BOARD OF SELECTMEN October 28, 2002
The meeting was called to order at 7:30 p.m. Present were Selectmen John Tuffy, Chair, Elizabeth Sullivan, Andre Martecchini and Rocco Longo, Town Manager.
OPEN FORUM
There was no one present under the Open Forum.
NEW ANIMAL SHELTER UPDATE – Annie Eldridge
Ms. Eldridge reported $81,426.00 has been raised to date for the new animal shelter. She thanked her committee members for their help and was very grateful for the community-wide support shown.
Ms. Eldridge noted that Tom Daley, DPW Director and Lt. Roger Banfill, Duxbury Police Department, provided the direction needed to finalize their efforts. The shelter will be modular and smaller than Kingston’s shelter. Tom Daley will present detailed plans to the Board on November 18th. The committee’s goal is to raise $100,000 by March’s Annual Town Meeting.
Mrs. Billy Emerson listed the Committee’s expectations of the new Animal Control Officer’s responsibilities. Lt. Banfill will be provided with this list.
The Board thanked Ms. Eldridge, the committee members, and volunteers for their efforts.
DRY CASK STORAGE RESOLUTION – Nuclear Advisory Committee/Entergy
Entergy representatives and members of the Nuclear Advisory Committee, including Chair, Mary Lampert, and Nuclear Physicist Dr. Gordon Thompson explained their positions.
Currently at Pilgrim, used nuclear fuel is kept in a 40-ft deep indoor storage pool. The pool is made of 6-ft thick reinforced concrete walls and contains 2,300 spent nuclear fuel rods in a high-density rack system. The water cools the nuclear waste and prevents it from overheating and catching fire. Dr. Gordon Thompson noted that a fire burning 2,300 spent fuel rods could not be extinguished because it would be too radioactive.
Jack Alexander, who represents government relations for Entergy indicated the White Plains New York Company uses dry cask storage at two of its other ten nuclear power plants. However, there are no plans to implement it at Pilgrim. He also indicated that both systems are safe. At this time there is plenty of room in the spent fuel pool. Mr. Mike Slobodien, Entergy’s certified health physicist noted it is a safe technology licensed by the Nuclear Regulatory Commission.
Mr. Rich Drake, a licensed structural engineer for Entergy indicated that Pilgrim was designed to withstand an F5 tornado, 300-mph winds, and tornado-borne missiles, as well as earthquakes.
Mrs. Mary Lampert asked the Board to join the Board of Health, the Nuclear Advisory Committee and citizens by endorsing a campaign advocating the immediate move to dry cask storage, or a longer resolution to decrease the risk of terrorism at nuclear reactors with dry cask storage.
The Board indicated that would vote on both issues at a later date.
YOUTH AND ALCOHOL POLICY – Chief Mark DeLuca
Chief DeLuca presented his “General Policy Concerned with Youth and Alcohol” to the Board. The policy includes a summary of more commonly violated statutes, i.e. possession of alcohol not involving any vehicle and transporting alcohol with a vehicle involved. Other types of violations were discussed such as youths who are flagrant or repeat offenders of alcoholic beverage laws, youths who are transporting or providing alcohol to others, and hosts of underage drinking parties. Chief DeLuca noted if a police officer encounters any of these three types of violators, the preferred response would be arrest and prosecution.
Mr. Tuffy noted that the Youth and Alcohol Policy has been approved by Town Counsel and will be published on the Police Department’s web site. Chief DeLuca also plans to present this policy at the schools. Mrs. Sullivan thanked the Chief for developing the policy.
The Board voted favorably to adopt the Youth and Alcohol as presented by Chief DeLuca.
BUSINESS
Town Manager's Brief
The Town Manager’s Brief is attached and made part of these minutes. Highlights are as follows:
Paul Cusson, Webster Hill C40B Project Developer, is on a November agenda to seek approval for water service. He will seek water for both sides of the project, Duxbury and Marshfield. Residents, members of the Water Department and the DPW will be in attendance.
The DPW Director, Collector Treasurer and Mr. Longo will be making recommendations to the Fiscal Advisory Committee on 11/7/02 to amend the current sticker prices and Transfer Station practices. They will continue to pursue long-range solutions. The reason to pursue short-range options at this time is due to:
Recent changes at the Bourne Transfer Station
Increased costs per ton at SEMASS and
Increased volume of waste.
Recommendations will be presented to the Board on November 12, 2002.
The Massachusetts Association of Assessing Officers awarded Sue Libby the “Clerk of the Year” award.
Workplace Violence Policy

The Critical Incident Team is in the process of developing a training program for employees.
The Board voted favorably to adopt the policy on Workplace Violence as written.
Bonus Shellfish Season (November)
The Board voted favorably to declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of November as outlined in the regulations in attachments B & C.
The Board voted favorably to declare a temporary Bonus Shellfish Season for the commercial harvesting of quahog clams for the month of November as outlined in the regulations in attachments A & C.
The Board voted favorably to declare a temporary Bonus Shellfish Season for the recreational harvesting of soft shelled clams for the month of November as outlined in the regulations in attachment D.
One-Day Liquor License – Crossroads for Kids
The Board voted favorably to grant a One-Day Liquor License for the Crossroads for Kids Annual Fall Fundraiser, a Harvest Moon Benefit to be held on Saturday, November 2, 2002 at the Duxbury Stockade from 7:3- p.m. – 11:30 p.m., with appropriate insurance and compliance with requests from Chief William Harriman. Letters of approval were received from Chief Mark DeLuca and Richard MacDonald, Director, Building/Inspectional Services.
Thank You – NSTAR - $1,000 For Tree Planting
The Board voted favorably to accept NSTAR’s generous gift of $100.00 to be used for tree planting within the community and promote the proper planting of trees around electric wires.
