Conservation Comm. Meeting - 2008/10-07
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, October 7, 2008 beginning at 7:30 p.m.  Members present were Samuel Butcher, Dianne Hearn, Thomas Gill, and Corey Wisneski.  Chairman Joseph Messina, Barbara Kelley, and Holly Morris were absent.  Dr. Gill was Acting Chairman.  Also present was Joe Grady, Conservation Administrator.  

CONT’D. PH, BENTINCK-SMITH, 192 POWDER POINT AVE., SE 18-1482, PIER
Representing the applicant were Paul Brogna from Seacoast Engineering Co. and property owner Andrew Bentinck-Smith.  Mr. Brogna submitted a letter in response to the comments from the Duxbury Bay Management Commission and the Division of Marine Fisheries.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions for the project.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY CONSTRUCTION LLC, 702 CONGRESS ST., SEPTIC, SE 18-1489
Representing the applicant was Freeman Boynton.  The proposed project is a septic system upgrade located in the buffer to bordering vegetated wetlands and a riverfront area.  The Commission asked the applicant to move the septic tank farther from the wetlands.  The proposed system includes a monolithic tank and watertight covers.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions for the septic system project, subject to receiving a revised plan that moved the tank approximately 20 feet farther from the wetlands.  The vote was 4 – in favor; 0 –opposed.  Motion passed.

PM, COHEN/CANTRELL, 423 CHANDLER ST., SHED
The applicants, Barbara Cohen and Robert Cantrell were present for the discussion.  The proposed project is construction of a shed located 40 feet from the bordering vegetated wetlands.  The project conforms to the regulations.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the shed.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, SEGAR, 735 CONGRESS ST., DRAIN, SE 18-1491
Representing the applicant was Paul Brogna from Seacoast Engineering Co.  The proposed project is to replace an existing drain pipe in the buffer to bordering vegetated wetlands.  The proposed pipe will be located farther from the wetlands than the existing pipe.  Mr. Brogna presented a revised plan that adjusted the wetlands delineation as a result of a review by the Conservation Administrator.  Mr. Brogna submitted a letter dated 10/7/2008 that detailed the installation of the drain pipe. Mr. Butcher asked if the last 10-foot section of pipe could be perforated.  Mr. Brogna agreed.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, CASTANON, 201 MARSHALL ST., RESTORATION PLAN
Representing the applicant were Christopher Castanon and Freeman Boynton from Duxbury Construction LLC.  Mr. Castanon explained the proposed restoration plan which is in response to an enforcement order issued by the Conservation Commission for cutting of trees and vegetation beyond the scope of the Orders of Conditions SE 18-1473. Because of the extent of cutting, Commission requested an outside consultant be retained to review the application and to monitor the project.  The expense of the consultant is to be paid by the applicant.  An abutter William Thayer of 105 Marshall St. presented photographs of the area and a letter dated 10/6/2008 regarding concerns about the vegetation cutting and proposed restoration plan.  Mr. Mark Mahoney, 181 Marshall St. spoke on the extent of cutting and noted that the area was previously a wildlife corridor and asked that the restoration try to reestablish that wildlife corridor.  Mr. Mahoney also asked that the proposed plan include a plan for invasive species management.  Mr. David Thomas, 15 Quail Run spoke on the extent of the cutting and the disturbance of the natural vistas.  Mr. Butcher agreed that a consultant should be hired to review the restoration plan.  Mr. Butcher made a motion that was seconded to continue the public hearing to November 4, 2008 at 7:35 p.m. in order that the Commission retains a consultant.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, SPOOR/LOJKO, 80/84 MARSHALL ST., SE 18-1490
Dr. Gill reported that there was not a quorum of all the Commissioners that had been present at the last hearing for the project so it was necessary to continue the public hearing.  Ms. Hearn made a motion that was seconded to continue the public hearing to October 21, 2008 at 7:55 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, INTOCCIA, DUXBURY FARMS CORP., 30 SAW MILL RD., SE 18-1487
Since the DEP file number has been issued, Mr. Butcher made a motion that was seconded to issue the Orders of Conditions.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
Mr. Butcher made a motion that was seconded to approve the expenditure of $1,000 from the Conservation Fund for the new Round Pond trail map.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator reported on a proposed zoning bylaw change regarding coverage.
