza
and Great River Park on East River Drive, subject to compliance with adopted codes and
regulations of the State of Connecticut, the Town of East Hartford, and any other stipulations
required by the Town of East Hartford or its agencies.

Riverfront Recapture, Inc.: Olmstead Summer Classic – Hartford Pops

to approve the outdoor amusement permit application submitted by Jessica Leone, Public
Events Manager, for Riverfront Recapture, Inc. to conduct the Olmstead Summer Classic, a
Hartford Pops concert series, to be held in Great River Park in East Hartford on the following
Saturdays: May 28th, June 25th and, July 30th from 7PM to 9PM, with music from 7PM to 9PM,
and a rain date of Friday, August 26th with the same hours, subject to compliance with adopted
codes and regulations of the State of Connecticut, the Town of East Hartford, and any other
stipulations required by the Town of East Hartford or its agencies.

Riverfront Recapture, Inc.: Riverfront U.S. Title Series

to approve the outdoor amusement permit application, Riverfront U.S. Title Series, submitted
by Jessica Leone, Public Events Manager, for Riverfront Recapture to conduct professional
power boat races on the Connecticut River, launched out of Great River Park on the following
dates and times in 2011:

Friday, Sept 2nd        Setup/Boat Testing                9AM to 5PM
Saturday, Sept 3rd    Racing 10AM to 5PM, music Noon to 4PM
Sunday, Sept 4th      Racing 12PM to 5PM, music Noon to 4PM

Additionally, the applicant seeks authorization to sell or dispense alcoholic beverages in
connection with this event under the provisions of Section 14-7(b) and Section 14-10 (13)
of the Town of East Hartford Code of Ordinances; subject to compliance with adopted codes
and regulations of the State of Connecticut, the Town of East Hartford, and any other
stipulations required by the Town of East Hartford or its agencies.

Head of the Riverfront Rowing Regatta

to approve the outdoor amusement permit application submitted by Jessica Leone,
Public Events Manger, for Riverfront Recapture, Inc. to conduct a rowing regatta on the
Connecticut River beginning at the Charter Oak Landing in Hartford on Sunday,
October 2, 2011 from 7AM to 4PM, subject to compliance with adopted codes and
regulations of the State of Connecticut, the Town of East Hartford, and any other
stipulations required by the Town of East Hartford or its agencies.

Waiver of Qualifications: Temporary Acting Town Clerk

                to adopt the following resolution:

Waiver of Qualifications: Acting Town Clerk/Registrar of Vital Statistics

WHEREAS, Mayor Leclerc wishes to temporarily appoint Patricia Consalvo as Acting Town Clerk/Registrar of Vital Statistics; and
WHEREAS, Patricia Consalvo possesses a certification from the State of Connecticut as a certified Connecticut Town Clerk; and

WHEREAS, the qualifications listed in Section 2-115 of the Town of East Hartford Ordinances requires the Town Clerk/Registrar of Vital Statistics to have a Bachelor’s Degree in Business or Public Administration or a closely related field (the “Educational Qualification”); and
WHEREAS, Patricia Consalvo does not hold the Educational Qualification, but has substantial practical work experience for the Town with land and vital statistic records, general and special election procedures, town government records and license and fee schedules; and

WHEREAS, Section 2-114 of the Town of East Hartford Ordinances allows the Town Council to waive the Educational Qualification.

NOW, THEREFORE, BE IT RESOLVED that the Town Council waive the Educational Qualification for the appointment of Patricia Consalvo as Acting Town Clerk/Registrar of Vital Statistics.

OPPORTUNITY FOR COUNCILLORS TO DIRECT QUESTIONS TO THE ADMINISTRATION

Ram Aberasturia asked that the Council consider an alternate method to disposing used-equipment from the Board of Education by selling that equipment on eBay and using the proceeds of any sales to fund scholarships for East Hartford students.  Chair Kehoe suggested that this matter be referred to the Town Council’s Town-owned Property Other Than Real Estate subcommittee for further discussion.

Pat Harmon (1) inquired on the status of the construction of the new firehouse on Brewer Street – specifically if the project is on budget and if it’s on schedule for completion; (2) asked what the progress is on the $900M granted to the town for the construction or remodeling of a new senior center; (3) heard that there was going to be electronic garbage receptacles installed along Main Street and wanted confirmation from the Mayor; and (4) inquired on the salary changes for the Directors of Public Works, Finance, Parks and Recreation, and Finance.

Bill Horan reminded all that April 30th is the opening day for East Hartford Little League at Gorman Field.

Eric Thompson (1) asked if the salary increases for the Finance Director and the Parks and Recreation Director that been proposed in the Mayor’s recommended budget will be implemented; (2) requested contact information for the new East Hartford Police Department liaison; and (3) asked if there is more information available for the upcoming joint meeting with the East Hartford Housing Authority.

OPPORTUNITY FOR RESIDENTS TO SPEAK

Mayor Leclerc (1) announced that the East Hartford Police Department has been actively enforcing the “Distracted Driving” law and will provide the statistics to the Council office; (2) invited the Councillors to join her on a walk-through of the new firehouse on Brewer Street at 6PM on Tuesday, May 3rd, and (3) reported that she was with Senator LeBeau at the State Capitol inquiring on PILOT funds and advocating with the Connecticut Conference of Municipalities.
