Selectmen's Minutes 10/10/06
The weekly meeting of the Board of Selectmen was held on Tuesday evening, October 10, 2006 at 7:35 p.m.
 
Present: Peter A. Hamilton, Chairman; Theresa McNulty, Clerk; David L. Walsh

            Karen Grabau, Adm. Assistant
 
M/McNulty, s/Walsh, a unanimous vote, move to approve the minutes of the October 3, 2006 meeting.
 
M/McNulty, s/Walsh, a unanimous vote, move to approve the appointment of William R. McCoy to the Sachem Rock Committee, effective immediately.
 
M/McNulty, s/Walsh, move to approve the appointment of the following as Election Workers submitted by the East Bridgewater Republican Town Committee:

M/McNulty, s/Walsh, a unanimous vote, move to approve the request of Jessica Sproule of the East Bridgewater High School Class of 2007 to hold the Homecoming Parade and use the town common gazebo for judging on October 28, 2006 pending the appropriate approvals.
 
Town Administrator Report
 
            Ethics Seminar – tentative date November 28, 5:30 p.m. – need at least 30 people
                                     Will check with School Committee, if date is okay
                                     Possible pre-record seminar and show on cable – will check with
                                     Carol Carson, Ethics Commission
 
Reminders
            Voter registration – last date to register October 18 – Town Clerk’s Office will be open
8:30 a.m. – 8:00 p.m.; Absentee ballots now available
 
            Flag Retirement – Box made and donated by Jim Weidenfeller and decorated by George
Redgate at entrance to Town Hall – flags may be left in box for retirement at annual flag retirement ceremony.
 
            Sachem Rock Fall Festival – October 14, 10 a.m. – 3 p.m.
 
            Recycling Information
 
Mr. Hamilton explained that he has spoken to Mr. Haines and the trash bags are being upgraded to a heavier plastic. Noted that they will look the same but are stronger.
 
Mrs. McNulty noted that she has received a check for use of the town fields during the summer and that it will be put into the Recreation Commission revolving fund. Mr. Walsh questioned whether there needed to be a vote to establish a Recreation Revolving fund; suggested that the check be reissued to the Town with notation for use of Recreation Commission.

Mr. Walsh noted that the Board would be meeting with the School Committee on Thursday evening, for interviews with candidates for vacancy on School Committee.
 
Board requested Mrs. Grabau to contact Town Clerk Marcia Weidenfeller and ask her to attend the October 24 meeting to discuss with the Board the following:
            “Miss a Meeting” law
            Open Meeting Law
            Question #2 on the November ballot
            Recall
 
A discussion was held regarding changing to canceling the October 31 meeting.
 
M/McNulty, s/Walsh, a unanimous vote, move to change the October 31, 2006 meeting to Monday, October 30 to allow Board members to participate in Halloween with their families.
 
Appointment
Donald Ferbert, Jr. met with the Board relative to the application for Change of Manager for the Commercial Club, Club – All Alcoholic License.
 
Mr. Ferbert noted that he has met with Officer John Grillo regarding his responsibilities as a Manager; involved with the Club for over 12 years; is putting together a TIPS training session for all employees not certified including himself. Completed ServSafe training through board of Health. All employees will be TIPS certified within 6 months.
 
M/McNulty, s/Walsh, a unanimous vote, move to approve the change of manager for the Club  - All Alcoholic License of the Commercial Club of East Bridgewater, Neilsen Avenue to Donald Ferbert, Jr.
 
Appointment
Claire Yocum, Conservation Commission Chairman met with the Board and introduced Judson Lyons, who had applied for the vacancy on the Commission.
 
The Board agreed to act on Mrs. Yocum’s appointment as the Conservation Commission representative to the Sachem Rock Committee.
 
M/McNulty, s/Walsh, a unanimous vote, move to appoint Claire Yocum as the Conservation Commission representative on the Sachem Rock Farm Committee.
 
Mr. Lyons explained his interest in serving on the Commission; noted he was retired and could devote needed time to commission; explained his prior work with another town’s Commission.
 
Mr. Hamilton welcomed Mr. Lyons and noted that the Board was pleased with the number of new people who have come forward to serve on various town committees.
 
M/McNulty, s/Walsh, a unanimous vote, move to approve the appointment of Judson Lyons as a member of the Conservation Commission effective immediately to June 30, 2009.
 
Board Discussion
Board discussed information received regarding a Recall By-Law.
 
Mr. Walsh noted incorrect article in newspaper; had not said he was in endorsing recall, but stated that the Government Review Committee had recommended this and that he was in favor of bringing it to the voters.

Board went over several ideas regarding make-up of the by-law. It was agreed that Mr. Walsh would put together a draft for the members to review and discuss in two weeks. The draft will then be sent to Town Counsel for finalization.
 
Board discussed possible dates for a Special Town Meeting. Mr. Walsh stated that he would like to have a one article STM in December for the purpose of presenting the Capital Stabilization Fund and in either January or February hold the regular mid-term STM for budgets, etc.
 
Mrs. McNulty noted that this would give the Town the means to control funding and to learn to not count on state aid and funding.
 
Mr. Walsh stated that future planning for capital needs has to be addressed; will allow town to plan for the next 5-10 years. Is pleased that Mr. Samia, the Department Heads and the voters are looking at long-term planning. Commended the Department Heads, Capital Planning committee and the members of the Board for their initiative.
 
Mr. Hamilton noted that a letter has been received from the Board of Health informing them that the EDS (Emergency Dispensing Site) has been sent to the State for review and approval. State has recommended that local Health boards conduct this years’ Flu Clinic as a staged event and the Board of Health will run this years Flu clinic utilizing the EDS plan. Working on securing the site and will notify the Board when plans are completed.
 
Mr. Hamilton noted that he and Mr. Samia completed the NIMS test last week for their certification. Congratulated Deputy fire Chief, Robert Fairburn for the work he has put into this plan.
