Conservation Comm. Meeting - 2008/07-08
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, July 8, 2008 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Samuel Butcher, Dianne Hearn, and Holly Morris. Thomas Gill, Barbara Kelley and Corey Wisneski were absent.  Joe Grady, Conservation Administrator was also present.  

PM, WHITTEMORE, 25 HOUNDS DITCH LN., RETAINING WALL
The applicant, Janet Whittemore was present for the discussion.  The proposed project is to replace the existing railroad tie wall with concrete blocks in the same footprint, approximately 75 feet from the wetlands.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the replacement of the retaining wall.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, LOJKO, 84 MARSHALL ST., SE 18-1449
CONT’D. PH, SPOOR, 80 MARSHALL ST., SE 18-1472
Representing the applicants was Paul Brogna from Seacoast Engineering Co. who reported on the status of the plot plan with Land Court.  Mr. Butcher made a motion that was seconded to continue the public hearings to August 19, 2008 at 7:45 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION, 201 MARSHALL ST., SE 18-1473
No one was present for the applicant.  Mr. Grady reported the concerns of the neighbors.  The Commission agreed to a vista clearing of up to 50% of each of the forest layers.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, ROGERSON, 90 MARSHALL ST., PIER
Representing the applicant were Tom and Cathy Rogerson and Paul Brogna from Seacoast Engineering Co.  Mr. Brogna explained the project which was construction of a pier over the salt marsh.  The Commission asked Mr. Brogna to show the following information on the plan:  elevation of Marshall St.; channel of the river; and location of the opposite bank.  Mr. Butcher asked how many hours the float will be floating.  Some of the concerns voiced by the Commissioners include prop wash and scouring of the salt marsh; encroachment on the secluded habitat at Eagles Nest; and impact to the vista and aesthetics.  The Commission asked the applicant to address the performance standards listed in section 23.6 (4) of the Commission’s rules and regulations.  Mr. Butcher made a motion that was seconded to continue the public hearing to July 22, 2008 at 8:05 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PM, O’CONNOR, 58 BAY RD., DAM REPAIR
The applicant Nicholas O’Connor explained the project which was to reconstruct the existing dam.  The work was to be done by hand.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The vote was 4 – in favor; 0 – opposed.  Motion passed.


ADMINISTRATIVE MATTERS
The Commission reviewed a request for a Certificate of Compliance for SE 18-1102, 95 Duck Hill Rd.  It was noted the garage was never constructed.  Mr. Butcher made a motion that was seconded to issue a Certificate of Compliance for SE 18-1102.  The vote was 4 – in favor; 0 – opposed.  Motion passed.
