3-26 Board Of Selectmen Minutes
BOARD OF SELECTMEN MEETING                              March 26, 2002

The meeting was called to order at 7:00 p.m.  Present were Selectmen Andre Martecchini, Chair, John Tuffy, Elizabeth Sullivan and Rocco Longo, Town Manager.

OPEN FORUM

There was no one in attendance for Open Forum.

SWEARING IN OF NEWLY ELECTED PUBLIC OFFICIALS

The following individuals were sworn in by Nancy Oates, Town Clerk:

Elizabeth H. Sullivan   - Selectman One – 3 Yrs.
Allen M. Bornheimer – Moderator One – 1 Yr.
Kathleen M. Kazanowski – School Committee Two – 3 Yrs.
Amy M. MacNab – Planning Board One – 5 Yrs.

Business

Bonus Shellfish Season (April)

The Board voted favorably to declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of April as outlined in the regulations in attachments B & C.

The Board voted favorably to declare a temporary Bonus Shellfish Season for the commercial harvesting of quahog clams for the months of April as outlined in the regulations in attachments A & C.  

Attachments A, B, & C are attached and made part of these minutes.

One Day Liquor License – Duxbury Bay Maritime School

The Board voted favorably to grant the Duxbury Bay Maritime School a one day liquor license for the Bay Clam Jam scheduled to take place on Friday, May 24, 2002 from 6:00 p.m. – 11:30 p.m.  Letters of recommendations from Richard MacDonald, Director of Inspectional Services, Mark DeLuca, Chief of Police and Bill Harriman, Fire Chief all state there are no objections to the granting of this request.

Board of Selectmen Minutes – 3/18/02

The Board voted favorably to accept the minutes of 3/18/02 as presented.  Ms. Sullivan abstained.

BEACH ACCESS RIGHTS COMMITTEE (BARC)

Nancy Day submitted a petition made up of 1600 signatures of BARC supporters who would like to repeal the Duxbury Beach Dog Ban currently in place from April 1st – August 31st.

Mr. Al Vautrinot, Chairman of the Duxbury Beach Technical Committee indicated that the committee has gained approval from the Massachusetts National Heritage and Endangered Species program and would like to recommend the Duxbury Beach Dog Control Program.  This program will allow the dogs back on the beach in certain areas with the following conditions:

No additional cost to the Reservation is incurred.
The ban will be re-instituted, if at any time it comes to the attention of the Committee that it should be.

The newly proposed Duxbury Beach Dog Program is attached and made part of these minutes.  

Mr. Martecchini commended the members of the Beach Access Right Committee for working with the Duxbury Beach Technical Committee to develop a compromise that would lift the ban, but also provide appropriate controls to ensure State requirements are met.  Ms. Nancy Day appealed to all dog owners to follow the rules.  

Mr. Don Beers, Harbormaster submitted a memo to the Board outlining proposed dog regulation for Duxbury Beach properties.  He also informed the Board that signage would be going up.  Sign-up sheets will also be available after hours at the Harbormaster’s office.

Mr. Longo indicated a license can be obtained from the Town Hall Switchboard Operator beginning on Thursday, 3/28/02.   Ms. Sullivan noted that obtaining a license for your dog beginning April 1st would coincide nicely.

Mr. Martecchini cautioned everyone to pay close attention to the rules and regulations.  He asked that people self-police, so that the few do not spoil it for the many.  He believes the Town can handle the cost within normal budget, however, will revisit next year to determine if a cost associated with obtaining the license will be necessary.  He cautioned, the cost will go up if the Town must step up patrols

The board voted favorably to adopt the Duxbury Beach Dog Control Program as outlined in a memo that Donald Beers, Harbormaster submitted dated 3/24/02.





REORGANIZATION OF THE BOARD OF SELECTMEN

The Board voted favorably to reorganize as follows:

Andre P. Martecchini, Clerk
