BOARD OF SELECTMEN                                                      November 20, 2003

The meeting was called to order at 8:00 a.m.   Present were Chairman Elizabeth Sullivan, Selectmen Andre Martecchini and John Tuffy.  Town Manager Rocco Longo was not present.

OPEN FORUM

There was no one present under Open Forum.

PUBLIC HEARING – BOARD OF SELECTMEN ACTING AS LICENSING AUTHORITY VOTE TO PERMIT THE SELLING OF ALCOHOL ON SUNDAYS FROM NOVEMBER 23, 2003 THROUGH DECEMBER 28, 2003.

Mrs. Sullivan noted approval letters have been obtained from Chief Mark DeLuca, Chief William Harriman and Richard MacDonald, Director of Inspectional Services relative to the Package Good Stores being allowed to be open on the Sunday before Thanksgiving through the Sunday before New Years.  The stores are as follows:

Osborne’s Country Store
Bennett’s General Store
Duxbury Wine and Spirits
Duxbury General Store
La Maison Du Vin Inc.
The Wine Depot and Liquors
Millbrook Market

Mr. Martecchini moved the Selectmen, acting as Licensing Authority, approve the request of the Package Goods Store Owners: Osborne’s Country Store, Hick’s Point Ventures, Inc. d/b/a Bennett’s General Store, Duxbury Wine and Spirits, Duxbury General Store, La Maison Du Vin Inc., The Wine Depot and Liquors, and Duxbury Provisions d/b/a Millbrook Market Inc. to sell alcoholic beverages on Sundays, November 23, November 30, December 7, December 14, December 21 and December 28, 2003 subject to the following:

Stores may not open before noon.
Stores must close not later than 11:00 p.m. (11:30 p.m. if the following day is a Monday Holiday).
Employees must be paid at a rate not less than one and one half times the employee’s regular rate.
No employee shall be required to work and refusal to work on a Sunday shall not be grounds for discrimination, dismissal, deduction of hours, or any other penalty.
No unauthorized signs advertising such openings will be allowed to be displaced.

Further, Board of Selectmen advised the Package Goods Store Owners cannot sell or deliver alcoholic beverages at any time during the day on Thanksgiving Day, Thursday, November 27, 2003 and Christmas Day, December 25, 2003 (Thursday).

According to the Alcoholic Beverage Control Commission, Package stores may remain open until 11:30 p.m. on Wednesday, November 26, 2003 (Thanksgiving Eve), Wednesday, December 24, 2003 (Christmas Eve) and Wednesday, December 31, 2003 (New Year’s Eve).  All licensees may sell or deliver alcoholic beverages on New Year’s Day, Thursday, January 1, 2004.  Regular opening and closing hours that are stated on the license for 2004 will apply.

BUSINESS

MEETING MINUTES NOVEMBER 12, 2003

Mr. Tuffy moved the Board approve the meeting minutes of November 12, 2003 as written.  Mr. Martecchini seconded.  The motion passed 3-0.

Mr. Martecchini moved the Board approve the Executive Session meeting minutes of November 12, 2003 as written, and to be kept in public record until the reason for the meeting has passed.  Mr. Tuffy seconded.  The motion passed 3-0.

COMMITTEE APPOINTMENTS/RE-APPOINTMENTS

Mrs. Sullivan moved the Board appoint Mack Herman as a member of the Duxbury Youth Commission for a period of one year.  Mr. Tuffy seconded.  The motion passed 3-0.

Mrs. Sullivan moved the Board appoint Erica Morrocco as an alternate member of the Duxbury Youth Commission for a period of one year.  Mr. Martecchini seconded.  The motion passed 3-0.

Mrs. Sullivan noted Dr. Eileen Williams recommended these individuals.  She further noted that after one year, they will switch appointments, i.e. Mack Herman will be appointed an alternate, and Erica Morrocco will be appointed a member of the Duxbury Youth Commission.

Mrs. Sullivan regretfully, but understandably accepted the resignation of Mr. William Billingham as a member of the Board of Health.

At 8:12 A.m. Mr. Tuffy moved to adjourn.  Mr. Martecchini seconded.  The motion passed 3-0.
