The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, November 13, 2007 beginning at 7:30 p.m. Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, and Holly Morris. Corey Wisneski was absent. Joe Grady, Conservation Administrator was also present.
CONT’D. PH, DPW, GENERAL MAINTENANCE, DRAINAGE SYSTEM
Since no DEP file number had been issued, the applicant requested a continuation of the public hearing. Dr. Gill made a motion that was seconded to continue the public hearing to December 11, 2007 at 7:35 p.m. The vote was 6 – in favor; 0 – opposed. Motion passed.
CONT’D. PH, LOJKO, 84 MARSHALL ST., SE 18-1448
Representing the applicant were Paul Brogna from Seacoast Engineering and the property owner Joseph Lojko. The Commission reviewed a letter from the Harbormaster. The Commission conducted a site visit with Mr. Brogna and as a result the wetlands line on the plan needs to be revised. Ms. Morris had concerns with safety issues and cumulative effect of piers in the area. Mr. Grady questioned the property lines on the plan and asked for a copy of the deed and that the plan be stamped by a land surveyor. Dr. Gill made a motion that was seconded to continue the public hearing to November 27, 2007 at 8:05 p.m. The vote was 6 – in favor; 0 – opposed. Motion passed.
PM, TOWNSHIP CONDOMINIUM ASSOC., 521 WEST ST., SEPTIC
Representing the applicant was Richard Grady of Grady Consulting. The proposed project is installation of a septic system. The only work within the 100-foot buffer to bordering vegetated wetlands is piping for the septic tank. Dr. Gill made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 6 – in favor; 0 – opposed. Motion passed.
PH, SALMELA, 4 MIDWAY RD., POOL
Representing the applicant were Alexander Salmela and John Casha from Crystal Construction. The proposed project is to install a swimming pool. The project conforms to the regulations; however no DEP file number had been issued. Dr. Gill made a motion that was seconded to continue the public hearing to November 27, 2007 at 8:15 p.m., for issuance of the file number. The vote was 6 – in favor; 0 – opposed. Motion passed.
CONT’D. PH, INDUSTRIAL TOWER, 454 FRANKLIN ST., SE 18-1440
Representing the applicant was Rick Voci, who submitted a revised plan that showed only the wetlands delineation in the area of the proposed lease area for the cell tower. Mr. Voci indicated if the applicant goes forward with the project then the wetlands along the access road will be delineated. Several abutters spoke about the current activities on the site. The Commission indicated that current activities on the site are a separate issue that the Conservation Administrator is looking into. Dr. Gill made a motion that was seconded to accept the wetlands delineation as shown on the revised plan of the proposed leased area dated 11/5/2007. The vote was 6 - in favor; 0 – opposed. Motion passed.

These three continued public hearings were discussed simultaneously. Mr. Messina recused himself; Dr. Gill was Acting Chairman. Representing the applicant were Attorney Robert Shelmadine, Landscape Architect Edward Fuller, and Jack O’Leary from Merrill Associates. The consultant for the Commission, Thomas Sexton, Mainstream Engineering Co. was also present. Mr. Fuller explained the restoration plan. Mr. Grady asked that the mitigation work be done prior to any construction work on the sites. Mr. Fuller indicated that the trees could be planted now, but the herbaceous layer should wait until spring. Ms. Morris made a motion that was seconded to issue Orders of Conditions for SE 18-1444, SE 18-1445, and SE 18-1446. The vote was 5 – in favor; 0 – opposed. Motion passed.
ADMINISTRATIVE MATTERS
Mr. Grady reported on a request to change one of the special conditions in the Orders of Conditions for SE 18-1438, which required all mitigation to be done prior to any other construction work. The Commission indicated that the applicant should file a formal request to amend the Orders of Conditions.
