MEETING MINUTES

Call to Order: 3:15 PM
Reading of Minutes: Postponed.
Warrant Articles: Discussion of Article 18. Mr. Dahlen’s suggestion is to go along with the policy of the building codes, which defines substantial as 50% or more of the structure. Partial demolitions affect remodeling jobs primarily. Mr. Dahlen believes the original intent of the bylaw was aimed at whole houses. He does not feel it was aimed at taking off portions for remodeling purposes.
Ms. Sheehan proposed Indefinitely Postponing Article 18 to further study how other towns administer/interpret “substantial”. The planning board voted not to support this article as it was presented. Mr. Broadrick was in favor of leaving it to see how it works. Ms. Kispert moved to Indefinitely Postpone warrant article 18 in it entirety. Ms. Himes seconded. Motion carried 5-0.
Article 19. The Planning Board voted not to support this article as presented. They recommended keeping the emergency demolition issue down the road.
Article 20. Mr. Dahlen suggested we strike the paragraph specific to partial demolition since we have IP the definition in Article 18. It was suggested that guidelines for securing regulated structures that have been issued a delay be included in the Historic Commission Demolition Delay Application packet.
If there is not a structural reason for taking down more than the application requested, it is subject to the building code. Mr. MacDonald will assume the responsibility of taking pictures of emergency problems for our information.
In lieu of the final line of Article 20, a line will be added to the application to reflect that ownership has changed hands. This will include contact information. Ms. Hall moved to accept these amendments to the proposed article 20. Ms. Himes seconded. Motion carried 5-0.
Article 21. The Selectmen are concerned about the wording. “Shall” will be changed to “may be subject to fines of up to $2000.”
Demolition Applications: A walk through of 82 Gurnet Road has been scheduled for March 12 at 3:30 PM. Ms. Himes distributed a hand out regarding 82 Gurnet Road.
New Applications: Applications for Demolition have been received for 54 West St. and 34 West Street. Ms. Kispert will recuse herself from these discussions because these properties abut her property on West Street. Ms. Himes will contact Mr. White to schedule walk-throughs.
V.      Community Preservation Project: Because of the complexities added to the        
Project by disability compliance and to give time for further study, it is recommended that the proposal be withdrawn from consideration by the CPC. Ms. Himes so moved. Ms. Hall seconded. The motion carried 5-0. Ms. Himes moved to recommend we IP the Tarkiln Proposal at Town Meeting. Ms. Davis seconded. The motion carried 5-0.
30 Ocean Ave. Ms. Hall and Ms. Kispert met with the owners on Monday, March 4, 2002. The structure has been posted in the web site ISellMYHouse.com. They indicated they would add pictures to the posting to make it more attractive. They have received three responses, none serious. They also indicated they had contacted a house mover for information on the logistics of moving the house if the event arose. The tone of the meeting was cooperative and congenial.
