Conservation Comm. Minutes - 2006/09-26
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, September 26, 2006 beginning at 7:30 p.m.  Members present were Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry and Holly Morris.  Joe Grady, Conservation Administrator was also present.

EXECUTIVE SESSION
At 7:30 p.m. Dr. Gill made a motion that was seconded to go into executive session to discuss strategy with respect to litigation where an open meeting may have a detrimental effect on the litigating position of the governmental body in accordance with M.G.L. Chapter 39, section 23B, subsection 3. A roll call vote was taken:  7 – in favor; 0 – opposed.  Motion passed.

At 7:45 p.m. Dr. Gill made a motion that was seconded to reconvene into open session.  A roll call vote was taken: 7 – in favor; 0 – opposed.  Motion passed.

PH, HEALY, 46 LANDING RD., ADDITION, SE 18-1388
Representing the applicant were Grace Healy and Paul Shea, an environmental consultant.  The proposed project was construction of a 116 square foot addition.  Since the existing coverage exceeds the 15 % regulation, the applicant proposes to remove a section of the existing walkway, driveway and deck so there is no increase in coverage.  The Commission asked the applicant to show on the site plan the specific locations where impervious cover is being removed.  Mr. Grady noted that the portion of the new addition within 50 feet of the wetlands is required to be on sonotubes.  The Commission asked the applicant to show the location of sonotubes on the plan.  Ms. Kelley made a motion that was seconded to continue the public hearing to October 10, 2006 at 7:35 p.m.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

DBR, INC., EXTENSION PERMIT, DUXBURY BEACH, SE 18-1198
Representing the applicant were Al Vautrinot, Shawn Dahlen, Kay Foster, and Jim O’Connell.  The applicant requested a three-year extension for the Orders of Conditions (SE 18-1198), for the management of Duxbury Beach.  Mr. Vautrinot reported on beach activities and discussed a letter dated 9/26/2006 from Scott Hecker, National Audubon Coastal Bird Conservation Program regarding recommendations to improve beach management and the ORV track program.  Ms. Molly Bartlett from 52 Crooked Lane supported Mr. Hecker’s recommendations and also had concerns about long-term maintenance of the beach road and the bird monitoring program.  She recommended the Commission conduct a site visit to the beach.   Mr. Dahlen reported that the applicant usually schedules a site visit with the Commission in early winter to review upcoming maintenance activities and suggested that Mr. Hecker attend that meeting.   The Commission felt minor modifications to the beach program  could be handled through the existing Order of Conditions and the Beach Management Plan and asked that the applicant to submit an addendum to the management plan listing any changes.  Dr. Gill made a motion that was seconded to issue a three-year extension of the Orders of Conditions SE 18-1198.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

PH, DUXBURY CONSTRUCTION, 389 KING CAESAR RD., SE 18-1383
Representing the applicant was Freeman Boynton.  Mr. Grady reported that letters requesting review of the project by the Duxbury Bay Management Commission and the Harbormaster were sent, but the Commission received no comments back.  Dr. Gill made a motion that was seconded to issue Orders of Conditions.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed requests for Certificates of Compliances.  Dr. Gill made a motion that was seconded to issue a Certificate of Compliance for SE 18-1163, 35 Merry Ave.   The vote was 7 – in favor; 0 – opposed.  Motion passed.

Dr. Gill made a motion that was seconded to issue a Certificate of Compliance for SE 18-154, Weston Farms.  The vote was 7 – in favor; 0 – opposed.  Motion passed.

The Commission postponed action on the request for a Certificate of Compliance for SE 18-1239 because the as-built plan was not accurate.

The Commission reviewed an easement plan for access over the property at 884 Temple Street to access for maintenance purposes only the town-owned parcel located behind 884 Temple Street.  Dr. Gill made a motion that was seconded to accept the Mackenzie easement plan.  The vote was 7- in favor; 0 – opposed.  Motion passed.
