The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, December 15, 2009 beginning at 7:00 p.m. Members present included Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Holly Morris, and Corey Wisneski. Chairman Joseph Messina was absent. Dr. Gill was Acting Chairman. Also present was the Conservation Administrator Joe Grady.
PM, MASS. HIGHWAY, ROUTE 53, PAVING
Representing the applicant were Michael Clemmens and Carey Gallagher. The proposed project is to repave Route 53 from the Pembroke town line for 400 feet into Duxbury and to replace existing catch basin grates. Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the maintenance project on Route 53. The vote was 6 – in favor; 0 – opposed. Motion passed.
PH, DUXBURY CONSTRUCTION, 52 SUNSET RD., BOATHOUSE, SE 18-1523
The public hearing was rescheduled to January 5, 2010 because abutters were improperly notified.
PH, WHITMAN, 6 VILLAGE WAY, TREE CUTTING/GRADING
The applicant, David Whitman explained the project. The project is to correct a drainage problem by cutting down approximately 12 trees and re-grading the yard to direct water away from the dwelling and to add a small gravel parking area. The Commission questioned the location of the limit of work line and wanted the applicant to show the edge of existing and proposed lawn and on a revised plan. The Commission noted no new lawn is permitted within 25 feet of the wetlands. Ms. Morris recommended plantings along the 25-foot buffer. No DEP file number had been issued. Mr. Butcher made a motion that was seconded to continue the public hearing to January 5, 2010 at 7:45 p.m. The vote was 6 – in favor; 0 – opposed. Motion passed.

The DEP file number has been issued. Mr. Butcher made a motion that was seconded to issue Orders of Conditions for the drainage project. The vote was 6 – in favor; 0 – opposed. Motion passed.
ADMINISTRATIVE MATTTERS
The Commission reviewed requests for Certificates of Compliances for SE 18-1441 (2 Bassett Brook Ln.) and SE 18-1486 (Ocean Ave.) Mr. Butcher made a motion that was seconded to issue Certificates of Compliances for SE 18-1441. The vote was 6 – in favor; 0 – opposed. Motion passed.

The Conservation Administrator reported the property owner at 273 Bolas Road had paid the violation fine and will be filing a Notice of Intent for the restoration plan. Ms. Morris asked if the Commission should require bounds or signs along the property line.
The Conservation Administrator reported Mr. Brogna from Seacoast Engineering Co. sent a letter requesting a meeting with the Commission to discuss the non-compliance with the Orders of Conditions for SE 18-1457 (67 Harden Hill). The Commission recommended a letter from the Chairman be sent indicating the Commission would meet with the applicant and applicant’s engineer to hear how the violation would be rectified.
