Duxbury PASS Committee
May 1, 2003 - Meeting Minutes

Meeting called to order at 7:33 PM

Present at meeting: P. Brogna, S. Dahlen, J. Hagerty, H. Pape-Laird, B. Tenhoor, and P. Roveto

Minutes of April 3, 2003 were approved.

The next meetings are scheduled for May 15 and May 29th, 2003.

Committee resumed working through proposed pier regulation bylaw language.
There was discussion on the use of general language and the wording.  

Section B lines b. and g. had language regarding the requirement that the piers extend from the upland to the water’s edge and not from a location in the middle of the marsh.  Line g. had the 266 foot length maximum.  Discussion continued regarding the rational behind the existing 200’ limit to pier length and whether or not Committee should re-address this limit.  

It was determined that the Back River was not included in the Committee’s shoreline study under the assumption that the 200’ limit was not under consideration for change.  The distances are too great and the channels too small for piers to be considered there.

Changing property setbacks from 15 feet to 25 feet were discussed

It was decided that we need some data to get to the next phase of making decisions regarding the bylaws.  Bill said he would contact Urban Harbors institute to get impacts to properties of changes we have considered
Length of piers; 150, 200, 266 feet
Length in proportion to distance along lot line: 50% or 100%.
Setback: 15 feet, 25 feet.
Setbacks from Ways to the Water and Town Landings:  50, 100, 150, 200, 250 feet.
Hold density to distance minimum: 250 feet
There will be limits to what they can do.  Many of these numbers would depend on what piers get built first.

John Hagerty volunteered to find out where we stand financially.  It was noted that we don’t have a treasurer other than Bill Tenhoor.

It was noted that even with the bylaws, neighbors still have a right to protest an individual pier.
