PUBLIC HEARING AGENDA
INLAND WETLANDS - ENVIRONMENT COMMISSION OF
THE TOWN OF EAST HARTFORD

The Public Hearing was called to order at 7:00 PM in the Town Hall Council Chambers, East Hartford Town Hall.


A)  File # 2007-025
              Application of Jerrold Lipman/Lipman Farm to conduct a regulated activity within the Inland Wetlands and buffer zone in conjunction with the clear cutting of trees and brush located at No. 59-61 Leverich Drive (Assessor’s map 49, lot 157). Other activities include the grinding of stumps, chipping piles of brush and cultivating the site for the purpose of farming activities.   
Mr. Lipman had no further comments on the application.

Robert Valerio

Mr. Vilario spoke about his dealings with the Assistant Town Engineer Bob Sukosky and stated that he had alerted the Assistant Town Engineer several times about the  illegal activity taking place on Leverich drive and nothing was done about it until three months after the Town had been alerted.  He also added some pictures to the record that demonstrated the flooding in that area.

Mr. Rinaldi had four specific questions that he wanted answered and the Commission answered them.

Mrs. Oconner was alerting the Commission of the serious flooding that had taken place in that area in 2005 and was asking the Commission to carefully consider the damage that could take place if Mr. Lipman was granted permission to continue on with his work.

Mr. Foran wanted a silt fence to be put up to help protect the area.  He also wanted the Commission to seriously think about their decision to grant Mr. Lipman approval to continue on with his work.  He also asked the Commission to read the conditions and recommendations so that everyone was aware of them.  Bob Carr from the Commission read the recommendations and conditions.

Ms. Kniep had several questions that she wanted answered by the Commission and those questions were answered.  She also asked the Commission not to approve the application.

Robert Valerio

Mr. Vilario was wondering if the Commisson was increasing their revenue when the Commission had increased the Buffer Zone with the State’s approval. He also wanted to know what the Town’s consequence was when the regulations were not followed.  The Commisssion answered Mr. Vilario’s concerns.

Again Mr. Foran expressed his desire for a silt fence to be put up right away and that if it was not then Mr. Lipman should receive a fine everyday until it is in place.  He also asked the Commission to not grant their permission to Mr. Lipman based upon the water problems that were pre-existing.

Mary O’Conner

Ms. O’Conner spoke again to correct Commissioner Mary Dowden on which retention basin she was talking about.  She also read a letter that she sent out to the seven Commissioners so that everyone was clear on what she was speaking about.

Richard Kehoe
8 Knollwood Road
Mr. Kehoe shared his opinion on how he felt this application should be handled since there was a clear violation.  He felt that the violation should be dealt with first and then the approval of the application.  He also felt that during a Public Hearing the Commission should address the comments but that the communication between the Commission and speakers should be kept to a minimum so the Public Hearing would not take up so much time.

Mr. Lipman spoke briefly before the Commission in regards to the Public Hearing.

The Public Hearing was closed at 8:15 PM.









         B)  File # 2007-029
     Application of 26 Cedar Street, LLC, Peter D’Addeo, to conduct a regulated activity within the Inland Wetlands buffer zone in conjunction with demolition of three existing buildings and the construction of a new building located at No 18 and No 20-22 Main Street.  Other modifications to the site include the construction of a parking lot, installation of utilities, storm drainage system and associated grading.

Peter Alter spoke on behalf of the applicant and explained that the two parcels
of  land would be merged into one.  He also reviewed the comments from the
Town Engineer and found them to be acceptable.
Robert Baltramaitis, a licensed Professional Engineer, also spoke to the Commission going over in detail a reduced plan that was passed out to the Commission.  He assured the Commission that the erosion controls would be followed and that around the perimeter of activity a silt fence would be put in.

Stanley Frank

Mr. Frank was concerned that if the above applicant were to widen the road which had been previously discussed that it would create water problems for his business that is located in that area.

OLD BUISNESS

A)File # 2007-018
    Application of Riverone, LLC to conduct a regulated activity within the Inland Wetlands buffer zone in conjunction with various construction activities located at No. 125 Riverside Drive.  Proposed construction activities on the site include:
·       demolition and reconstruction of an existing stage
·       regrading of that portion of the site for the placement and anchoring of dock sections
·       construction of a concrete slab and the installation of a new cooler
·       installation of a new sanitary sewer pump, holding tank and associated piping
The applicant’s engineer, Mr. Robert Johnston, spoke on behalf of the plan concerning some of the slight modifications that had taken place.

Approval is granted with the following conditions:
              
1.      The permit is non-transferable without the written consent of the Inland Wetlands Commission.
2.   Proper erosion controls are to be maintained at all times.
3.  All work in the Inland Wetlands and/or buffer zone must be commenced and completed within one (1) year from the effective date.
4.      Written notice shall be submitted to the Town Engineer 48 hours prior to the starting date of the approved activity.
5. In evaluating this application, the Inland Wetlands Commission has relied on information provided by the applicant, and if such information subsequently proves to be false, deceptive, incomplete and/or inaccurate, this permit shall be modified, suspended or revoked.
               6.  Approval is granted as per plans submitted with the application dated 8-15-07 revised to 10-23-07
                7.  Final plans are to be signed and stamped (ink and impression) by the Professional Engineer and Land Surveyor.
                8.  Prior to the start of construction a site modification bond in the amount of
                     $ 2,325.00 shall be posted with the Town of East Hartford.

B)  File # 2007-025

4.      Written notice shall be submitted to the Town Engineer 48 hours prior to the starting date of the approved activity.
5.  In evaluating this application, the Inland Wetlands Commission has relied on information provided by the applicant, and if such information subsequently proves to be false, deceptive, incomplete and/or inaccurate, this permit shall be modified, suspended or revoked.
                6.  Approval is granted as per plans submitted with the application dated 8-4-07.
7.      Final plans are to be signed and stamped (ink and impression) by the Land Surveyor.
8.      Provide a general description (as per section 6.K of the Inland Wetlands application) of the proposed activities including recommended practices as referenced in a letter dated 9-12-07 from the North Central Conservation District (NCCD).
9.      Revise section 6.m of the application – revise limits of disturbance accordingly.
10.     Provide dimensions and dimensional ties for the layout of the limits clearing (limits of silt fence).
11.     Provide and maintain a 25 foot riparian zone from the limits of clearing.
      Re-sprouting vegetation within the riparian zone shall be mowed or cut       several timed during the growing season.
12.     Provide lines and labels for proposed plantings within the riparian zone – include spacing plan, species and quantities. (refer to NCCD letter)
13.     Provide a landscape screening along the northerly property line – include spacing plan, species and quantities.
14.     Provide lines and labels for a designated stockpile area for composting of brush, wood waste (chips) and stumps – include erosion and sedimentation control measures. (refer to NCCD letter) Compost location is to be outside of the flood hazard zone.
15.     Farming activities are to be in accordance with the “Manual of Best Management Practices for Agriculture, Guidelines for Protecting Connecticut’s Water Resources – 1993” and report from the North Central Conservation District, Inc dated 9-12-07 amended to 11-16-07.  Note on plans.
16.     Within 15 day of the date of this letter, silt fence is to be installed as per the approved site plan  
                 17. Prior to the start of construction a site modification bond in the amount of
                      $ 11,320.00 shall be posted with the Town of East Hartford. The bond shall be held until the agricultural project is stabilized.

6. Approval is granted as per plans submitted with the application dated
    10-5-07 revised to 11-15-07..
7. Provide environmental testing of the soil in the vicinity of the existing greenhouse and fuel storage tank. If required, provide a plan and report as to how environmental issues will be addressed

          

General Comments:

8.      Final plans are to be signed and stamped (ink and impression) by the  Professional Engineer and Land Surveyor.
7.      Final plans are to be provided for each individual application and labeled  accordingly.  For example adding “Inland Wetland Application Package” below the title of the project on the cover sheet.

          Grading & Utility Plan – Sheet SP-3

9.      Graphically depict the 200’ conservation buffer on the map.
10.     Provide the NRCS soil types and boundaries on the plan.
11.     There appears to be a low point at elevation 34.2 adjacent to the northern property boundary.  Revise the proposed grading to grade this area to drain to the proposed yard drain to the west.
12.     Provide an invert elevation for the 6” pipe entering catch basin “F”.
13.     Revise the material for the pipe run from catch basin “G” to water quality unit “B” to be reinforced concrete pipe.
14.     Provide pipe design information for the pipe run from water quality unit “B” to the underground detention system.
15.     Provide an invert elevation for proposed type “C-L” catch basin along Main Street.

          Engineering Report:

16.     Revise storm water quality portion of the text on page 8 to specify four foot deep sumps for all proposed catch basins.
17.     Provide pipe capacity and hydraulic grade line computations for the proposed storm drainage system for the 25 yr storm event.  More specifically for the run of pipe from the proposed detention system to the type “C-L” catch basin along Main Street.
18.     Demonstrate that the proposed underground infiltration structure is designed to drain dry within time limits specified within the 2004 DEP stormwater quality manual.
19.     The tables summarizing the stage storage/discharge and pond data for the rooftop infiltration/detention structures inlet and outlet pipes differ from what is shown on the site plan.  Reconcile this discrepancy.

D)  File # 2007-030
Application of Goodwin College to ask for a modification to a previously approved application (File # 2006-011) to conduct a regulated activity within the Inland Wetlands buffer zone in conjunction with the construction of a college campus located at No. 211 Riverside Drive. Proposed modifications include the placement of crushed stone along the river bank, construction of retaining walls, steps, placement of fill material and regarding of the site.
The application was presented by Everet Milam, PE of Zuvic Associates, and David Holmes, AIA, the applicant’s civil engineer and architect, respectively.

3.  All work in the Inland Wetlands and/or buffer zone must be commenced within one   (5) years from the effective date. The activity must be completed within one (1) year from the commencement of the activity.
4.      Written notice shall be submitted to the Town Engineer 48 hours prior to the starting date of the approved activity.
5. In evaluating this application, the Inland Wetlands Commission has relied on information provided by the applicant, and if such information subsequently proves to be false, deceptive, incomplete and/or inaccurate, this permit shall be modified, suspended or revoked.
                6.  Approval is granted as per plans submitted with the application dated 10-6-07 revised to 11-12-07.
                7.  The application is to be revised to include all proposed modifications.
                8.  Final plans are to be signed and stamped (ink and impression) by the Professional Engineer.
                9.  Provide hydraulic grade line calculations for the proposed pipe run – check on possible flooding of stairwell.
                10. Final drainage calculations are to be signed and stamped by the Professional Engineer.

NEW BUSINESS

   A)  File # 2007-031
Application of the Town of East Hartford to conduct  regulated activities within the Inland Wetlands buffer zone in conjunction with the “2008 Roadway Improvement Project”  for the pavement rehabilitation of the following streets:
1)      Hills Street – beginning at a point 75 feet  westerly of Greenwood Street and then running easterly 600 feet
2)      Risley Street – beginning at House No. 51 and running easterly 1000 feet to House No. 132.
3)      Scotland Road – beginning at Goodwin Lane and running southerly 1100 feet to Hudson Street.

         Modifications to the roadways include removal or milling of the pavement, resetting of utility structures, paving and replacement of curbing, guide rails, sidewalks and driveway aprons

The Commision reviewed the proposed 2008 schedule of meetings. The next proposed meeting date is 1.08.08.

On Nov. 13, 2007 the Commission received a letter of resignation from  Cmsr.Anita Morrission

November 13, 2007 a letter of resignation was received from Anita Morrission.
November 19, 2007 the Town received a Publication of Soil Scientists
DVD for Inland Wetland Commission training program was received.


REPORTS
The Town received a complaint that at the location of 722 Goodwin Street a lot of clearing had taken place in a regulated area.  The Town Engineer declared the clearing was not fine worthy.
