BOARD OF SELECTMEN MINUTES
Present: Elizabeth Sullivan, Chair; Andre Martecchini, Vice-Chair; and John Tuffy, Clerk.
Staff: Richard MacDonald, Town Manager; and C. Anne Murray, Dept. Secretary.
The meeting was called to order at 7:30 PM by Ms. Sullivan.

VENDOR PERMIT REQUEST: JAY JOHNSON/ ITALIAN ICE CART
As Mr. Jay Johnson had appeared before the Selectmen previously he was not required to appear at this meeting.
Mr. Tuffy moved that the Board of Selectmen issue a Vendor’s Permit to Jay Johnson (d/b/a Little Jimmy’s Authentic Italian Ice) for a pushcart to sell ice cream / Italian ice at Mattakeesett Court, subject to the conditions stated on memoranda from the Duxbury Police Chief, Duxbury Board of Health, Harbormaster, and Director of Inspectional Services. Second by Ms. Sullivan. Vote: 3:0:0.
ONE-DAY LIQUOR LICENSE: JACK HAMILTON FOR COUNCIL ON AGING/ DINNER THEATRE ON
JUNE 17
Mr. John “Jack” Hamilton was present to describe the event, which is a fundraiser sponsored by the Friends of the Council on Aging. Tickets will be available at the Senior Center and at Westwinds Bookshop. Cocktails (beer and wine only) will be served starting at 5:30 PM. Dinner will be served at 6:30 PM. A theater group will perform three vignettes during the evening.
Ms. Sullivan noted the request had been circulated to the appropriate departments. As long as the appropriate permits are obtained there were no objections. A police detail is needed.
Mr. Martecchini moved that Mr. John Hamilton, as a representative of the Friends of the Duxbury Council on Aging, be granted a one-day Wine & Beer Pouring License to hold a fundraising event (Dinner Theater) at the Duxbury Senior Center (10 Mayflower ST) on Monday, June 5, 2006 from 5:30 PM to 9:00 PM subject to the conditions on the departmental memoranda. Second by Ms. Sullivan. Vote: 3:0:0.
ONE-DAY LIQUOR LICENSE: PATRICK BROWNE FOR DUXBURY RURAL & HISTORICAL SOCIETY ON JUNE 8
Ms. Sullivan stated that the Board has received a request from the Duxbury Rural and Historical Society for a one-day wine & beer license for a Wine & Cheese for the Board of the Chandler School PTA. She noted that the request had been circulated to the appropriate departments. No objections were noted, but a police detail needs to be arranged and access to the second floor of the building must be limited to employees only.
Mr. Tuffy moved that the Board of Selectmen issue to Patrick Browne, as a representative of the Duxbury Rural and Historical Society, for a one-day Wine & Beer Pouring License to hold a Wine & Cheese at the Board Meeting of the Chandler School PTA at the Nathaniel Winsor, Jr. House, (479 Washington ST, Duxbury) on Thursday, June 8, 2006 from 6:30 PM to 9:30 PM, subject to the conditions on the attached departmental memoranda. Second by Mr. Martecchini. Vote: 3:0:0.
EVENT PERMIT REQUEST: TRIATHLON ON SEPT 16
Brian Noyes, the Triathlon organizer, was present to discuss the event. This is the 5th year of the event. This year the Triathlon will be on Saturday, September 16th with an approximately 8:00 AM start due to the timing of the high tide. The organizers expect approximately 500 participants. Proceeds from the registration fee benefit the Police Athletic League (P.A.L.). This year three other charities: JET, Special Olympics, and the Thoroughbred Retirement Foundation will also receive donations.
A new VIP registration is being added this year. For a $500.00 entry fee VIPs will be given a streamlined registration and some thank you gifts. In addition, a donation will be made to the charity of the individual’s choice.
Attempts have been made to address past concerns regarding traffic and notification. Regarding traffic, no roads will be closed, but a plan to redirect traffic in a circular one-way pattern in the Powder Point / King Caesar Road area is being worked on with police input. Notification improvements to area residences and business will include use of reverse 911 messages and pre-event signage.
The Beach Sweep organizers have agreed to re-schedule the date of that event to prevent any conflicts.
Mr. Martecchini moved that the Board of Selectmen grant a permit to the Duxbury Beach Triathlon organization to hold the Duxbury Beach Triathlon on September 16, 2006 beginning at 8:00 AM, subject to the conditions stated of memoranda from the Duxbury Police Chief, the Duxbury Fire Chief, the Director of Inspectional Services, the Board of Health, the DPW Director, and the Harbormaster.
TOWN MANAGER BRIEF
1. Shellfish Closure: The State Division of Marine Fisheries has issued a notice prohibiting all shellfish harvesting in Duxbury until further notice. This is a rain closure. It does not mean that there is a problem with the water quality, but rather is a standard precautionary measure due to the weather conditions. The Harbormaster has posted the notice and notified all appropriate parties.
2. Chapter 90 Funds: Duxbury will receive $3,0290,000. in Chapter 90 Funds. This was $5,000. more than the $3,024,000. figure previously provided by the State and used in the budget process.
3. A meeting with the residents of Gurnet Road has been arranged with NStar for Wednesday afternoon to address the power outages that occur in that area.
4. Coastal Zone Management’s (CZM’s) Coastal Hazards Commission is beginning an inventory of seawalls. The inventory is to determine what structures are owned by the State, the local communities, or privately owned, and an assessment of the condition. The inventory must be completed before any State funds will be released for repair of the structures.
Mr. Tuffy commented that many of the seawalls were built years ago by the Department of Environmental Management (DEM) with the promise of upkeep. Since that has not happened he is skeptical that this Commission will be a windfall for financial assistance.
5. Storm Damage: Relative to other communities Duxbury has weathered the recent rainstorms with minor damage. The only situation reported was a culvert, which overflowed on Lakeshore Drive on the Pembroke line.

COMMITTEE APPOINTMENTS/RE-APPOINTMENTS
No appointments or re-appointments were made. Ms. Sullivan did, however, take this opportunity to encourage anyone interested in serving on a board or committee to complete a Talent Bank form.
