REGULAR SESSION MEETING MINUTES
PLANNING AND ZONING COMMISSION
NOVEMBER 13, 2013

A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in Town Council Chambers, 740 Main Street, East Hartford, Connecticut on November 13, 2013.

CALL TO ORDER

The meeting was called to order at 8:07 PM.

ROLL CALL

Present:

Chairman Anthony Kayser declared a quorum and the Commission would be voting with 7members.


SITE PLAN APPLICATION – 180 Goodwin Street, Installation of a 234 kw dc roof-mounted solar system and associated ground equipment.
Applicant: David Heller, President of Allan S. Goodman, Inc.

Upon a motion by Thomas Fitzgerald, seconded by Mary Whaples, the Commission Voted (7-0) to approve the above application, with the following condition:

  •       Final plans and mylars are to be signed and sealed by the professional engineer or land   
       surveyor licensed in the State of Connecticut that is responsible for the work.
  • Provide Planning and Zoning Commission Site Plan Approval Block on cover sheet
        located in the Town of East Hartford Design Manual.
  • Provide Engineering Division Standard note for scheduling of inspections located
             in the Town of East Hartford Design Manual.
  • Provide a dimension on the concrete pad section detail for the top of pad elevation
             above existing grade.
  • Provide a map reference on the cover sheet for the PDS Engineering plan for A-2
             survey/Site Plan.
  • Clarify the Equipment Layout & Interconnection Detail shown on the Overall Site
             Plan located on the cover sheet.
  • Provide a general note that all disturbed areas shall receive 6" of topsoil and turf
             establishment.


SITE PLAN APPLICATION – 701 Main Street, Installation of a handicap access ramp to an existing    
 commercial building.
Applicant: JRI Advisors LLC

Upon a motion by Kathleen Salemi, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the above application, with the following conditions:

  • Final plans and mylars are to be signed and sealed by the professional engineer or land surveyor licensed in the State of Connecticut that is responsible for the work.
  • Include a note for “Call Before You Dig”
  • Verify the status of underground utilities.
  • Graphically depict limits of disturbance, limit of saw cut in the vicinity of the work.
  • Include construction details including restoration details.  See Manual of Technical Design for typical restoration details.
  • Provide a scale for the detail of the accessible concrete ramp.
  • Provide a benchmark
  • Check the proposed grades in the detail.
  • Provide the approval block and inspection note.

SPECIAL PERMIT USE APPLICATION – Under section 405.2(b) to allow the installation of a non-
profit donation drop-off box on property located at 20 Burnside Avenue.

Upon a motion by Kathleen Salemi, seconded by Travis Simpson, the Commission Voted (7-0) to approve the above application, with the following conditions:

  • Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
  • No title, date or certification on plans submitted. Supply a map reference for the plan submitted.  

SPECIAL PERMIT USE APPLICATION – Under Section 403.2(a) to allow an automobile repair garage on land located at 400 Governor Street

Upon a motion by Travis Simpson, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the above Special Permit Use application with the following conditions:

  • Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
  • Show details and limits of construction for curb and sidewalk construction and tie-in to existing.

SITE LOCATION APPROVAL – 400 Governor Street under C.G.S. Section 14-54 for the establishment of a general repairs license. “Governor’s Auto Body D/B/A Governors Motor Sports”

Upon a motion by Travis Simpson, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the above Site Location approval, with the following conditions:

1. Applicant shall obtain a certification of completion prior to signature of the Chairman of the Town
    Planning and Zoning Commission on the State of Connecticut Department of Motor Vehicles K-7
    form.
2. Applicant’s Site Location Approval shall be limited to the site plan entitled: General Repair License   
    Application Drawing Prepared for Governor’s Auto Body d/b/a Governors Motor Sports 400 governor
    Street East Hartford, Connecticut, dated 4-23-13 revised to 11-1-13 prepared by The Bongiovanni
    Group, Inc. Land Surveyors 170 Pane road Newington, Connecticut 06111 Tel. (860)666-0134

3. Applicant shall provide documentation that 400 Governor Street parcels have been combined by deed
     prior to signature of the Chair of the Town Planning and Zoning Commission on the State of
     Connecticut Department of Motor Vehicles K-7 form.
4. Approved plan shall not be modified for licensing purposes without written authorization from the East
    Hartford Town Planning and Zoning Commission.
5. In evaluating this application, the Town Planning and Zoning Commission has relied upon information
    provided by the applicant and, if such information subsequently proves to be false, deceptive,
    incomplete, and/or inaccurate, this permit shall be modified, suspended or revoked.


APPLICATION FOR ZONING TEXT AMENDMENT - Add new special permit section to Industrial II (I-2) & Industrial III (I-3) zones to allow a Marijuana Production Facility with specific requirements, add new special permit section to Business 3 (B-3) zone to allow Marijuana Dispensary Facility with specific requirements, and add new wording to Section 200 definitions.

Upon a motion by Thomas Fitzgerald, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the above Zoning Text Amendment application, with an effective date of 15 days after public notice.


REVIEW OF CORRESPONDENCE

  • Correspondence from Robert Switala, PE, with Bergmann Associates regarding Buckeye Pipeline   
      Company proposed pipeline repair in Kenney Cove.
Upon a motion by Peter Bonzani, seconded by Kathleen Salemi, the Commission Voted (7-0) to approve the proposed pipeline repair in Kenney Cove by the Buckeye Pipeline Company as outlined in correspondence from Robert Switala, PE, with Bergmann Associates.
8-24 REFERRALS
  • Easement Modification Acquisitions for roadway drainage and public sidewalks adjacent to 1-5 Riverside Drive.
Upon a motion by Travis Simpson, seconded by Kathleen Salemi, the Commission Voted (7-0) to approve the proposed easement modification acquisitions for the roadway drainage and public sidewalks adjacent to 1-5 Riverside Drive in front of the Connecticut River Academy.


APPROVAL OF MINUTES

  • Regular Session Minutes – October 9, 2013
Upon a motion by Mary Whaples, seconded by Paul Roczynski, the Commission Voted (4-0-3) to approve the Regular Session Minutes of October 9th with the following correction: to rescind the motion for the Raymond Library made at the October 9th Design Review Meeting and substitute the following in its place: to approve the 8-24 referral for the 99-year lease with the Raymond Library Company of East Hartford and the Village Improvement Society of East Hartford for the use of 840 Main Street, and associated parking, as the town’s public library.  Abstain: Bonzani, Salemi, Fitzgerald

  • Workshop Minutes – October 23, 2013
Upon a motion by Paul Roczynski, seconded by Travis Simpson, the Commission Voted (7-0) to approve the Workshop Minutes of October 23rd.


ADOPTION OF 2014 TOWN PLANNING AND ZONING COMMISSION MEETING SCHEDULE / CLOSE OUT DATES

Upon a motion by Paul Roczynski, seconded by Mary Whaples, the Commission Voted (7-0) to approve the 2014 Town Planning and Zoning Commission Meeting Schedule and Close Out Dates.


MISCELLANEOUS

Travis Simpson inquired on the replacement of certain mobile homes at Rivermead Park.

Anthony Kayser noted that there is a sign advertising buying junk cars on an empty lot on Tolland Street.
