BOARD OF SELECTMEN August 12, 2002
The meeting was called to order at 7:00 p.m. Present were Selectmen John Tuffy, Chair, Elizabeth Sullivan and Rocco Longo, Town Manager. Mr. Andre Martecchini was absent.
OPEN FORUM
There was no one present under the Open Forum.
EXECUTIVE SESSION
At 7:01 p.m. Mr. Tuffy moved to go into Executive Session to discuss strategy with respect to pending litigation; and to discuss recommendations from the King Caesar Advisory Committee which are confidential in nature as they relate to the King Caesar Poor and Hospital Fund, the purpose of which is to provide medical relief for the poor and elderly citizens of Duxbury, and to reconvene in Open Session in accordance with Mass. General Laws, Chapter 39, Section 23, Subsection 6. A roll call vote was taken - Mrs. Sullivan "aye", and Mr. Tuffy - "aye."
At 7:35 p.m. there was another roll call vote taken by Mr. Tuffy as the Executive Session adjourned. Mrs. Sullivan - "aye", and Mr. Tuffy - "aye."
The meeting resumed in Open Session at 7:36 p.m.

MANDATORY OUTSIDE WATER USE RESTRICTIONS
Mr. Carl Hillstrom, Water/Sewer Superintendent requested the Board to declare a “State of Water Supply Conservation” and impose the following restrictions immediately:
Outdoor watering by water users with odd numbered addresses is restricted to odd numbered days.
Outdoor watering by water users with even numbered addresses is restricted to even numbered days.
All outdoor watering is to be done between the hours of 6:00 a.m. – 9:00 a.m. and 6:00 p.m. – 9:00 p.m.
This request was made due to the prolonged dry spell. He explained that with ground water levels dropping, the Town would not be able to sustain the current level of pumping without significant rainfall, which is not in the forecast.

The Board favorably voted to put forth a water ban as described in an August 12th memo from Mr. Carl Hillstrom regarding mandatory outside water use restriction, effective immediately.
Mr. Hillstrom further noted that the Water Department will assign all fines and that the ban relates to all outdoor use. Any person violating these restrictions will be subjected to a penalty of $50.00 for the first violation and $100.00 for each subsequent violation.
NUCLEAR ADVISORY COMMITTEE DISCUSSION – What is Mass. Department of Public Health Potassium Iodide K1 Program?
Mrs. Mary Lampert, Chairman of the Duxbury Nuclear Advisory Committee distributed and reviewed information from the Massachusetts Department of Public Health that describes their new KI Policy. Mrs. Lampert also distributed an email from Assistant Commissioner, Nancy Ridley noting responses to questions that were sent to her.
Mr. Tuffy thanked Mrs. Lampert for the information. He requested the Nuclear Advisory Committee to document all of their recommendations and submit them to the Board of Selectmen for review. Mrs. Lampert indicated the Committee’s main concern is a safer method of storage for the placement of spent fuel.
ALCOHOL POLICY DISCUSSION
Mr. Longo informed the Board he has reviewed the Board of Selectmen’s Manual and meeting minutes from an earlier Board discussion relative to alcohol use on public property in January 1997.
Section 4.0 LICENSES, PERMITS AND FEES in the Selectmen’s Manual provides for the granting of One-Day Liquor Licenses. There are no exclusions noted in the policy, therefore, he believes the policy would allow the Board of Selectmen to grant One-Day Liquor Licenses at the Senior Center.
Mr. Longo also noted the One-Day Alcohol Policy varies from town to town, there is no consistency and every request for a one-day liquor license at the Senior Center should be taken up on a case by case basis. The Board agreed there is no need to take any further action on this matter.

7/29/02 Minutes
The Board favorably voted to approve the minutes of July 29, 2002 as drafted.
Block Party Request – 4 Pine Pt. Road
The Board favorably voted to approve the request for a block party at 4 Pine Point Place on Saturday, August 24, 2002 from 5:00 p.m. – 11:00 p.m., rain date August 25, 2002, with approval received from Chief William Harriman and Chief Mark DeLuca, as presented.
Block Party Request – 8 Buckboard Road
The Board favorably voted to approve the request for a block party at 8 Buckboard Road on Saturday, September 7, 2002 at 1:00 p.m., rain date September 14, 2002, with approval received from Chief William Harriman and Chief Mark DeLuca.
Mr. Tuffy noted that the location of the block party is in his neighborhood and normally he would recuse himself, however, because Mr. Martecchini is absent and a quorum is needed, he would participate in the vote.
One-Day Liquor License Request – Bay Side Marine Corporation
The Board favorably voted to approve a one-day liquor license to be used on Saturday, August 17, 2002 for a fishing tournament from 4:00 p.m. – 11:00 p.m. Approval letters from Mark DeLuca, Chief of Police and William Harriman, Fire Chief were noted.
Gift – K&S Novelty - $1,000 Marge Parcher Fund
The Board favorably voted to accept a gift from K&S Novelty to the Marge Parcher Fund in the amount of $1,000.00.
Extended Hour for 11/5/02 State Election
The Board favorably voted to extend the voting hours for the November 5, 2002 General Election for one hour, polls to open from 6 a.m. until 8 p.m. as presented in a memo from the Town Clerk dated August 5, 2002.
The meeting adjourned at 8:02 p.m.
