Conservation Comm. Minutes - 2007/12-18
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, December 18, 2007 beginning at 7:30 p.m.  Members present were Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, and Corey Wisneski.  Chairman Joseph Messina and Holly Morris were absent.  Dr. Gill was Acting Chairman.  Joe Grady, Conservation Administrator was also present.   

PAT LORING, ALLEN PROPERTY CONSERVATION RESTRICTION
Ms. Loring reported on a conservation restriction with Wildlands Trust that was placed on 12 acres of the Allen property owned by the Duxbury Rural & Historical Society, Inc. off Crescent Street.  Ms. Kelley made a motion that was seconded to approve the conservation restriction with the Wildlands Trust.  The vote was 5 in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY DPW, GENERAL MAINTENANCE, DRAINAGE SYSTEM
The DEP file number had not been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to February 26, 2008 at 7:35 p.m.  The vote was 5 – in favor; 0 – opposed. Motion passed.

PH, RIVER REALTY TR., 10 PINE POINT PLACE, 2 DWELLINGS
Representing the applicant were Michael Biviano and the applicant’s engineer, Robert Crawford.  The proposed project is to demolish the existing structures and construct two single family dwellings.  The site is located on a barrier beach and land subject to coastal storm flowage and in the buffer to salt marsh.  The Commission requested that the dwellings be on an open-pile foundation.  Issues discussed included coverage and encroachment on the 35-foot buffer to the marsh.  The Commission noted there could be no increase in coverage and no expansion of the structures within the 35-foot buffer.  Dr. Gill read a letter from the abutter, John Bernazani objecting to the project.  No DEP file number had been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to January 8, 2008 at 7:35 p.m. to allow the applicant to revise the plan.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, DORAN, 1398 TREMONT ST., BARN, SEPTIC
The property owners Fran and Christina Doran were present with their engineer, Mark Flaherty.  The proposed project is to construct a barn in the buffer to bordering vegetated wetlands.  The project conforms to the regulations.  No DEP file number had been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to January 8, 2008 at 7:45 p.m. for the file number.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, HINCKLEY, 160 WASHINGTON ST., SE 18-1450
Representing the applicant were Clark Hinckley and Shawn Dahlen.  Also present was the Commission’s consultant, Lenore White from Wetlands Strategies.  Ms. White gave her report and recommended the stream remain a perennial stream.  The applicant responded to the consultant’s report in a letter dated 12/8/2007.  Mr. James Lampert, 148 Washington St., reiterated his concerns in his letter dated 11/11/2007.  Mr. John Hill, 120 Washington St. reported he has never seen the stream dry.  Dr. Gill asked Ms. White to review the applicant’s response to her recommendation and report back to the Commission at its next meeting.  Mr. Butcher made a motion that was seconded to continue the public hearing to January 29, 2008 at 7:35 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, PINEAU, 67 HARDEN HILL, DWELLING, BOATHOUSE, POOL
Representing the applicant were Robert and Donna Pineau, Paul Brogna from Seacoast Engineering Co., Landscape Architect Paul Ripley, and Architect James Kelleher.  The proposed project is demolition of the existing dwelling and boathouse and construction of a new single family dwelling, new boathouse/guesthouse and installation of a swimming pool in the buffer to salt marsh, coastal dune and coastal bank.  Mr. Grady questioned the accuracy of the topography on the plan and noted the wetlands line should be revised to include the coastal bank.  The boathouse is in a velocity zone and would need to be built on piles.  The applicant was advised that no new construction is permitted in the 35-foot buffer to the salt marsh.  The Commission asked the applicant to move the septic tank farther from the marsh and show proposed landscaping on a plan. No DEP file number had been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to January 8, 2008 at 7:50 p.m. for a revised plan.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, KENNEY-PIERCE, 114 ALDEN ST., BRUSH CLEARING
Representing the applicant was Scott Doyle.  The proposed project is to clean up the overgrown brush and debris along the wetlands and in the stream and to establish a 10-foot buffer with mulch between the wetlands and the lawn.  The Commission had concerns about the mulch washing into the stream and wanted to see a planting plan showing native plantings in the buffer rather than just mulch.  No DEP file number had been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to February 12, 2008 at 7:45 p.m. for a detailed planting plan.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed the request from the Conservation Administrator for the following items to be paid from the Conservation Fund:  Round Pond trail maps ($380); North Hill Map ($3,500); Hounds Ditch cable & lock ($208); gravel for parking areas ($1,500); truck repair ($500).  Mr. Butcher made a motion that was seconded to approve the spending of $6,088 from the Conservation Fund for the above-referenced expenditures.  The vote was 5 – in favor; 0 – opposed.  Motion passed.
