A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on April 13, 2011.
The meeting was called to order at 10:19 p.m.

Chairman Anthony Kayser declared a quorum present and stated that the Commission would be voting with seven members.

2. APPROVAL OF MINUTES

Upon a motion by Paul Roczynski, seconded by Tom Fitzgerald, the Commission Voted (7-0) to Approve the above minutes.

3. SPECIAL PERMIT USE APPLICATION – Under Sections 402.2(b) & 228 to allow double drive-through facilities associated with a proposed 12,900 sq. ft. retail pharmacy building on land located at 972 Silver Lane & 403 Forbes Street.

Upon a motion by John Ryan, seconded by Tom Fitzgerald, the Commission Voted (7-0) to Approve the above Special Permit Use Application with the following conditions:
1. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the State of Connecticut that is responsible for the work.
2. Provide separate plans for each application and label them accordingly.

4. SITE PLAN APPLICATION: 972 Silver Lane & 403 Forbes Street to construct a 12,900 sq. ft. retail pharmacy building with double drive-through facilities, parking lot and associated storm water drainage system.

Upon a motion by John Ryan, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the above Site Plan Application with the following conditions:
- In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant, and if such information subsequently proves to be false, deceptive, incomplete, and/or inaccurate, this permit shall be modified, suspended or revoked.
- Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the State of Connecticut that is responsible for the work.
Provide separate plans for each application and label them accordingly.
- Proposed driveway curb cut on Forbes Street shall be geometrically designed as to prevent north bound on Forbes Street left hand turns into the site. Appropriate approved Manual Uniform Traffic Control Devises "MUTCD" traffic signs shall be employed prohibiting the north bound traffic on Forbes Street from making a left hand turn.
Proposed driveway on Silver Lane shall consist of three drive lanes (2 exiting and one entering) and shall have an appropriate traffic barrier installed to provide separation from automobiles entering and exiting the site.
- Site Plan Modification Bond set in the amount of $10,000.

Upon a motion by Peter Bonzani, seconded by Paul Roczynski, the Commission Voted (7-0) to Approve the above Soil Erosion and Sediment Control Application with the following conditions:
1. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the state of Connecticut who is responsible for the work.
2. Provide separate plans for each application and label them accordingly.
3. On sheets C-6, replace the construction entrance on Silver Lane that was proposed on the previous submission; remove the note specifying no construction access to Silver Lane.
4. On sheet C-6, revise depiction of the construction entrances to maintain the concrete for the existing sidewalks.

6. MAJOR FLOOD HAZARD DEVELOPMENT PERMIT - Under Section 601 to allow construction of bituminous concrete access driveways and parking lots, concrete sidewalks and retaining walls, installation of new site utilities, storm-water drainage system, landscaping associated with the construction of 103,000 square foot magnet high school and attached three level parking garage on land located at 1-5 Riverside Drive, 84 & 90 Colt Street.

Upon a motion by Peter Bonzani, seconded by Paul Roczynski, the Commission Voted (7-0) to Approve the above Major Flood Hazard Development Permit with the following conditions:
1. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the state of Connecticut who is responsible for the work.
2. Provide separate plans for each application and label them accordingly.
3. Provide a drainage report; report shall also include low point gutter flow calculations using CTDOT methodology for the proposed drainage improvements within Riverside Drive.
4. Revise the plan set per the comments within the site plan review.
5. On the plans, provide a calculation for the conversion of the flood elevations from the Datum used on the FIRM maps to the datum the plans utilize.
6. On all plan sheets where the proposed building is depicted, graphically depict the floodway, 100 year flood zone and 500 year flood zone.

7. On all plan sheets where the proposed building is depicted, graphically depict the deck and stairs that extends toward the Connecticut River.
8. On sheet L-200, for the sidewalk and stair leading down to the river’s edge specify that the trash receptacle, bench, and site lighting are to be flood proofed.
9. On sheet L-506, provide a detail for a flood-proof trash receptacle.
10. On sheet C-300 add a note to the plans that all areas within the 100yr flood plain shall be fully stabilized and have turf established prior to October 1st.
11. On sheet C-301, add a flood contingency plan to the specifications, level of detail shall include but not be limited to river level monitoring, plan for stabilizing the work area, plan for removing men, equipment, and materials from the floodplain, and emergency telephone numbers.
12. On sheet SL-101, provide a detail for a flood-proofed light fixture, pole, and appurtenances.
13. Provide details for all retaining walls that will be subject to inundation, retaining walls shall be designed by a Geotechnical Civil Engineer licensed in the State of Connecticut.

Upon a motion by John Grottole, seconded by Paul Bonzani, the Commission Voted (7-0) to Approve the above Site Plan Application with the following conditions:
1. In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant, and if such information subsequently proves to be false, deceptive, incomplete, and/or inaccurate, this permit shall be modified, suspended or revoked.
2. Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the State of Connecticut who is responsible for the work.
3. Provide separate plans for each application and label them accordingly.
4. Provide a site plan approval block and engineering inspection note on every sheet of the plan set.
5. Determine by testpit, the horizontal and vertical location of all proposed utility crossings/conflicts shown on the plans, add the testpit and information to the plans, and revise the utility layout to resolve utility conflicts.
6. On the plans, add specifications and details to properly handle the removal, stockpile, and disposal of contaminated soil.
7. Provide a traffic report, discussion shall include but not be limited to anticipated bus trips and adequacy of stacking provided for buses, anticipated parent drop-off, distribution of traffic to the south and north, and turning movement diagrams for the proposed loading area.
8. Provide a revised drainage report; report shall also include low point gutter flow calculations using CTDOT methodology for the proposed drainage improvements within Riverside Drive.
9. On sheet G-100, add a note to the plans specifying that the Contractor shall post a 100% performance bond for the work within the Town of East Hartford’s right-of way for their excavation permit.

10. On sheet G-101 and SS-200, graphically depict intersection sight distance from the proposed site driveways, add notes to specify and graphically depict clearing limits to achieve minimum sight distances. In addition, revise the landscaping plan to provide for intersection sight distance from the proposed driveways.
11. On sheet G-101 and the landscaping plan, remove proposed trees from the Town of East Hartford’s right-of-way. Applicant shall work with staff regarding the location of proposed trees within the Town of East Hartford’s right-of-way as shown on sheet G-101 landscaping plan. Staff shall report to the Commission on a potential solution.
12. On sheet SS-200, add a note to specify the removal of the sanitary lateral adjacent to CL&P pole #5658.
13. On sheet SS-200, add notes to the plan to abandon or protect and reset existing, or reinstall monitoring wells, and add construction details for the wells to the plans.
14. On sheet L-100, relocate the proposed sidewalks along Riverside Drive and Colt Street offset 1’ from the street line, and provide an easement to the Town of East Hartford for highway purposes for instances where proposed sidewalk extends over the streetline onto private property. Graphically depict these easements and provide documentation that the easements have been granted to the Town of East Hartford and filed on the land records.
15. On sheet L-200, coordinate the erosion control fabric specification to other sheets within the plan set.
16. On sheet L-200, add a CT transit bus stop sign to the proposed bus turnout area.
17. On sheet L-200 and SL-100, relocate the site lighting outside of the Town of East Hartford’s right-of-way and add a note to the plan specifying that the site lights, pole foundations, and conduit shall not be installed within the Town of East Hartford’s right-of-way. Applicant shall work with staff regarding proposed site lighting within the Town of East Hartford’s right-of-way as shown on sheet L-200 and SL-100. Staff shall report to the Commission on a potential solution.
18. On sheet L-200, add no parking signs to the snow bin snow storage area.
19. On sheet L-500, add additional site construction details which shall include but not be limited to: a cross-section for the gravel access driveway, a full-width cross section for the reconstruction of Riverside Drive, Town of East Hartford concrete sidewalk and permanent patch detail.
20. On sheet L-500, revise cross section number 3 to place the Class II on top of the class I pavement.
21. On sheet C-100, provide top of frame elevations for all reset monitoring wells, proposed manholes, and all existing manholes that are to be reset and paved around.
22. On sheet C-100, provide a detailed proposed profile with associated horizontal baseline for the reconstruction of Riverside Drive.
23. On sheet C-100, extend the limits of the Riverside Drive reconstruction to encompass the proposed grading that is shown.
24. On sheet C-101, provide slope labels for all proposed piping and revise the pipe from MH-1 to MH-11 to consist of concrete pipe.
25. On sheet C-101, revise the location of CB-29 to be located 10’ minimum from the SNET utility poles.
26. On sheet C-101, graphically depict and specify a proposed 20’x20’ drainage easement adjacent to the Riverside Drive right-of-way around manholes 22, 25, and 32 in favor of the Town of East Hartford. Provide evidence that the easements have been granted to the Town of East Hartford and filed on the land records, easements shall include rights to drain across the subject property to a suitable watercourse.
27. On sheet C-101, provide more detail on how the area drain within the tree well will be constructed and a construction detail.
28. On sheet C-101, add a drainage structure to the snow bin snow storage area to collect snow melt and to capture it before it flows onto the public sidewalk.

29. On sheet C-200, graphically depict where all testpits are conducted to determine the location of existing utilities, add testpit results and readings to the plan, and revise the utility design to resolve utility conflicts.
30. On sheet C-200, add an oil water separator with detail to the sanitary line from the parking structure, clearly specify on this sheet and sheet C-101 which levels of the parking structure drain to sanitary and to the storm drainage system.
31. On plan sheet C-200, add invert elevations to the sanitary manhole schedule and graphically depict all underground conduit for the proposed site lighting.
32. On sheet C-401, modify the trench detail to account for contaminated soil when it is encountered during construction.
33. On sheet SL-100, add the property boundary to the plan and graphically depict all underground conduit for the site lighting.
34. Provide sheet RW-100 for review, it appears to be missing from the set, all retaining walls shall be designed by a Geotechnical Civil Engineer licensed in the State of Connecticut.
35. Within the drainage computations and plans, revise the invert elevations of the proposed storm drainage structures so that the computations coordinate with the plans.
36. Within the drainage computations, provide Hydraulic Grade Line Computations for review, revise plans as necessary to provide for 1’ of freeboard on all drainage structures.
37. Within the capacity computations, add a footnote noting that the runoff coefficients for YD15 and YD16 are assumed to be higher to account for future development.
38. Within the drainage computations and on the plans, coordinate the numbering of YD/MH 11,a,b,&c.
39. Within the plans and computations revise the last run of piping prior to the outfall to consist of reinforced concrete pipe.
40. Revise the drainage area map to show how the roof will be divided into the storm drainage system.
41. Provide gutter flow computations for the low point on Riverside Drive.
42. Site Plan Modification Bond set in the amount of $120,000.

On sheets C-300 and C-301, provide a signature block per section 217.6 of the zoning regulations.
On sheet C-300, provide inlet protection for all yard drains add temporary swales to direct water to the temporary sediment trap and basin, and provide sizing calculations for the temporary sediment trap and basin.
On sheet C-301, add notes for the construction, maintenance, and final restoration of the temporary sediment trap and basin, add notes to the plan to describe the operation and maintenance schedule of the permanent erosion controls and best management practices.
On sheet C-301, add additional details; including but not limited to: a covered stockpile, temporary sediment trap outlet temporary sediment basin outlet, erosion control blanket installation, diversion swale.
Revise the erosion control plan to account for and trap oil and/or other petroleum products encountered construction such as a oil absorbent booms or socks.

9. ZONING TEXT AMENDMENT APPLICATION - to Design Development District ~~~~~
~~~~ I (DDD1) regulations under Section 603.4.3.a.1, “Minimum Threshold Limits for Application” to specifically eliminate the requirement that subject parcel shall abut an existing Design Development District.

Upon a motion by Paul Bonzani, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the Zoning Text Amendment Application setting the effective date 15 days from the date of the legal advertisement of decision.

Upon a motion by John Ryan, seconded by Paul Roczynski, the Commission Voted (7-0) to approve the bond release in the amount of $4,070 for Goodwin Village.
