BOARD OF SELECTMEN MINUTES      
                
Present:  Andre Martecchini, Chair and Elizabeth Sullivan, Clerk.

Absent: Jon Witten, Vice-Chair.

Staff:  Richard MacDonald, Town Manager; John Madden, Finance Director; and C. Anne Murray, Department Secretary.

The meeting was called to order at 7:15 PM at which time a motion was made for the Board to go into Executive Session to discuss a matter regarding the King Caesar Fund.  The Board re-convened in Open Session at approximately 7:30 PM

BUSINESS

Event Permit Request /Alden Ringquist for Alden Kindred Society: Christmas Tree Sales

Mr. Alden “Rink” Ringquist and Mr. Chad Frost of Hedges, Inc. were present for this item.  This is the third year that they will be selling trees.  Mr. Frost said that the trees come from Vermont and they will have balsam and a frazier/balsam hybrid.

Ms. Sullivan moved that  Mr. Alden Ringquist, as a representative of the Alden Kindred Society of America, Inc., is granted permission to sell Christmas Trees at the Alden House Historic Site from 10:00 am until 8:00 pm on December 1, 2, 8, and 9, 2007.   This approval is contingent upon approval by the Police, Fire, and Inspectional Services Departments.  Any signs must be approved by the Department of Inspectional Services.  Second by Mr. Martecchini.  Vote: 2:0:0.

One-Day Liquor License Requests / Patrick Browne for the Duxbury Rural & Historical Society: Members Christmas Party: December 7, 2007

Mr. Martecchini noted the request had been reviewed by the appropriate departments with no objections and only some standard requirements.

Ms. Sullivan moved that the Board of Selectmen grant to Mr. Patrick Browne, as a representative of the Duxbury Rural & Historical Society a One-Day Wine & Malt License to hold a Members Party at the King Caesar House (120 King Caesar Road) on December 7, 2007 from 6:00 to 8:00 PM, contingent upon the following:  That the appropriate permits are obtained from the Inspectional Services Department for any related tents, signs and/or electrical work; and that any platforms, staging or temporary structures be inspected prior to the event.  Second by Mr. Martecchini. Vote: 2:0:0.


Patrick Browne for the Duxbury Rural & Historical Society
Private Rental: December 6, 2007

Mr. Martecchini noted that this request is for a private function.  He mentioned a memorandum about the event was circulated and has received approval from all appropriate departments.

Ms. Sullivan moved that the Board of Selectmen grant to Mr. Patrick Browne, as a representative of the Duxbury Rural & Historical Society a One-Day All-Alcohol License to hold a private party at the King Caesar House (120 King Caesar Road) on December 6, 2007 from 7:00 to 9:00 PM, contingent upon the following:  that the appropriate permits are obtained from the Inspectional Services Department for any related tents, signs and/or electrical work; that any platforms, staging or temporary structures be inspected prior to the event; and that Duxbury Services obtain a Temporary Food Caterer’s Permit from the Board of Health prior to the event.  Second by Mr. Martecchini.  Vote: 2:0:0.

Town Manager’s Brief

Mr. MacDonald indicated he had just two items to mention this evening:

1.      Gurnet Beach Meeting:  Mr. MacDonald stated, that as requested by a number of the residents of the Gurnet area, he has initiated steps to organize a meeting about beach issues.  Mr. MacDonald said he has notified Rep. Webster, who represents that district, of the issues.  He also reported he had some preliminary conversations with representatives of Coastal Zone Management (CZM) and the Army Corps of Engineers (ACOE).  Mr. MacDonald mentioned that he has spoke with Mr. Jim Ryan, a Gurnet area resident, and asked him to informally let his neighbors know that a meeting is being arranged for after the holidays.

2.      Budget Presentation:  Mr. MacDonald said he has been working diligently on the budget, and will be prepared to make a budget presentation to the Board and the public at the Board of Selectmen’s meeting on Monday, December 10, 2007.

The Selectmen suggested to have members of the ad hoc FY09 Budget Taskforce also at that meeting to give an overview of their work.  Mr. MacDonald said he would discuss that with the Taskforce at an upcoming meeting.

Minutes

Ms. Sullivan moved that the Board approve the Minutes of November 19, 2007 as presented.  Second by Mr. Martecchini.  Vote: 2:0:0.

Committee Appointments/Re-appointments - None

Bonus Shellfish Season

Ms. Sullivan moved that that the Board of Selectmen:

1)      Declare a temporary Bonus Shellfish Season for the commercial harvesting of
    softshell clams for the month of December. (For regulations please see Attachment B
    & C of Harbormaster Memorandum dated 11/20/07).

2)      Declare a temporary Bonus Shellfish Season for the commercial harvesting of
    quahog clams for the month of December.  (For regulations please see Attachment A
    & C of Harbormaster Memorandum dated 11/20/07).

3)      Declare a temporary Bonus Shellfish Season for the recreational harvesting of Soft
    Shelled Clams for the month of December. Regulations as attached. (For regulations
    please see Attachment D of Harbormaster Memorandum dated 11/20/07).

Second by Mr. Martecchini.  Vote:  2:0:0.

ANNOUNCEMENTS

Jaycox Christmas Trees on Sale this Weekend:  Mr. Martecchini announced that this weekend (Dec. 1st & 2nd) trees will be on sale from the town-owned tree farm on the Jaycox property on West ST.  

Holiday Town Hall Closing: Town Hall will be closed on Monday, December 24th (Christmas Eve) and on Tuesday, December 25th (Christmas Day).  Notices have been posted in the Town Hall.  The Town Hall will be open on Monday, December 31st (New Year’s Eve).

Board of Selectmen Meetings in December:

December 3rd: Might be cancelled. It was mentioned in passing that right now there is nothing on the agenda for the December 3rd Board of Selectmen’s Meeting.  

December 10th: Budget Presentation.  The Board mentioned again that Mr. MacDonald would be making a budget presentation at the December 10th Selectmen’s Meeting.  Ms. Sullivan suggested the FY09 Budget Task Force also be at that meeting.  She mentioned that an override is not being proposed by the Task Force to balance the budget this year, and perhaps the members of that group could explain some of their work.

Ms. Sullivan also acknowledged the efforts of the schools to prepare the school budget earlier this year and how helpful that has been to the process.

December 17th:  Meeting will be scheduled.  Agenda to be determined.

December 24th (Christmas Eve) and Dec. 31st (New Year’s Eve).  No Selectmen’s Meetings. Mr. MacDonald suggested that given that Christmas Eve and New Year’s Eve fall on Mondays this year that Selectmen’s Meetings not be scheduled for those dates.  The Board agreed that should some pressing matters need to be discussed, then arrangements will be made and a Selectmen’s Meeting posted for another date and time to accommodate this.

Warrant Closing:  It was announced and stressed again that the deadline for articles, in final language, is December 4, 2007 as the Warrant will be closed on that date.  Mr. MacDonald did comment that Mr. Troy, Town Counsel, has met with and assisted a number of boards with the drafting of articles.
