REGULAR SESSION MINUTES
PLANNING AND ZONING COMMISSION
August 19, 2009


A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on August 19, 2009.

The meeting was called to order at 8:18 p.m.

Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Travis Simpson would be voting in the absence of Elaine Carey and that Mary Whaples would be voting in the absence of Thomas Fitzgerald. Chairman Kayser stated additionally, that the Commission would be voting with seven members

APPROVAL OF MINUTES

  • Design Review Minutes – June 24, 2009
Upon a motion by John Ryan, seconded by Travis Simpson, the Commission
Voted (6-0) to Approve the above minutes. Kathleen Salemi did not vote due to her absence from the meeting.
  • Workshop Minutes - August 5, 2009
Upon a motion by Paul J. Roczynski seconded by John Grottole the Commission Voted (5-0) to Approve the above minutes. Mary Whaples and Kathleen Salemi did not vote due to their absence from the meeting.

SPECIAL PERMIT USE APPLICATION: Under Section 207.10 (a) to allow    
incubator space for a proposed magnet high school use on land located at
403 Main Street & 2 King Court

Upon a motion by Travis Simpson, seconded by John Grottole the Commission
Voted (7-0) to Postpone the above Special Permit Application prior to the public hearing and acknowledged a waiver of the sixty-five day requirement.

SPECIAL PERMIT USE APPLICATION: Under Section 209.2 to allow    
off-site parking at 399 Main Street to serve as required parking for a
magnet high school use on land located at 403 Main Street and 2 King Court.

Upon a motion by Travis Simpson, seconded by John Grottole the Commission
Voted (7-0) to Postpone the above Special Permit Application prior to the public hearing and acknowledged a waiver of the sixty-five day requirement.

SPECIAL PERMIT USE APPLICATION – Under Sections 403.2 (l), & 222
to allow a liquor store within an existing commercial building on land located at 1227  Burnside Avenue.

Upon a motion by Kathleen Salemi, seconded by John Ryan, the Commission
Voted (7-0) to Approve the above Special Permit Application.

SPECIAL PERMIT USE APPLICATION: Under Sections 207.9 & 207.10(a) to    
allow modification of a previously approved special permit for the expansion of an    
existing educational use into three buildings formerly used for residential purposes on land located at 474 School Street A.K.A Polaris Center.

Upon a motion by John Grottole, seconded by John Ryan, the Commission
Voted (7-0) to Approve the above Special Permit Application with the following conditions:

1. Educational use expansion shall be limited to Lincoln House only, the   
    Achievement House and Merit Progress House shall remain vacant until future     
    zoning approvals are sought and received.

     2. Final plans are to be signed and stamped (ink & impression) by the Professional   
          Engineer and Land Surveyor.


  3. Final plans are to be provided for each individual application and labeled     
       accordingly.

  4. Revise mapping to depict the inland wetland upland review area that appears to be    
       located on the northern portion of the site from the current Town of East Hartford     
       Inland Wetland mapping.

5.  On sheet L-l.1, graphically depict the half-mile offset radius from the site and label    
     accordingly.  Graphically depict the 200 foot offset radius and label accordingly.

SITE PLAN APPLICATION – 474 School Street A.K.A “Polaris Center,   
Installation of handicapped ramp / sidewalks and exterior doors and lighting to an  
existing school.
Applicant: Gus Penna, Project Manager, CREC

Upon a motion by John Ryan, seconded by Paul J. Roczynski, the Commission
Voted (7-0) to Approve the above Site Plan Application with the following conditions:

1. In evaluating this application, the Planning and Zoning Commission has relied  
    upon information provided by the applicant and, if such information subsequently       
    proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be     
    modified suspended or revoked.

2. Educational use expansion shall be limited to Lincoln House only, the   
    Achievement House and Merit Progress House shall remain vacant until future     
    zoning approvals are sought and received.

3. Final plans are to be signed and stamped (ink & impression) by the Professional      
    Engineer and Land Surveyor.

4. Final plans are to be provided for each individual application and labeled    
    accordingly.

5. On the title sheet add the Town of East Hartford site plan approval block and   
    inspection note, include approval block on all plan sheets.

Existing Conditions Site Plan - Sheet L-1.0:

6. Add the inland wetland upland review area from the current Town of East Hartford    
    inland wetland mapping to the northern portion of the site.

Site Information - Sheet L-l.1:

7. Graphically depict the half-mile offset radius from the site and label accordingly.
8.   Graphically depict the 200 foot offset radius and label accordingly.
9.   Expand the bus turning movement graphic to include the Achievement and      
      Lincoln houses, use design vehicle appropriate for bus with handicapped       
      accessible capabilities.
10. Revise the parking and parking calculation table as necessary to satisfy Town of      
      East Hartford building department requirements.

Site Layout and Grading Plan - Sheet L-2.0

11. Revise note 6 in the layout notes to specify a minimum depth of topsoil of 6”.
12. Add erosion controls to both of the enlargement plans.
13. Specify an appropriate area of pavement repair where the driveways to the  
      Lincoln and Achievement house meet.
14. Show all proposed sidewalk at the building entrances on the enlargement plans to    
      coordinate with architectural drawings and comply with East Hartford Building           
      Department requirements.

Achievement House Enlargement - Sheet L-2.0:

15. Add a length dimension for the proposed accessible parking space, which needs to  
      be 20 feet long.
16. Revise width of parking space to meet minimum building code requirements,  
      change to a van accessible parking space.
17. Revise the handicapped sign to be bollard mounted to prevent a vehicle from  
      hitting the building.
18. Clarify all notes for proposed sidewalks, show all existing landscaping, and  
      provide information on restoration and protection of existing plantings.
19. Add a dumpster pad with gated enclosure with necessary details.

Lincoln House Enlargement - Sheet L-2.0:

20. Revise the handicapped sign to be bollard mounted to prevent a vehicle from  
      hitting the building, change to a van accessible parking space.
21. Clarify all notes for proposed sidewalks, add concrete sidewalk to the parking
      area and revise layout similar to the Achievement house.
22. Show all existing planting and protection of existing plantings.
23. Show the location of a proposed tree to replace the one that is to be removed.
24. Replace the enclosure around the existing dumpster pad with an appropriately   
      sized gated enclosure with necessary details.

Site Details - Sheet L-3.0:

25. Add all necessary details including: dumpster enclosure, fence with gate, bollard   
      mounted sign, and revise the handicapped parking space layout for van accessible.

26. Site plan modification bond set in the amount of  $13,000.00.

PRELIMINARY & FINAL SUBDIVISION APPLICATION
“Dill Property 1350 & 1366 Silver Lane” –Preliminary & Final Approval,
Three (3) Lots on 12.02 acres of land located at 1350-1366 Silver Lane.
Assessor’s Map #66 & 67 Lots #186 & 1
Applicant: Town of East Hartford; Billy G. Taylor; Director of Public Works

Upon a motion by Paul J. Roczynski, seconded by Kathleen Salemi, the Commission Voted (7-0) to Approve the above preliminary & final subdivision application with the following modification:

1. A note shall be placed on the final mylar stating that the septic system for the dwelling    
    at 1350 Silver Lane is non-functioning. A code complying system must be approved by   
    the Health Department and installed prior to occupancy of the existing residence.

Upon a motion by Paul J. Roczynski, seconded by John Ryan, the Commission Voted
(7-0) to  Approve the following waivers:

        1. Section 4.6D (10)    Valuable Site Resources Map
        2. Section 5.4J (5d)            Placement of monuments at each corner and angle point’s of the boundary
        3. Section 5.4K (Entire)        Conservation Plan
        4. Section 8.3N Plate 5 Sidewalks
        5. Section 8.4          Sanitary Waste Disposal
        6. Section 8.7 (Entire) Street Trees

  • Acquisition of property located at 1350-1366 Silver Lane “Dill Property”
Upon a motion by John Grottole, seconded by Travis Simpson, the Commission Voted (7-0) to Approve the above 8-24 Referral.

REVIEW OF CAPITAL REGION COUNCIL OF GOVERNMENTS DRAFT    
REGIONAL PLAN OF CONSERVATION      

It was the consensus of the Commission to place the Capital Region Council of Governments draft regional plan of conservation on the September agenda for consideration.

MISCELLANEOUS

  • Site Modification Bond Release – 35 Wrobel Place
           Applicant: Lynne Kleeberg

Upon a motion by Paul Roczynski, seconded by Travis Simpson, it was Voted (7-0) to Approve the bond release in the amount of $9,300.00.

  • Review of Correspondence from Attorney Robert DeCresenzo dated July 16, 2009 addressed to Richard Gentile; Assistant Corporation Counsel regarding environmental testing at 135 Riverside Drive.
It was the consensus of the Commission to require formal submission of a Flood Hazard Development Permit application for installation of monitoring wells within the one hundred year flood zone.
