2010/07-20

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, July 20, 2010 beginning at 7:00 p.m.  Members present included Dianne Hearn, Barbara Kelley, Holly Morris and Corey Wisneski.  Chairman Joseph Messina, Samuel Butcher, and Thomas Gill were absent.  Also present was Conservation Administrator Joe Grady. Barbara Kelley was Acting Chairman.

PH, OLDE KINGS, LLC, 180 HIGH ST., SUBDIVISION, SE 18-1537
Representing the applicant were John Baldwin, Raymond MacFarlane, and Jeff Hassett from McKenzie Engineering Co.  The proposed project is construction of a 3-lot subdivision.  The wetlands delineation was done by Sharon Laport from Lady Slipper Consulting.  The Conservation Administrator agreed to the wetlands line as shown on the proposed plan.  Construction activities within the buffer to the wetlands included a small portion of the roadway and stormwater drainage system.  Mr. Hassett indicated that Horsley and Witten Co. was the engineering consultant for the Planning Board.  Mr. Grady noted that the plans submitted with the Notice of Intent are not the most recent; however, he had reviewed with the Town Planner the revised plans dated 7/13/2010, the correspondence and the recommendations of Horsley and Witten.  One issue still outstanding was how the applicant would protect the drainage system during house construction.  Mr. Grady recommended that as part of the Orders of Conditions the applicant should submit for approval an erosion control plan before building permits are issued for each house.   Ms. Wisneski made a motion that was seconded to issue Orders of Conditions for the proposed subdivision subject to receiving the revised plans dated 7/13/2010.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PM, LOWRY, 105 STANDISH ST., VEGETATION CUTTING
Representing the applicant was Freeman Boynton of Duxbury Construction LLC.  Mr. Boynton explained the project which was to remove the overgrowth and invasive vegetation to restore an area back to pasture, as shown in photographs submitted with the Request for Determination of Applicability (RDA) application.  The work will be done during the dry season. Ms. Hearn made a motion that was seconded to issue a negative determination that a Notice of Intent is not requiring for the proposed vegetation cutting project.   The vote was 4 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
Mr. Grady explained that a parcel of land off Elm Street (Parcel 150-911-018) that was purchased using money from the Conservation Fund was inadvertently deeded to the Board of Selectmen rather than the Conservation Commission.  The Board of Selectmen has agreed to transfer the property to the Conservation Commission.  Ms. Morris made a motion that was seconded to accept the land transfer of parcel 150-911-018 to the care and custody of the Conservation Commission.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed a request for a Certificate of Compliance for SE 18-1330, 521 Congress St.  Mr. Grady recommended the Certificate be issued.  Ms. Morris made a motion that was seconded to issue a Certificate of Compliance for SE 18-1330.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

Ms. Hearn made a motion that was seconded to approve the expenditure of $27.16 from the Conservation Fund for phone usage by the Conservation Administrator.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

The Commission postponed action on meeting minutes until more members are present.
