REGULAR SESSION MINUTES
PLANNING AND ZONING COMMISSION
September 9, 2009


A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on September 9, 2009.

The meeting was called to order at 10:09 p.m.

Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Mary Whaples would be voting in the absence of Elaine Carey and would also be acting secretary the evening. Chairman Kayser stated additionally, that the Commission would be voting with five members

APPROVAL OF MINUTES

Upon a motion by Paul J. Roczynski , seconded by John Ryan, the Commission
Voted (5-0) to Approve the above minutes.

SPECIAL PERMIT USE APPLICATION: Under Section 207.10 (a) to allow    
incubator space for a proposed magnet high school use on land located at
403 Main Street & 2 King Court
Assessor’s Map #10 Lot #108,109 &139
Applicant: Capital Studio Architects; David Holmes

Upon a motion by Mary Whaples, seconded by John Ryan the Commission
Voted (5-0) to Approve the above Special Permit Application with the following conditions:

  • Final plans are to be signed and stamped (ink & impression) by the Professional Engineer and Land Surveyor.
  • Provide separate plans for each application and label accordingly.
  • On the one half mile radius map provide the location of the affected property boundaries per section 207.4.b.2 of the zoning regulations.
  • In compliance with section 207.7 (c) special permit use to allow incubator space for a proposed magnet high school use on land located at 403 Main Street & 2 King Court shall expire five years from the date of this approval.

off-site parking at 399 Main Street to serve as required parking for a
magnet high school use on land located at 403 Main Street and 2 King Court.

Upon a motion by John Grottole, seconded by Paul J. Roczynski, the Commission
Voted (5-0) to Approve the above Special Permit Application with the following conditions:

  • Final plans are to be signed and stamped (ink & impression) by the Professional Engineer and Land Surveyor.
  • Provide separate plans for each application and label accordingly.
  • On the one half mile radius map provide the location of the affected property boundaries per section 207.4.b.2 of the zoning regulations.

SITE PLAN APPLICATION – 403 Main Street, Construction of an addition to an existing office building.
Applicant: Capital Studio Architects, LLC.

Upon a motion by John Grottole, seconded by Mary Whaples, the Commission
Voted (5-0) to Approve the above Site Plan Application with the following conditions:

  • In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.
  • Final plans are to be signed and stamped (ink & impression) by the Professional Engineer and Land Surveyor.
  • Provide separate plans for each application and label accordingly.
  • On the title sheet, provide a detailed parking calculation table demonstrating that the proposal meets the requirements set forth in the zoning regulations the calculation shall be broken down by each lot, use, existing, required, provided, etc.
  • On the site plan sheet C1, Provide additional dimensions and layout information for the proposed parking lot striping on the northern parking lot bays.
  • On site plan sheet C1, specify that the proposed handicap parking signs are to be bollard mounted.
  • Provide an access easement agreement to permit the bus drop-off and parking on no. 399 Main Street, and provide documentation that it has been filed on the land records.
  • On site plan sheet C1, replace the existing 15” Reinforced Concrete Pipe that passes beneath the southern end of the building with cast iron pipe or relocate the pipe outside of the footprint of the building, and connect the proposed roof leaders to the drainage system.
  • On site plan sheet C1, on the proposed water line and drainage lines provide a sawcut limit and provide notes specifying permanent pavement patch.
  • On site plan sheet C1, clarify on the plan, possibly with an inset detail and revise as necessary how the proposed catch basin is to drain the proposed depression.
  • Site plan modification bond set in the amount of $18,000.00.

FINAL RESUBDIVISION APPLICATION “Homes on King Street”
333,334,338,342,360,380, & 400 King Street –  
Preliminary Approval, Five (5) Lots on 4.89 acres of land located at
333, 334, 338, 342, 360, 380, & 400 King Street.
Assessor’s Map# 28 Lots# 92, 93, 94, 95, 96, 97, & 167
Applicant: Premier Building & Development Inc. &  Jetmore Construction, LLC

Upon a motion by Mary Whaples, seconded by John Ryan, the Commission Voted (4-1) (John Grottole voted in opposition) to Approve  the above final resubdivision application with the following modifications:

  • Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
  • Provide separate applications for each application and label accordingly.
  • Provide a letter from the Metropolitan District stating that there is adequate water and sewer capacity in Burnham and King Streets to support the subdivision.
  • Revise the water quality basin outlet structure details to match the computations and plans with respect to grate size, grate elevation, pipe sizes, etc.  Also revise the outlet structure top  to include a drop inlet to reduce clogging such as a type “C-G” catch basin top.
  • Proposed lot grading , tree clearing, berm establishment and landscaping on the easterly side of lot five adjacent to 7 Burnham Street and 17 Pheasant Lane shall be coordinated and approved by the Town Planner and the Town of East Hartford Tree Warden. Additionally, prior to the issuance of certificate of occupancy to lot five proof of the establishment and filing on the Town of East Hartford land records of a fifteen foot conservation area along the property line of 7 Burnham Street and 17 Pheasant lane shall be provided. A note shall be placed on the final mylar
        stating the requirement of such a proposed easement.
  • Subdivision bond approved in the amount of $38,000.00.
Upon a motion by John Ryan, seconded by Paul J. Roczynski, the Commission Voted
(5-0) to  Approve the following waivers:

  • Section 5.4J (5d)               Placement of monuments at each corner and angle point’s of the boundary
  • Section 8.9C                    Sidewalks

SOIL EROSION AND SEDIMENTATION CONTROL APPLICATION-

Upon a motion by Paul J. Roczynski, seconded by John Ryan, the Commission Voted
(4-1) (John Grottole voted in opposition) to Approve the above Soil erosion and sedimentation control Application with the following conditions:

  • Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
  • Provide separate plans for each application and label accordingly.
  • On sheet EC-1, provide a signature block per section 217.6 of the zoning regulations.
  • On sheet D-2, provide the information requested in sections 217.3.d.6&7 of the zoning regulations.

REVIEW OF CAPITAL REGION COUNCIL OF GOVERNMENTS DRAFT REGIONAL PLAN OF CONSERVATION

It was the consensus of the Commission to have Commissioners contact staff directly with any and all comments or concerns.
