PLANNING AND ZONING COMMISSION
SEPTEMBER 12, 2012
A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on September 12, 2012.
The meeting was called to order at 8:37 p.m.

CALL TO ORDER
Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Travis Simpson would be acting secretary, and Crystal Hernandez would be voting in place of Kathy Salemi. Additionally, Chairman Kayser stated that the Commission would be voting with five members.

Design Review Meeting – August 8, 2012
Upon a motion by Tom Fitzgerald, seconded by Travis Simpson, the Commission Voted (3-0) to Approve the above minutes.

APPOINTMENT OF TOWN PLANNING AND ZONING COMMISSION ECONOMIC DEVELOPMENT COMMISSION REPRESENTATIVE
The matter was tabled to the October meeting agenda. No action taken.

SPECIAL PERMIT APPLICATION –~Under section 228 (h) to allow a twenty eight point nine (28.9) square foot menu board sign to an existing automobile oriented restaurant on land located at 268 Silver Lane.

Upon a motion by John Grottole, seconded by Tom Fitzgerald, the Commission Voted (5-0) to approve the above Special Permit Application.

ZONE CHANGE APPLICATION:~Master Plan modification request to construct a 2,045 square foot financial institution building within a previously approved Comprehensive Rehabilitation Zone (CDR) on 5.26 acres of land located at 893- 957 Main Street, & 20 Connecticut Boulevard.

Upon a motion by John Grottole, seconded by Crystal Hernandez, the Commission Voted (5-0) to approve the above Zone Change Application with the following condition:
1. Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.

SPECIAL PERMIT APPLICATION –~Under section 228 to allow drive- through facilities associated with the construct a 2,045 sq. ft. financial institution on land located at 957 Main Street.

Upon a motion by Travis Simpson, seconded by John Grottole, the Commission Voted (5-0) to approve the above Special Permit Application with a fifty percent reduction of the required queing spaces.

SITE PLAN APPLICATION – 957 Main Street, Construction of a 2,045 square foot financial institution, parking lot, landscaping and associated storm- water drainage.
Applicant: Farmington Bank
Upon a motion by Tom Fitzgerald, seconded by John Grottole, the Commission Voted (5-0) to approve the above Site Plan Application with the following conditions:
- In evaluating this application, the Planning and Zoning Commission has relied upon information provided by the applicant and, if such information subsequently proves to be false, deceptive, incomplete, and / or inaccurate, this permit shall be modified suspended or revoked.

2. Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
3. Provide separate plans for each application and label them accordingly.
4. Add a site plan signature block to each of the sheets within the plan set.
5. On Sheet C-1, revise general note 4 to specify 6” of topsoil and turf establishment, revise general note 8 to additionally specify conformance with STC regulations, and add a general note specifying that substitutions and modifications to the plan may be subject planning zoning commission approval depending upon their nature and extent.
6. On sheet C-4, add additional dimensions to the plan to layout and construct the proposed parking areas and provide dimensions for all accessible parking spaces.
7. On sheet C-4, revise the limits of sidewalk and paver repair adjacent to Main Street so that repair limits are square to the existing sidewalk and pavers.
8. On sheet C-5, revise the catch basin replacement notes to be more specific, include top of frame, invert, pipe diameter, and length information.
9. On sheet C-6, specify the replacement of sidewalk for the telephone connection in Governor Street and revise the pavement sawcut limits to a minimum of 2’ from the face of curbing to be reset.
10. On sheet C-6, graphically depict all lighting and underground conduit locations as well as all construction details necessary for the fixtures.
11. On sheet C-9, revise the catch basin detail to specify a 4’ deep sump, and provide all details necessary to construct the proposed improvements including but not limited to concrete pedestrian ramp, paver installation, and cast-in-place detectable warning tiles.
12. Final site plan shall depict the proposed tract “A” adjacent building foot print as shown on the approved Master Plan. It shall be identified as “Future Building”.

SOIL EROSION AND SEDIMENTATION CONTROL APPLICATION – 957 Main Street, Construction of a 2,045 square foot financial institution, parking lot, landscaping and associated storm- water drainage.

Upon a motion by John Grottole, seconded by Travis Simpson, the Commission Voted (5-0) to approve the above Soil Erosion and Sedimentation Control Application with the following conditions:
1. Final plans are to be signed and stamped by the Professional Engineer, Land Surveyor, or Architect licensed in the state of Connecticut who is responsible for the work.
2. Provide separate plans for each application and label them accordingly.
3. On Sheet C-7, add the NRCS soil types and provide contact information on the plan for the individual responsible for maintaining the proposed erosion controls.

Upon a motion by Travis Simpson, seconded by John Grottole, the Commission Voted (5-0) to approve the above Site Plan Application with the following conditions:

4. On sheet SP-1, provide additional existing feature information for the area in front of 399 Main Street and provide more information on how the proposed improvements tie into existing.
5. On sheet SP-1, provide concrete pedestrian ramps along the west side of the building to permit access to the accessible parking spaces.
6. On sheet SP-1, add notes along Crosby Street to specify granite curbing adjacent to the stamped concrete and bituminous curbing elsewhere.
7. On sheet GP-1, revise the grading adjacent to #17-19 Crosby Street, the proposed grading appears to depict a low-point without a means to drain it.
8. On sheet GP-1, revise the proposed grading adjacent to the proposed stormwater management area, there appears to be a 36 contour missing, additionally provide a minimum of 10’ of top width for the proposed berm.
9. On sheet GP-1, provide more information for the sanitary lateral as well as the electrical service for 2 King Court, and if necessary, graphically depict their relocation to accommodate the stormwater management area.
10. On sheet GP-1, revise the configuration of the hydrodynamic separator to coordinate with the construction details and provide a cleanout with invert at the end of the roof leader collection piping.
11. On the detail sheets provide the Town of East Hartford sidewalk detail for the work within the state and town right of way or revise the sidewalk detail to conform to it.
12. On sheet MD-2, revise the outlet structure detail to provide specifications for each of the orifice diameters.
13. Within the drainage computations, revise the outlet structure information to coordinate with what is shown on the plans and revise the starting water surface elevation within the hydraulic grade line computations to coordinate with the water surface in the stormwater management area.
14. Site Improvement Bond set in the amount of $4,600.00

REVIEW OF CORRESPONDENCE
- The Commission reviewed the correspondence with Attorney Bruce Fader representing his client, Burnham Meadows, LLC. It was the consensus of the Commission to acknowledge the extension of time granted by the amendment to Connecticut General Statutes 8-26c (e) to complete public improvements. The new extension expiration date will be September 19, 2016. Commission requested that the developer install the last permanent pavement patch to King Street prior to the closing of asphalt plants.

DISCUSSION REGARDING NEW STATE LAW PUBLIC ACT 12-95 REQUIRING CERTIFICATE OF APPROVAL OF LOCATION FOR FOOD MANUFACTURING ESTABLISHMENTS
- The Commission reviewed the new law requiring certificate of approval for a food manufacturing establishment license with staff. It was the consensus of the Commission to allow the Zoning Enforcement Officer to determine zoning compliance.

MISCELLANEOUS
- Staff noted that the regular Commission meeting for October 10, 2012 had to be moved due to work in the Council Chambers. It was the Consensus of the Commission to move the meeting date to October 17, 2012.
- Staff discussed the bond reduction for 270 Long Hill subdivision. It was the consensus of the Commission to have the developer complete installation of the required street trees prior to a request for a full bond release.

Upon a motion by John Grottole, seconded by Tom Fitzgerald, the Commission Voted (5-0) to Adjourn the meeting. The meeting was adjourned at 9:37 p.m.
