BOARD OF SELECTMEN MEETING March 4, 2002
The meeting was called to order at 7:05 p.m. Present were Selectmen Andre Martecchini, Chair, Margaret Kearney, John Tuffy as well as Rocco Longo, Town Manager.
DUCK HILL VILLAGE
Also present for discussion with the Board: Bob Troy, Town Counsel. Attorney Jon Witten joined the meeting at 7:15 p.m.
There was a brief discussion outlining why the Town should join the lawsuit over the Duck Hill Project.
The Board of Selectmen unanimously voted to join the lawsuit that was filed by the Duck Hill Neighborhood Association against the Massachusetts Housing Finance Agency for its preliminary approval of a 108-unit condominium development on the Duxbury/Marshfield line. This project called Webster Estates, is under Chapter 40B, would build 51 condominium units on 18 acres in Duxbury and 57 Units on 25 acres in Marshfield.
The Board felt that this suit was necessary because MassHousing did not take into consideration the town's opposition to the project. The Selectmen further stated that they were not necessarily opposed to a development on this site.

$225,000 GIFT TO THE TOWN - SR. CENTER FURNITURE

Tom Chapman read a letter from the Friends of the Duxbury Council on Aging offering to the Town of Duxbury all of the furnishings and decorations that were purchased by them to complete the décor of the new Senior Center. The value of this gift is approximately $225,000. This letter is attached and made part of these minutes.
The Board of Selectmen voted to accept the gift from the Sr. Center valued at approximately $225,000 for all of the furnishings and decorations that were purchased by the Friends of the Council on Aging to complete the décor of the new Sr. Center. The

Board noted that this gift does not include computers that have been given to and/or purchased for use in the Senior Center.
DISCUSSION - ARTICLES 29, 30 (RELATIVE TO PIER MORATORIUM AND ZONING BY-LAW)

Shawn Dahlen presented to the Board of Selectmen a packet of information that is attached and made part of these minutes concerning "Pier Proliferation - Fact or Fantasy" on Articles 29 and 30.
Article 29
To see if the Town will establish a committee to study, develop, and recommend guidelines, principles and practices for pier regulations, such recommendations to be made at the next Annual Town Meeting, and to appropriate a sum of money to engage consultants or other services or materials required for such study, or take any action in relation thereto.
The Board voted not support Article 29 (0-3).
Article 30
To see if the Town will vote to amend the Protective by-law of the Town of Duxbury by adding a new Section 611 entitled "Special Regulations on Piers" under Article 600 Special Regulations as follows:
No new pier or part thereof shall be constructed as a principal or accessory use in any district for a period of one year from the date of approval of this section by the Massachusetts Attorney General, or June 30, 2003, whichever is a longer period of time, to provide time to study, develop and recommend guidelines, principles and best practices for pier regulation, and for the Town to consider and adopt any such proposals at the next Annual Town Meeting. Whereas the Town is in the process of engaging in such a study, it is desired to protect the waterfront from ill-advised pier projects pending such action, and a moratorium on the issuance of special permits and building permits for the construction of such piers is hereby in effect for the period of item described
above, or take any action in relation thereto.
The Selectmen voted not to support Article 30 (0-3).

Also attached and made part of these minutes is "Why Affirm Articles 29 and 30? - Rebuttal to Negative Points" by the Bay Preservation Committee.
BUSINESS
Town Manager's Brief
Mr. Longo introduced Heather Durant who is an intern working for the Town of Duxbury.
Vote on Annual Town Meeting Articles/STM Articles (March 9, 2002)
Article 12 - Community Preservation Committee - to see if the Town will vote to appropriate Community Preservation Fund revenues for historic preservation for Open Space Acquisition. (BOS voted to Indefinitely Postpone this article).
Article 13 - Community Preservation Committee - to see if the town will vote to appropriate Community Preservation Fund revenues for Open Space Acquisition. (BOS voted to Indefinitely Postpone this article).
Article 14 - Community Preservation Committee - to see if the Town will vote to appropriate or reserve monies from the Community Preservation Fund for CPC Administrative Expenses; Reserves monies from the Community Preservation Fund for CPC Administrative Expenses; Reserves (as required by the CPA) for: Open Space Land Acquisition, Community Housing and Historic Preservation. (BOS voted to support $83,000 - Open Space - $83,000 for Historic Preservation and $83,000 for Land Acquisition.)
Article 16 - Radiological Response Emergency Planning - Citizens Petition (BOS voted not to support 0-3).
Article 17 - Radiation Dose Reduction Study for Shelter(s) - (BOS voted to support A.M., J.T. - 2 -1 M.K.)
Articles 18-21 are on hold until the Selectmen's meeting prior to the Annual Town Meeting on March 9, 2002. These by-law changes are to do with Historical Zoning By-Law changes.
Article 27 - Police Revolving Fund (Police Detail Deposit Housekeeping item) (BOS voted to support in the amount of $14,000.)

Article 34 - Permanent rights regarding the installation of the padmount transformer, primary wires, service facilities and associated equipment - Duxbury Senior Center. This article will be voted at the Selectmen's meeting on Saturday, March 9, 2002.
Article 35 - South Shore Habitat for Humanity (Request for Parcel of Land) - Citizens Petition. (BOS voted to Indefinitely Postpone Article 35).
Article 36 - Rescind Authorized and Unissued Debt - (BOS voted to Indefinitely Postpone Article 36).
Article 39 - Street Acceptances - Cable Hill Way - (BOS voted to Indefinitely Postpone Article 39.)
SPECIAL TOWN MEETING:
Article 3 - Unpaid Bills - The Board of Selectmen revoted to support this article in the amount of $1,866.99. There may have to be another revote on this article before the Annual Town Meeting on March 9, 2002.

One Day Liquor License - Holy Family Church
The Board of Selectmen voted to grant Holy Family Church a one day liquor license for March 16, 2002 for their Irish Night from 8 - 12 p.m.
2003 Operating Budget
The Board of Selectmen voted to support the Aerial Ladder Truck (2 - J.T. M.K. - 1- A.M.). The truck will be bonded in the amount of $625,000.
