REGULAR SESSION MINUTES
PLANNING AND ZONING COMMISSION
MARCH 13, 2013


A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on March 13, 2013.

The meeting was called to order at 9:02 p.m.

CALL TO ORDER

Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Mary Whaples would be voting in place in Kathy Salemi and be acting secretary, and Crystal Hernandez would be voting in place of Pete Bonzani. Additionally, Chairman Kayser stated that the Commission would be voting with six members.

APPOINTMENT OF DESIGN REVIEW REPRESENTATIVE

Upon a motion by Paul Roczynski, seconded by Mary Whaples the Commission Voted (6 -0) to appoint Jeff Cummings as the Design Review Committee Member.

APPROVAL OF MINUTES

Regular Session Meeting – February 13, 2013

Staff noted that a correction needed to be made to the Plan of Conservation and Development Generalized Land Use Map Amendment Application.  The vote should be amended to also state “setting the effective date 15 days from the date of the legal advertisement of decision”.  Upon a motion by Paul Roczynski, seconded by Tom Fitzgerald, the Commission Voted (4-0) to Approve the above minutes with corrections.  Mary Whaples and Crystal Hernandez did not vote due to their absence from the meeting.

SPECIAL PERMIT USE APPLICATION- Under section 207.9 & 207.10 to allow expansion of a previously approved special permit use on land located at 28,36,40 Central Avenue & 840 Main Street A.K.A Raymond Library.
Assessor’s Map# 13, Lots# 335, 336, 337, & 338
Applicant: Town of East Hartford, Timothy A. Bockus Director of Public Works

Upon a motion by Mary Whaples, seconded by Paul Roczynski, it was Voted (6-0) to Approve the above Special  Permit Application.

SITE PLAN APPLICATION- 28,36,40 Central Avenue & 840 Main Street A.K.A Raymond Library, Construction of an 14,000 square foot addition and parking lot expansion to an existing municipal library.
Applicant: Town of East Hartford, Timothy A. Bockus Director of Public Works

Upon a motion by Paul Roczynski, seconded by Crystal Hernandez, it was Voted (6-0) to Approve the above Site Plan Application with the following conditions:

1.      In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
2.      Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
3.      Provide separate plans for each application and label them accordingly.
4.      On Sheet 3, add notes to clarify the use of park curbing for the curbing installation on Central Avenue and add notes and dimensions to the plan for the specify the installation of the concrete transformer pad.
5.      On Sheet 4, verify if existing utility connections are adequate to support the proposed addition and graphically depict and add notes to specify the replacement of the existing underground electrical service.
6.      On sheet 4, graphically depict and add notes to specify the limits of sawcut and permanent pavement repair within Central Avenue for the proposed utility connections.
7.      On Sheet 5, add to the sheet all construction details necessary to construct the proposed improvements including but not limited to: permanent pavement restoration detail and clarify the Central Avenue Curbing detail to specify 5” height from the binder course of pavement.
8.      Revise the lighting plan to comply with maximum lighting levels at the property line that are specified within the zoning regulations and relocate the proposed electrical transformer to a point adjacent to the building.

SOIL EROSION AND SEDIMENTATION CONTROL APPLICATION - 28,36,40 Central Avenue & 840 Main Street A.K.A Raymond Library, Construction of an 14,000 square foot addition and parking lot expansion, landscaping and associated storm-water drainage improvements to an existing municipal library.
Applicant: Town of East Hartford, Timothy A. Bockus Director of Public Works

Upon a motion by Paul Roczynski, seconded by Tom Fitzgerald, it was Voted (6-0) to Approve the above Soil Erosion and Sedimentation Application with the following conditions:

1.      Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
2.      Provide separate plans for each application and label them accordingly.

APPLICATION FOR ZONING TEXT AMENDMENT- To replace the existing Business I-A (B-1-A) zone with a new Business VI (B-6) zone and to add new wording to Section 200 definitions, Section 209 parking regulations, and Section 203 buffer strips.
Applicant: East Hartford Town Planning and Zoning Commission

Upon a motion by Mary Whaples, seconded by Paul Roczynski, it was Voted (6-0) to Approve the above Text Amendment Application and setting the effective date 15 days from the date of the legal advertisement of decision.

ZONE CHANGE APPLICATION – Business I (B-1), Business IA (B-1A), & Residence II (R-2) to Business VI (B-6), & Industrial II (I-2), on lands located off Silver Lane on the north and south side approximately between Gould Circle and Forbes Street and other parcels located off Roberts Street north of I-84, East of Forbes Street north of Ridgewood Road, parcel know as 711 Silver Lane, and two parcels know as 889 & ~891 Silver Lane.

REVIEW OF CORRESPONDENCE

  • Correspondence from the Metropolitan District Commission dated March 5, 2013 regarding Wickham water storage facility improvements.
It was the consensus of the Commission not to require Special Permit Use Application for this previously approved special permit use.

  • Memorandum from Mr. Greg Grew; Director of Permits and Inspection dated March 6, 2013 regarding ZBA Variance Granted For Store Expansion At 1387 Forbes Street.

It was the consensus of the Commission to indicate to the Director of Permits and Inspection that the proposed interior alteration to expand the retail area constitutes an increase in the volume of a non conforming use which is not allowed under Section 205 Non Conforming Uses Subsection 205.1(c).

Upon a motion by Paul Roczynski, seconded by Tom Fitzgerald, it was Voted (6-0) to Approve the above 8-24 Referral.

DISCUSSION REGARDING THE EAST HARTFORD ZONING BOARD OF APPEALS DECISION FOR 1375 SILVER LANE.

The Commission discussed the ZBA decision.

DISCUSSION REGARDING CHANGING THE JUNE 12, 2013 PUBLIC HEARING MEETING DATE.


Upon a motion by Tom Fitzgerald, seconded by Paul Roczynski, it was Voted (6-0) to Approve changing the above public hearing meeting date to June 5, 2013.

MISCELLANEOUS

CRCOG Alternate Representative

Upon a motion by Paul Roczynski, seconded by Tom Fitzgerald, the Commission Voted (6-0) to appoint Crystal Hernandez as the CRCOG Alternate Representative.

Upon a motion by Paul Roczynski, seconded by Val Povinelli, the Commission Voted (6-0) to Adjourn the meeting. The meeting was adjourned at 9:37 p.m.
