BOARD OF SELECTMEN August 11, 2003
The meeting was called to order at 6:47 p.m. and went into Executive Session to discuss recommendations from the King Caesar Advisory Committee. Present were Chairman Elizabeth Sullivan, Selectmen John Tuffy and Andre Martecchini and Town Manager Rocco Longo.
INFORMATION SESSION FOR SNUG HARBOR SHARED SEPTIC SYSTEM
The Board of Selectmen held an informal discussion relative to proposed changes in Board of Selectmen’s Manual Section 7.13, Sewerage Rules and Regulations.
Mr. Martecchini opened this portion of the meeting by reviewing a memo prepared by Liz Beardsley of CDM.
J.R. Kent of Bayside Marine asked the Board for a spreadsheet of how costs per thousand gallons are allocated to the businesses within this system for each of the years since the system was put in place. He questioned the town’s contribution to the cost of the Bluefish system.
Informational packets were distributed to those in attendance who had not picked theirs up at locations designated in the Clipper prior to the meeting.
PUBLIC HEARING FOR SNUG HARBOR SHARED SEPTIC SYSTEM
At this point, Mr. Martecchini moved that the Board of Selectmen hold their regular agenda and open the schedule for a public hearing with the Board of Selectmen acting as Sewer Commissioners for the Snug Harbor Septic System. John Tuffy seconded. The motion passed, 3-0.
Mr. Martecchini reviewed the proposed changes to the bylaw, particularly the user charge which clearly specify all of the elements to be included when calculating fees.
A separate paragraph allowing separate meters to measure water that does not empty into the system was added. This will address the non-septic use of water for such purposes as boat washing, aquaculture, and similar activities.
A minimum user charge will be retained, regardless of the lack of activity at a dormant business.
The use of penalties was discussed at length; it was decided to leave the wording in Section 10 in place.
Mr. Martecchini asked for comments from the floor. Ned Lawson, Duxbury Bay Maritime School, had proofread the bylaw and outlined his corrections.
Frank Mangione, Finance Committee chairperson, pointed out two instances of misnumbering and corrections were noted.
Ruth Rowley questioned CDM’s assignment of gallonage and urged the Board of Selectmen not to make changes.
Mr. Longo suggested voting to continue the hearing until September 8, 2003, when all parties will have had more time to review proposed changes. John Tuffy moved to continue the hearing until September 8, 2003, at 7:35 pm in the Mural Room at Duxbury Town Hall. Andre Martecchini seconded. The motion passed, 3-0.
At 8:37, Mrs. Sullivan moved to adjourn the Public Hearing and reconvene in open session. John Tuffy seconded. The motion passed, 3-0.
D’ORAZIO’S ITALIAN MARKETPLACE – REQUEST FOR COMMON VICTUALLER’S LICENSE
Cristen Alloca appeared before the Board to request a Common Victualler’s License for D’Orazio’s Italian Marketplace at 35 Depot Street. They will be converting the adjacent space into seating for 40 people. All approvals from Town departments have been obtained. John Tuffy moved to grant a Common Victualler’s License to D’Orazio’s Italian Marketplace at 35 Depot Street as described in Karen McCann’s memo of August 8 to the Board. Andre Martecchini seconded. The motion passed, 3-0.
OPEN FORUM
Joe Conway, Chairman of the Town Beach Committee, appeared before the Board to voice his concerns about the Conservation Commission opening Orders of Conditions on Duxbury Beach. His group fears that this action may eliminate access to the beach by both vehicles and people. He urged the Board of Selectmen to rectify the situation.
Mrs. Sullivan pointed out that the Conservation Commission would meet to discuss this matter on Tuesday, August 12, and that it would be televised on Adelphia at that time.
TOWN MANAGER BRIEF
Mr. Longo pointed out that a press release had been sent to local papers regarding high bacteria counts at Shipyard Beach. This was due to runoff from heavy rains and should clear up within a few days, but until further notice, the beach is closed. Daily testing will be done and it will be open as soon as it is safe to do so.
BUSINESS:
One-day Liquor License – Bayside Marine
J.R. Kent applied for a one-day liquor license as part of Bayside Marine’s annual fishing tournament. It will be held on Saturday, August 16 from 3pm till 10 pm at the Bayside Boat yard.
All approvals have been received, and a TIPS certificate is in place. Andre Martecchini moved t grant a one day liquor license for the fishing tournament to be held on August 16, 2003, from 3 to 10 pm at the Bayside Boatyard. John Tuffy seconded. The motion passed, 3-0.
One-day Liquor License – Duxbury Bay Maritime School
Robin Nutter of the DBMS requested a one-day liquor license on behalf of the Classic Boat Festival, to be held on DBMS property in the shed on September 27 from 6 to 10 pm. Up to 250 people are expected to attend. All approvals have been obtained, TIPS certificates are in place and a certificate of insurance has been provided. At the request of the Fire Chief, the Master of Ceremonies will indicate all exits at the start of the function. This is a joint function involving the Duxbury Art Association, Duxbury Yacht Club, Rural and Historical Society, and others.
John Tuffy moved to grant a one-day liquor license to the Duxbury Bay Maritime School on September 27, 2003 from 6 to 10 pm. Andre Martecchini seconded. The motion passed, 3-0.
Neighborhood Block Party – Pine Point Rd.
David Rollins had applied for a permit for a block party for this neighborhood. In his absence, Caroline Dunham addressed the Board. They would like to have their annual (20+ years) block party on Saturday, August 30 with a rain date of Sunday, August 31, from 3 to 11pm. They expect between 200 and 400 people to come and go between these hours. A liquor liability certificate of insurance is provided, TIPS certification is in place, and all approvals have been received. According to Ms. Dunham, for over 20 years, this neighborhood has held this party without any problems.
Andre Martecchini moved to approve a neighborhood block party on Pine Point Road on August 30, 2003 with a rain date of August 31, 2003 from 3 to 11pm. John Tuffy seconded. The motion passed, 3-0.
Minutes – July 22 and July 28
John Tuffy moved to accept the minutes of July 22 as written. Betsy Sullivan seconded. Andre Martecchini abstained. The motion passed, 2-0.

Committee Appointments
Betsy Sullivan moved to reappoint Miriam McCaig and Mary Ellen See to three year terms as Registrars of Voters. John Tuffy seconded. The motion passed, 3-0.
Mrs. Sullivan moved to reappoint Susan Littlefield to a 3 year term on the Recreation Activities Committee, and to reappoint Gordon Cushing to a one year term on that committee as ex-officio. Chuck Foster had resigned from the committee and Mrs. Sullivan moved to appoint Anne Ward, 19 Franklin Terrace, to the remainder of his unexpired term which ends June 30, 2004. Joseph Marrocco also resigned and she moved to appoint Rick Davis, 222 Chestnut Street, to his unexpired term, also ending June 30, 2004. Andre Martecchini seconded the motions, which passed, 3-0.
Mrs. Sullivan moved to reappoint Chief William Harriman, ex-officio, to a one-year term on the Highway Safety Committee; to appoint Dennis Symmonds to the unexpired term created by Friend Weiler’s resignation, and to appoint Fred Von Bargen, 62 Tobey Garden Street, to the 3 year term vacated by Linda Garrity, who is not seeking reappointment. John Tuffy seconded; the motions passed, 3-0.
Mrs. Sullivan moved to reappoint Albertina Bruce, Joe Shea and Bridget O’Keefe to three year terms on the Municipal Commission on Disability, and to appoint Marcia G. Solberg, 278 Washington Street to a two-year term expiring June 30, 2005. John Tuffy seconded. The motion passed, 3-0. Mrs. Sullivan further moved to appoint Rocco Longo, ex-officio, to a one-year term expiring June 30, 2004. John Tuffy seconded, and the motion passed, 3-0.
Mrs. Sullivan requested updated committee lists reflecting recent changes.
August 25, 2003 Meeting
Budget presentations by Conservation, Planning and Inspectional Services Departments will begin at 7:00 pm, followed by discussion with Friend Weiler and the Conservation Commission.
John Tuffy motioned to adjourn at 9:10 pm. Andre Martecchini seconded. The motion passed, 3-0.
