CALL TO ORDER
Chair Kehoe called the meeting to order at 7:43 p.m. He announced the exit locations in
accordance with Connecticut General Statutes § 29-381, after which the Council joined him in the pledge of allegiance.
OPPORTUNITY FOR RESIDENTS TO ADDRESS THE COUNCIL ON AGENDA ITEMS
Mayor Currey (1) stated that in preparation for the start of single stream recycling on July 1st, informational packets will be attached to the new barrels that will be sent to all homeowners. Contained within that packet will be the pick-up schedule for both recycling and normal garbage collection, and what is considered acceptable recycling items; and (2) announced that spring clean up on Main Street – Bridge to Bridge – will be on Saturday, May 15th.

COMMUNICATIONS AND PETITIONS
Assistance at Kleen Energy Plant, Middletown
Mayor Currey acknowledged a letter from Middletown Mayor Sebastian Giuliano, that
praised the efforts of East Hartford’s Fire Department and CERT members who
participated in the search and rescue operation at the site of the tragic explosion of the
Kleen Energy plant. Assistant Fire Chief Will Perez read the names of those volunteers
who were recognized as Mayor Currey distributed Town of East Hartford pins to those
volunteers who were present. The following is a list of those people involved in the Kleen
Energy plant rescue operation:

Outdoor Amusement Permit Application: Abelon Memorial Walk/Car Show
Approval of Application

to approve the outdoor amusement permit application from Rachel Buck,
CIBA Student Advisory Board, to conduct a car show and fundraising walk
to raise public awareness of the cause and effects of pancreatic cancer on
the grounds of the Connecticut International Baccalaureate Academy, 857
Forbes Street, on Saturday, May 15, 2010 from approximately 8AM to
5PM, as follows: the walk will commence at 10AM beginning at CIBA and
following Forbes Street to the Sunset Ridge School and then back to CIBA;
the car show portion will begin at noon; subject to compliance with adopted
codes and regulations of the State of Connecticut, the Town of East
Hartford, and any other stipulations required by the Town of East Hartford
or its agencies.

Recommendations from Real Estate Acquisition & Disposition Committee:
Acquisition of Interest in Property Owned by the State of Connecticut (Easterly Section of Right-of-Way Along Route 2)

to recommend that the Town Council authorize the Mayor to execute a
license agreement with the State of Connecticut, upon such terms as the
Mayor deems most favorable to the Town, allowing the Town to maintain a
sheet pile cutoff wall as part of its flood control system along a portion of
the State-owned Route 2 Right of Way as shown on a May 2009 map
prepared by GEI Consultants, Project 081210, entitled “PROPOSED
MEADOW HILL PUMP STATION CUTOFF WALL.”

Burnside Avenue Drainage Outfall Reconstruction Easement Acquisitions: 3-33 Church Street

as Grantor, and the Town of East Hartford, as Grantee, which Easement

owned by The St. Rose Church Corporation of Burnside and known as No.
3-33 Church Street, which Easement and Drainage Rights are more
particularly described on a map entitled:

Subordination of Drainage Rights/Land Abutting Willow Brook at 400 Main Street

to recommend that the Town Council authorize the Mayor to execute a
subordination agreement through which the Town will subordinate a certain
easement granted by Joseph J. Peltz and J. H. Tichenor to the Town
(recorded April 18, 1951 in Volume 173 at Page 509 of the East Hartford
Land Records) and a certain easement granted by Stone and Goldberg
Associates to the Town (recorded November 20, 1979 in Volume 715 at
Page 280 of the East Hartford Land Records) to the lien and operation of
Declaration of Environmental Land Use Restrictions to be executed
between the State of Connecticut Department of Environmental Protection
and United Technologies Corporation.

Municipal Tax Exempt Lease Purchase Financing for the 5-year Capital Improvement Plan

to adopt the following resolution:
WHEREAS, the Town of East Hartford intends to purchase various capital equipment as part of the Town of East Hartford’s Approved 5-Year Capital Improvement Plan for the Years 2010-2011 through 2014-2015; and
WHEREAS, the cost of the various capital equipment and replacement furniture designated for lease-purchase financing totals $2,148,850; and
WHEREAS, the Town will budget $383,564 for two years, $436,542 for three years and $145,162 for two years beginning in fiscal year 2011-2012 in the General Operating Fund to pay principal and interest for the purchases.
THEREFORE BE IT RESOLVED, that the Mayor of the Town of East Hartford is authorized to enter into a master lease purchase agreement and related documents with Chase Equipment Finance, Inc. in the principal amount not to exceed $2,148,850. The interest rate, payment schedule and other details of the financing shall be mutually determined between the company and the Mayor, whose signatures will indicate approval of specific terms and conditions.
BE IT FURTHER RESOLVED, that the Town declares its intent to be reimbursed for any temporary advances from the General Fund to pay for any part of the equipment from proceeds of the lease financing in accordance with Treasury Regulation 26 CFR 1.103-18 and/or 26CFR1.150-2.

Arbitration Award: East Hartford Police Officers’ Association July 1, 2007 through June 30, 2012

to approve the arbitration award regarding the East Hartford Police
Officers’ Association – Case #2008-MBA-48 (Sworn Police Officers) for the
period July 1, 2007 through June 30, 2012, as referenced in a memo from
Frank Cassetta, Assistant Corporation Counsel to Richard Kehoe, Town
Council Chair dated April 19, 2010.
Motion carried 8/0.
Note: Once fully executed, a copy of the police contract will follow these minutes.
OPPORTUNITY FOR COUNCILLORS TO DIRECT QUESTIONS TO THE ADMINISTRATION
Susan Skowronek stated that she has received several calls regarding the need for some spring clean up at Dwyer Park, especially with spring and summer approaching. Also, the neighbors would like more police presence in that area at night.
Rich Kehoe said that it was brought to his attention by a resident that there is a pothole on the corner of Balsam and Wildflower Roads.
COUNCIL ACTION ON EXECUTIVE SESSION MATTERS
AUM Realty LLC v. Town of East Hartford

to accept the recommendation of the Corporation Counsel’s
office to settle the tax appeal case entitled AUM Realty, LLC v.
Town of East Hartford and to authorize the Town Assessor
to reduce the fair market value of the property located at
333 Roberts Street, owned by AUM Realty, LLC, to the sum of
$3,000,000.00, subject to rounding, beginning with the Grand
List of October 1, 2008; further that neither party will be entitled
to fees or costs of any kind; further that if the plaintiff is entitled
to a refund of taxes paid, the refund will be deducted from the
next installment of taxes.

Somnath Inc. v. Town of East Hartford

to accept the recommendation of the Corporation Counsel’s

$1,413,125.00, subject to rounding, beginning with the Grand

next installment of taxes.

Bill Horan announced the opening day for East Hartford Little League is Saturday, April 24th at Gorman Park and urged all to attend.
