BOARD OF SELECTMEN MINUTES      
                
Present:  Elizabeth Sullivan, Chair and Andre Martecchini, Vice-Chair.

Absent:  John Tuffy, Clerk.

Staff:  Richard MacDonald, Town Manager; and Barbara Ripley, Executive Assistant.

The meeting was called to order at 7:30 PM.


OPEN FORUM

No items were discussed.


INFORMATION REGARDING CANCELLED EXECUTIVE SESSION

Ms. Sullivan noted that an Executive Session had been planned for 7:00 PM to discuss the Town’s strategy relevant to negotiating a real estate purchase.  However, the matter was withdrawn by the proponent at 4:00 PM today, so the Executive Session was not held.


BLOCK PARTY REQUEST:  SOUTH RIVER LANE WEST

Ms. Catherine Lehman submitted an application on behalf of the residents of South River Lane West to hold a block party in that neighborhood on Saturday, October 21, 2006 from 3:00 P.M. to 6:00 P.M.  The Police, Fire, Inspectional Services and Board of Health departments all submitted memoranda in support of the event.

Mr. Martecchini moved to grant permission to the residents of South River Lane West to hold a block party on Saturday, October 21, 2006 from 3:00 P.M. to 6:00 P.M., subject to the conditions described in memoranda from the Police Chief, Fire Chief, Director of Inspectional Services, and Board of Health.  Second by Ms. Sullivan.  Vote:  2:0:0.


ONE-DAY LIQUOR LICENSE REQUEST: PATRICK BROWNE FOR THE DUXBURY RURAL & HISTORICAL SOCIETY (DRHS)/ CROSSROADS FOR KIDS COCKTAIL PARTY

The DHRS has applied for permission to hold a private cocktail party for the Crossroads for Kids organization.

Mr. Martecchini moved to grant a one-day all-alcoholic license to Mr. Patrick Browne as a representative of the Duxbury Rural & Historical Society to hold a cocktail party for the Crossroads for Kids organization at the Nathaniel Winsor House on October 27, 2006 from 6:00 PM to 8:00 PM, subject to the conditions stated on the following memoranda:  Duxbury Police Chief (10/4/06); Duxbury Fire Chief (10/4/06); Director of Inspectional Services (10/2/06), and Board of Health (10/3/06).  Second by Ms. Sullivan.  Vote:  2:0:0.


LOCAL HOUSING PARTNERSHIP RE: AFFORDABLE HOUSING PROPOSAL (Grange Property)

Ms. Sullivan explained that there had been a proposal for the Town to purchase the Duxbury Grange property, and to use it to create one or two units of affordable housing.  This was to be an article on the November 2006 Special Town Meeting Warrant.  However, a dispute has arisen over who actually has the authority to sell the property.  This must be resolved before the proposal can be considered further.  It is expected that this will not be resolved in time for the November Special Town Meeting, and that the matter will be removed from the warrant.


TOWN MANAGER BRIEF

Executive Session of October 5, 2006:  Mr. MacDonald noted that the Board of Selectmen voted to ratify contracts for the Library and Police Unions, subject to funding of pay increases by Town Meeting.  They also voted to make the results of that Executive Session public.  

·       Changes to the Library contract included modifications to medical co-pays, and the addition of a Preferred Provider Organization plan.   The Library pay raises are:  July 1, 2006--- 2% increase; January 1, 2007---1% increase; July 1, 2007---3% increase; and July 1, 2008---3% increase.

·       Changes to the Police contract include the same changes to health insurance that were made to the Library contract.  Police pay raises are:  July 1, 2006---2.5%; July 1, 2007---3.0%; July 1, 2008---3.0%.

Mr. Martecchini commented that the Town is working to get all unions on the same page with regard to health insurance.


WARRANT FOR STATE ELECTION ON NOVEMBER 7, 2006

Mr. Martecchini moved to sign the warrant for the November 7, 2006 State Election for both Duxbury congressional districts (Precincts 1& 6; and Precincts 2, 3, 4, & 5); such election to be held at the Duxbury Middle School from 6:00 AM to 8:00 PM.  Second by Ms. Sullivan.  Vote:  2:0:0.


BONUS SHELLFISH SEASON

Mr. Martecchini noted that the Duxbury Harbormaster has indicated that there are reasonable shellfish resources within the Town of Duxbury to accommodate a bonus shellfish season.

Mr. Martecchini moved to declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of October, per the regulations described in the Duxbury Harbormaster’s memorandum of September 27, 2006 (Attachments B & C); and to declare a temporary Bonus Shellfish Season for the commercial harvesting of quahog clams for the month of October, per the regulations described in the aforementioned memorandum (Attachments A & C).  Second by Ms. Sullivan.  Vote: 2:0:0.


MINUTES

Mr. Martecchini moved that the Selectmen accept the minutes of September 25, 2006 as presented.  Second by Ms. Sullivan.  Vote: 2:0:0.


APPOINTMENTS

Ms. Sullivan moved to make the following appointments:

·       Ms. Kim Mitchell, as the School Representative to the Duxbury Youth Commission, for a three-year term to expire on 6/30/09;

·       Officer Mary Ellen Vidito, as the Police Department Representative to the Highway Safety Committee, to fill an unexpired term to 6/30/07;

·       Deputy Chief William Carrico, as the Fire Department Representative (ex-officio) to the Highway Safety Committee, for a three-year term to expire on 6/30/09;

·       Bridget O’Keefe, as a re-appointment to the Municipal Commission on Disabilities, for a two-year term to expire on 6/30/08;

·       Stuart McEntee, to the Recreation Activities Committee, for a one-year term to expire on 6/30/07.

Second by Mr. Martecchini.  Vote: 2:0:0.

Mr. Martecchini moved to adjourn the meeting at 7:40 PM.  Second by Ms. Sullivan.  Vote: 2:0:0.
