Conservation Comm. Minutes - 2007/09-25
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, September 25, 2007 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Thomas Gill, Dianne Hearn, Holly Morris, and Corey Wisneski.  Samuel Butcher and Barbara Kelley were absent.

PH, DEADY, 39 OCEAN RD. NO., DRIVEWAY, SE 18-1437
The applicant, Jeffrey Deady was present for the discussion.  The proposed project is to install a 1,688 square foot-paver-driveway.  The Commission explained the regulation regarding only 500 square feet of hard surface in the Gurnet Road area which is a barrier beach and land subject to flooding.   The Commission indicated that as proposed the project would probably be denied.  The applicant asked to continue the hearing in order for him to review whether the property owner wanted to revise the proposal.  Dr. Gill made a motion that was seconded to continue the public hearing to October 16, 2007 at 8:25 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY DPW, MAYFLOWER ST., WATERMAIN, SE 18-1439
Representing the applicant were Water Superintendent Paul Anderson and Consultants Lou Cirrocco and Nicole Sanford from Santec.  Mr. Anderson explained the project which was to install a new watermain in order to improve water pressure.  Work requires replacing a culvert and pipe.  The culvert work would be done during stream no-flow.  The applicant is also working with the property owner, Earle Ricker to obtain an easement for the watermain.  Mr. Ricker indicated that the existing culvert is used for the cranberry bog’s irrigation and asked that the work schedule not interfere with activities at the bog. Ms. Hearn made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY DPW, CHURCH ST., PUMP STATION
Representing the applicant were Water Superintendent Paul Anderson and Consultants Lou Cirrocco and Nicole Sanford from Santec.  The proposed project is to construct a water pump station at the Damon wellsite.  Ms. Wisneski questioned the effect on the wetlands once the new wells are operating.  Mr. Anderson explained that the water withdrawal permit from Department of Environmental Protection requires extensive monitoring of effects on ground water.  Several abutters had concerns about access to the pump station from Church Street.   No DEP file number had been issued.  Ms. Hearn made a motion that was seconded to continue the public hearing to October 16, 2007 at 8:35 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, TOWN OF DUXBURY, 71 ALDEN ST., SYNTHETIC TURF FIELD
Representing the applicant was Whit Davis from Camp, Dresser & McKee.  The proposed project is to replace the existing football field with a synthetic turf field.  A portion of the work falls within the outer riparian zone of the Bluefish River and buffer to bordering vegetated wetlands and salt marsh.  The Commission asked that storage of equipment during construction be outside the riverfront area.  Ms. Hearn made a motion that was seconded to issue Orders of Conditions.  The vote was 5 in favor; 0 – opposed.  Motion passed.


PH, INDUSTRIAL TOWER & WIRELESS LLC, 454 FRANKLIN ST., DELINEATION,
SE 18-1440
Representing the applicant is Rick Voci.  The Commission reviewed the wetlands delineation and asked that the plan be drawn at a larger scale: show the wetland delineation along the access road to the proposed cell tower location; and add the location of the flood zones and riverfront area.  Dr. Gill made a motion that was seconded to continue the public hearing to October 30, 2007 at 7:35 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY BAY MARITIME SCHOOL, 457 WASHINGTON ST., NEW BUILDING,
SE 18-1435
Representing the applicant were Edward Lawson and Patrick Brennan from Amory Engineers.  Mr. Lawson described the project, which is to remove to existing structures and construct a new administrative/storage building.  The applicant indicated the proposed material for the parking area will be either gravel or crushed shells.  The Commission asked how material from the parking area will be kept out of the catch basins. Mr. Lawson asked if the Commission would allow storage lockers for boat safety equipment to be cantilevered approximately 3 feet into the 35-foot buffer zone.  The Commission asked the applicant to submit a foundation plan of the building; operation and maintenance plan for the drainage system; more detail on the fuel storage shed; and show location of storage lockers on the plan.  Dr. Gill made a motion that was seconded to continue the public hearing to October 16, 2007 at 8:40 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY FARMS CORP., FRANKLIN ST., RESTORATION PLAN
Representing the applicant were Attorney Robert Shelmedine and Jack O’Leary from Merrill Associates.  Joe Messina recused himself from this hearing; Dr. Gill was Acting Chairman.  This Notice of Intent was filed as a result of an enforcement order issued for tree cutting beyond the limit of work established under Orders of Conditions SE 18-1315.  Mr. O’Leary indicated that the area where the trees were cut is a location of future proposed development so the present plan is to just stabilize the area.  Ms. Morris noted that the disturbed area was a prime nesting habitat and also had concerns about runoff if the area was to be only lawn.  The Commission asked for a more-detailed restoration and planting plan that replaced the trees cut and requested that the plan be reviewed by the town’s consulting engineer, Mainstream Engineering.  Attorney Shelmedine indicated the applicant is also willing to provide mitigation elsewhere as part of the restoration plan.  Ms. Morris made a motion that was seconded to continue the public hearing to October 30, 2007 at 7:45 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY FARMS CORP., FRANKLIN ST., LOT R, GRADING, SITE WORK
Representing the applicant were Attorney Robert Shelmedine and Jack O’Leary from Merrill Associates.  Joe Messina recused himself from this hearing; Dr. Gill was Acting Chairman.  Mr. Merrill described the project which was grading, landscaping and site work associated with construction of a single family dwelling.  The dwelling was located outside the 100-foot buffer to a bog and bordering vegetated wetlands.  No DEP file number had been issued.  The Commission requested the applicant show the coverage ratio in the buffer and the specifics of the restoration of the dismantled area where trees were cut without a permit.  The Commission asked that roof runoff be directed to a leaching drywell.  Ms. Hearn made a motion that was seconded to continue the public hearing to October 30, 2007 at 7:55 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

Representing the applicant were Attorney Robert Shelmedine and Jack O’Leary from Merrill Associates.  Joe Messina recused himself from this hearing; Dr. Gill was Acting Chairman.  Mr. Merrill described the project which was construction of a single family dwelling and site work in the buffer to a bog and bordering vegetated wetlands.  No DEP file number had been issued.  The Commission requested the applicant show the coverage ratio in the buffer and the specifics of the restoration of the dismantled area where trees were cut without a permit.  The Commission asked that roof runoff be directed to a leaching drywell.  Ms. Hearn made a motion that was seconded to continue the public hearing to October 30, 2007 at 8:05 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PH, GRAHAM, 2 BASSETT BROOK LN., SEPTIC, SE 18-1441
Representing the applicant was the applicant’s engineer, Gary James.  The proposed project is a septic system upgrade located 60 feet from bordering vegetated wetlands and is as far from the wetlands as possible. The existing driveway is located between the septic system and the wetlands.  The Board of Health has approved the plan.  Dr. Gill made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed requests for Certificates of Compliances for SE 18-745 (Freeman Farms); SE 18-1004 (Freeman Farms; SE 18-1311 (226 Bay Rd.); SE 18-1318 (350 Franklin St.); and SE 18-1156 (44 Wirt Way).  The Commission postponed action on SE 18-1311 and SE 18-1156.  Ms. Hearn made a motion that was seconded to issue Certificates of Compliances for SE 18-745 and SE 18-1004.  The vote was 4 – in favor; 0 – opposed; 1 abstention (Gill).

Ms. Hearn made a motion that was seconded to issue a Certificate of Compliance for SE 18-1318.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

In response to a letter from the Board of Selectmen regarding return of the foreclosed land on Franklin Street back to Mr. King, the Commission discussed the value of the land to the Town.  Ms. Morris made a motion that was seconded to send a letter to the Board of Selectmen stating that the Conservation Commission position that the Town should obtain an easement over both the King properties on Franklin Street to provide access to the abutting conservation property.  The vote was 5 – in favor; 0 – opposed.  Motion passed.
