04-25-05 Board of Selectmen Minutes
The meeting was called to order at 7:00 PM.  Selectmen JohnTuffy, Betsy Sullivan and Andre Martecchini were present, along with  Town Manager Rocco Longo.

John Tuffy moved and Andre Martecchini seconded a motion to enter into executive session in accordance with MGL Chapter 39 Section 23B subsection (b) 3. to discuss strategy with respect to pending litigation.  A roll call vote was taken to enter executive session as follows:  John Tuffy “aye, ” Andre Martecchini “aye,” and Betsy Sullivan “aye.”

On a roll call vote at 7:50 PM, the Board voted to end the executive session, as follows John Tuffy “aye,” Andre Martecchini “aye,” and Betsy Sullivan “aye.”

The open meeting reconvened at 7:55 PM.

OPEN FORUM:  There was no one present under Open Forum.

NUCLEAR ADVISORY COMMITTEE:     

Pixie Lampert gave presentation covering the following:
1.      Analysis of suitability of Braintree Reception Center.  Voiced concerns of ability of reception center to adequately handle monitoring, decontamination, moving and tracking the large number of people sent to Braintree in the event of a nuclear accident.  Braintree statistics based on a minor nuclear accident, not a worst case scenario.
2.      Recommended that another location be considered.  Suggested that Gillette stadium be looked at to determine if it would be a better site than Braintree.
3.      Recommended that changes be made to Braintree set-up, while looking at long term solutions.
4.      Emergency Personnel made aware of deficiencies in proposed handling of Group Home and institutionalized individuals.

AQUACULTURE GRANT RENEWAL HEARING:

Selectmen discussed renewing licenses for four existing aquaculture grants in Duxbury  Bay for the next 10 years.  These grants, which are used to raise oysters from seed to market size, vary in size from less than an acre to almost three acres and have been in existence for three years.  After three years, the town’s rules state there must be a compulsory review of the grants, said Harbormaster Don Beers.  The town’s Shellfish Advisory  Committee advertised and held a public hearing to review the four grants.  It recommended each license be renewed.  Five men were given license extensions for four grants.  They are Joe Grady and Richard Loring with a joint application for one grant, and William Driver, Scott Doyle and Henry McCarthy.  Each had to prove they have been actively using the grants and spent at least $1,500.00  per acre per year or they could forfeit their grants.  Most shellfish farmers said they have spent much more money than $1,500.00 an acre and are just starting to earn a profit.  Although the license extensions are good for 10 years, the grants are reviewed every year, said Beers.  

Mr. Martecchini moved to approve Joe Grady and Richard Loring’s request for an extension of their aquaculture grant for 10 years.  Mrs. Sullivan seconded.  The motion passed, 3-0.

Mr. Martecchini moved to approve William Driver’s request for an extension of his aquaculture grant for 10 years.  Mrs. Sullivan seconded.  The motion passed, 3-0.

Mr. Martecchini moved to approve Scott Doyle’s request for an extension of his aquaculture grant for 10 years.  Mrs. Sullivan seconded.  The motion passed, 3-0.

Mr. Martecchini moved to approve Henry McCarthy’s request for an extension of his aquaculture grant for 10 years.  Mrs. Sullivan seconded.  The motion passed, 3-0.

WATERWAYS AND MOORINGS RULES AND REGULATIONS:

Tabled until May 2nd meeting.

BUSINESS:

1.      National  MS fundraiser bike tour.  Police, Fire and Public Safety permits in order.  Mr. Martecchini moved to approve, Mrs. Sullivan seconded.  The motion passed, 3-0.

2.      Duxbury Beach Triathlon to be held on September 18, 2005.  Gave conditional approval for event.  Condition set that Police, Fire and Public Safety give written approval for event. Mr. Martecchini made motion for conditional approval, Mrs. Sullivan seconded.  The motion passed, 3-0.

3.         Harbormaster- Don Beers received a letter from Mr. William McBain that    stated he would like to make  a donation of a bench to be placed  at the Eastern end of Powder Point Bridge.  The offering of the bench was made in memory of Mr. McBain’s wife who enjoyed walking along the Powder Point Bridge and the beach.  Mrs. Sullivan  motioned to accept the bench in memory of Mrs. McBain.  Mr. Andre Martecchini seconded.  The motion passed, 3-0.

                a.      Duxbury Bay Maritime School “Salty Dog Ball” May 27, 2005
                b.      First Parish Church, May 13, 2005
                c.      Miramar Retreat Center, May 7, 2005
d.      Duxbury Education Foundation, April 30, 2005.

Mrs. Sullivan moved to approve a one-day liquor license for Duxbury  Bay Maritime School’s “Salty Dog  Ball” on May 27, 2005  from 6 to 11:30 pm.  They have submitted a certificate of liquor liability insurance and town departments have given their approval.  Mr. Martecchini  seconded.  The motion passed, 3-0.

Mrs. Sullivan moved to approve a one-day liquor license for First Parish Church on May 13, 2005 .  They have submitted a certificate of liquor liability insurance and town departments have given their approval.  Mr. Martecchini seconded.  The motion passed, 3-0.

Mrs. Sullivan moved to approve a one-day liquor license for Miramar Retreat Center on May 7, 2005.  They have submitted a certificate of liquor liability insurance and town departments have given their approval.  Mr. Martecchini seconded.  The motion passed, 3-0.

Mrs. Sullivan moved to approve a one-day liquor license for Duxbury Education Foundation’s “Dinners for Duxbury” at the Senior Center on April 30, 2005 from 6 to 8 pm.  They have submitted a certificate of liquor liability insurance and town departments have given their approval.  Mr. Martecchini seconded.  The motion passed 3-0.

TOWN MANAGER’S BRIEF:

Mr. Longo reported on the following items:

If the Town pays its full retirement benefit on July 1st we will save a substantial amount of money.

Noted that there were 67 applicants for position of Executive Assistant to the Town Manager in the Selectmen/Town Manager’s office.  Will pick top 10 applicants and schedule interviews.

The crematory passed an inspection based on national criteria with flying colors and Mr. Longo praised the crematory staff.  We have a well managed facility and a great staff.
Duxbury’s crematory does the fourth largest volume in the country, according to Mr.
Longo, who quoted from the inspection report.      

MEETING MINUTES:

Mr. Martecchini moved to accept the meeting minutes of February  28, 2005,  March 7, 2005, March 21, 2005, March 18, 2005 and April 12, 2005.  Mrs. Sullivan seconded.  The motion passed, 3-0.

BONUS SHELLFISH SEASON:  Mr. Martechini moved that a bonus shellfish season be approved for the month of  May, 2005 as per Don Beer’s memo.  Mrs. Sullivan seconded.  The motion passed, 3-0.

EXECUTIVE SESSION

At 8:50 PM, Mr. Tuffy moved the Board enter into executive session in accordance with MGL Chapter 39 Section 23B subsection (6) to discuss strategy with respect to the purchase of real property and to reconvene in open session at the conclusion of the executive session for the purpose of adjourning.  Mr. Martecchini seconded.  A roll call vote was taken as follows: Mr. Tuffy “aye,” Mr. Martecchini “aye,” and Mrs. Sullivan “aye.”  Mr. Joe Grady, Conservation Administrator was also present during the executive session.

On a roll call vote at 10:15 PM, the Board voted to end the executive session and to reconvene in open session, as follows John Tuffy “aye,” Andre Martecchini “aye,” and Betsy Sullivan “aye.”

At 10:16 PM, Mr. Tuffy moved to adjourn.  Mr. Martecchini seconded.  The motion passed, 3-0.
