Conservation Comm. Minutes - 2007/09-11
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, September 11, 2007 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Holly Morris, and Corey Wisneski.  

PH, DUXBURY DPW, POWDER POINT AVE., SE 18-1430
Representing the applicant were Tom Daley, DPW Director and Ed Vickers from the Highway Department.  The proposed work is to repair the east end of the Powder Point Bridge and to add stone riprap to protect the eroding slope in the west end parking area. The Commission asked about access to the project and the timing of the work.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY DPW, GENERAL DRAINAGE MAINTENANCE
Representing the applicant were Tom Daley, DPW Director and Ed Vickers from the Highway Department.  The proposed work is general maintenance of the town’s existing drainage infrastructure.  No new infrastructure is proposed with the exception of three small projects referenced on the plan as #1a, 2b, and 3c in which work will be done to alleviate flooding problems.  The Commission required that the Conservation Administrator be notified prior to any work commencing.  No DEP file number has been issued because the Massachusetts Division of Fisheries & Wildlife, Natural Heritage Endangered Species Program requested more information from the applicant.  Mr. Butcher made a motion that was seconded to continue the public hearing to October 16, 2007 at 7:45 p.m.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

CONT’D PH, MCKENNA, 427 BAY RD., SE 18-1422
The applicants, William and Lorraine McKenna presented a revised plan showing the location of sonotubes for the proposed garage and amount of coverage in the buffer zone.  The Commission reviewed the coverage figures and indicated that there can be no net gain since existing coverage exceeds 15%.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions for construction of the garage and associated pavement removal such that the resulting coverage does not increase as presented in a letter from South Shore Survey Consultants dated 9/4/2007 and that the proposed new coverage not exceed 668.91 square feet.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

PH, LOVETT, 608 CHANDLER ST., SITE WORK, SE 18-1422
The applicant, Craig Lovettt explained the project which was to remove tree stumps and grade an area for lawn.  The proposed work is located no closer than 65 feet to the wetlands.  The project conforms to the regulations.  Ms. Morris made a motion that was seconded to issue Orders of Conditions for the proposed site work.  The vote was 7 – in favor; 0 – opposed.  Motion passed.





PH, DUXBURY BAY MARITIME SCHOOL, 457 WASHINGTON ST., NEW BUILDING,
SE 18-1435
Representing the applicant was Edward Lawson.  Mr. Lawson indicated that abutters had not been notified so the Commission rescheduled the public hearing to September 25, 2007 at 8:15 p.m.

PH, HOPKINS, 84 SOUTH STATION ST., SEPTIC, SE 18-1436
Representing the applicant was Paul Brogna of Seacoast Engineering Co.  The proposed project is to replace a failed septic system.  The Commission asked why the system could not be moved farther from the wetlands and Mr. Brogna indicated that if the system was moved it would get closer to existing utility lines and be more expensive.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 in favor; 1 – opposed (Messina).  

PH, MORSE, 251 WASHINGTON ST., GARAGE, ADDITION, SE 18-1438
Representing the applicant were Paul Brogna of Seacoast Engineering and Shawn Dahlen.  The proposed project is construction of a garage and two additions.  The Commission requested that the location of the flood zones be shown on the plan.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions subject to receipt of a revised plan showing location of flood zones.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

Representing the applicant was Paul Brogna of Seacoast Engineering Co.  Mr. Brogna submitted revised plans for the three properties and explained the revisions.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions for SE 18-1429, SE 18-1428, and SE 18-1427.  The vote was 7 – in favor; 0 – opposed.  Motion passed.
