BOARD OF SELECTMEN May 20, 2002
The meeting was called to order at 7:30 p.m. Present were Selectmen John Tuffy, Chair, Elizabeth Sullivan, Andre Martecchini, and Rocco Longo, Town Manager.
OPEN FORUM
Mrs. Diane Fagan, V.P. Duxbury Youth Football requested the Board of Selectmen enforce the policy established in 1994 that states mixed resident leagues will not be issued permits to use Duxbury’s football fields.
Mr. Pat Kramer, Duxbury Pop Warner distributed a letter to the Board of Selectmen that stated the nine children who were registered from out of town have been removed from the participant registration list. He then asked the Board of Selectmen to consider allowing these children to play in Duxbury as a gesture of good will and kind treatment to these children.
Mr. Tuffy noted that the policy of not issuing permits to mixed resident leagues was formulated 8 years ago and the position of the Board is to uphold the rule. Mrs. Sullivan also noted that the football fields are already overused and allowing these nine children to play is a precedent we do not have the luxury of setting.
Mrs. Mary Lampert requested a letter from the Board of Selectmen providing authorization for two members of the Nuclear Advisory Committee to observe the exercise for the Plymouth Nuclear Power Station scheduled to take place on Wednesday, 5/22/02 at the Emergency Operations Center.
Mr. Longo informed the Board there is not enough room for additional people to observe and that he was not sure it would be of any value. He also indicated that Chief William Harriman was of the same opinion.
Mr. Tuffy informed Mrs. Lampert there would be a written evaluation presented and the Board of Selectmen will accept Chief Harriman’s advice not to grant this request.
OPEN/CLOSE SPECIAL TOWN MEETING WARRANT
Mr. Longo reviewed a draft list of the Special Town Meeting Articles with the Board of Selectmen. Document is attached and made part of these minutes.
Articles 1 – 6 were submitted by the Community Preservation Committee. There will be more information available on Articles 3 & 4 in approximately two weeks. A Public Hearing is scheduled on 5/22/02 at 7:00 p.m. in the Merry Room at the Duxbury Library. The Affordable Housing Committee will attend to discuss possible usage of the land.
Article 7 was submitted by the Conservation Commission consisting of proposed revisions to Chapter 9 – Wetlands Protection ByLaw.
Articles 8 & 9 were submitted by the Historical Commission. A hearing has been scheduled with the Zoning Board as required by law. Mr. Tuffy requested the Historical Commission be placed on an upcoming Board of Selectmen meeting agenda.
Article 10 represents a transfer of funds between the Salary and Expense Columns for the Fiscal Year beginning July 1, 2002. This Article was initiated by the Board of Selectmen.
Articles 11 & 12 are Citizens Petitions submitted by Jackson S. Kent, III. Both Articles propose a change in zoning relative to the area located by Bayside Marine.
Article 13 is also a Citizens Petition relating to the acceptance of the provisions of a bill proposed for early retirement incentive for members of local retirement systems. Mr. Longo indicated he will give this to Town Counsel.
Mr. Longo noted that Article 14, Habitat for Humanity, was initiated by Ken Myers and that he is interested in pursuing this with the CPC.
Article 15 represents the payment of unpaid bills. There has been one submitted to date.
Mr. Tuffy indicated he would like the Board to vote on these Articles at the 6/3/02 and 6/10/02 meetings.
Mr. Martecchini moved the Board of Selectmen open the Warrant for the Special Town Meeting to be held on June 17, 2002. All in favor, Mrs. Sullivan “aye”, Mr. Tuffy “aye”, Mr. Martecchini “aye”.
Mr. Martecchini moved the Board of Selectmen recommend Articles 1 – 15, as listed on the document entitled “Revision 4, Draft List of the Special Town Meeting Articles” dated May 17, 2002. All in favor, Mrs. Sullivan “aye”, Mr. Tuffy “aye”, Mr. Martecchini “aye”. This document has been attached and made part of these minutes.
Mr. Martecchini moved the Board of Selectmen close the Special Town Meeting Warrant to be held on June 17, 2002. All in favor, Mrs. Sullivan “aye”, Mr. Tuffy “aye”, Mr. Martecchini “aye”.
Mr. Tuffy noted a Board of Selectmen meeting would be held on June 17, 2002 at 7:00 p.m. at the Duxbury High School auditorium and should be posted.
BUSINESS
Loring Property Intent to Sell
Mr. Tuffy noted a letter sent to the Board of Selectmen dated May 13, 2002 from Mr. Edgar W. Loring, II of 85 Indian Pond Road, Kingston, MA giving notice of intent to sell pursuant to M.G.L. Chapter 61A, Sec. 14, (Edgar W. Loring, Inc.’s property owner); a one (1) acre parcel of land (being approximately 477.86 ft. x 83.7 ft.) being a portion of Duxbury Assessors’ Parcel #100-021-000 for residential purposes pursuant to an Offer To Purchase Agreement dated 5/7/02.
The Board of Selectmen referred the above mentioned document to the Planning Board and the Conservation Commission for recommendation as to whether or not they are interested in pursuing acquisition of the property.
Appointments/Charge Duxbury Bay Management Committee
Mr. Martecchini read a proposed “Charge” for the Duxbury Bay Management Committee. This document is attached and made part of these minutes.
Mrs. Sullivan noted that once the committee is appointed, the Charge for the committee would be established. She preferred the Charge be more conceptual in nature. Mr. Martecchini cautioned the committee not to get bogged down with other Town’s agendas. Mr. Longo indicated that technical support from Town Hall would be available as needed.
Mr. Bill Tenhoor asked the Board if there will be a separate committee to address the Pier Study, as they are starting to fall behind in commitments. Mr. Martecchini indicated that there would be a separate committee that will work on a much faster track. He also indicated the Board of Selectmen would appoint 7 individuals to the Pier Committee on June 3rd.

Appointments – Duxbury Cultural Council
The Board of Selectmen favorably voted to appoint Beth MacLeod, Nancy Melia and Katherine Sturgis to the Duxbury Cultural Council for a three-year term to expire June 30, 2005.
Re-appointments – Duxbury Cultural Council
The Board of Selectmen favorably voted to re-appoint Lyell Franke and Lynn Smith, whose terms expire July 1, 2002, to the Duxbury Cultural Council for a three year term to expire June 30, 2005.
Bonus Shellfish Season (June)
The Board of Selectmen favorably voted to:
Declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of June. Regulations as attached (Please see Attachment B & C).

Brittany Lambert Road Race
A letter was sent to the Town Manager from Laurie Reney of the Brittany Lambert Foundation requesting permission from the Town to hold their third annual Brittany Lambert Road Race on Sunday, October 20, 2002. The race course will be the same as last year, beginning at Chandler School, running down Chandler Street, turning right onto Otter Rock Road, right onto Mayflower Street, left onto Bolas Road and then left onto Chandler Street, ending at the Chandler School.
Mr. Tuffy noted written recommendations from Chief Mark DeLuca, Duxbury Police Department and Chief William Harriman, Duxbury Fire Department, stating they have no objections to the Brittany Lambert Road Race. Mr. Longo indicated the Duxbury Police Department would also provide support on the day of the race.
The Board favorably voted to approve the third annual Brittany Lambert Road Race to be held on Sunday, October 20, 2002.
Renewal – Common Victualler’s License Renewal 2002
Dana V. Battista d/b/a Duxbury Beach Park II
Mr. Tuffy noted a memo from Mark DeLuca, Chief of Police stating the Police Department does not have a problem with the request for renewal of this Common Victualler’s License. He also noted a memorandum from Jennifer Dalrymple, Board of Health Agent that indicated an application for a Permit to Operate a Food Establishment was received and arrangements are being made to schedule an inspection of this food establishment as soon as possible.
The Board of Selectmen favorably voted to approve a Common Victualler’s License for Dana V. Battista d/b/a Duxbury Beach Park II subject to the Board of Health’s ability to schedule and pass an inspection of this establishment.
Accept Anonymous Gift in the Amount of $5,000 for new Animal Shelter
The Board of Selectmen favorably voted to accept a generous gift of $5,000, which was made anonymously, for the new Animal Shelter. The Board expressed their thanks for the donation.

The Board of Selectmen favorably voted to approve the minutes for 5/13/02 as amended.

The Board of Selectmen favorably voted to approve the Executive Session Minutes for 5/13/02 as drafted.
Mr. Tuffy announced there would be no Board of Selectmen meeting held on Monday, May 27, 2002.
