The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, March 7, 2006 beginning at 7:30 p.m. Members present were Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry and Holly Morris. Samuel Butcher and Joseph Messina were absent. Joe Grady, Conservation Administrator was also present. Since Mr. Butcher was absent, Dr. Gill was Acting Chairman.
This meeting was the continued public hearing for the proposed revised rules and regulations for the Conservation Commission under the Town’s Wetlands Protection Bylaw, Chapter 9. The first hearing was on 1/24/ 2006.
Dr. Gill read the hearing notice. The Commission reviewed the written comments submitted from the Duxbury Bay Management Commission in a memo dated 2/21/2006, from John Wisbach in a letter dated 2/21/06 and from a letter from Harry Scott dated 2/17/06. Dr. Gill reported that the Conservation Administrator had presented three revisions at the meeting on January 24, 2006. The three revisions were accepted at the 1/24/2006 meeting, but the Commission voted to confirm that vote. Ms. Kelley made a motion that was seconded.
Motion: to adopt the revisions presented by Mr. Grady at the 1/24/2006 meeting.

Ms. Kelley made the following motions that were seconded.
Motion: not to accept the proposed changes to Section 18.1(d) (2) (c) (p.26).

Motion: to accept the proposed change to section 18.3 (d)(2) (p. 31)

Motion: to revise Section 20.1 (d)(5) a) to read “new construction or placement of new structures, including buildings, sheds and garages. Existing buildings may be renovated or reconstructed but must be built using flood-resistant construction.”
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to revise Section 20.1 (d)(5) d) by adding “unless such structures are of a loose, sloped-stone design”.
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to add to Section 20.1(d)(6) a) “on vacant lots”.
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to revise Section 20.1 (d)(6) b) by adding “unless such structures are of a loose, sloped-stone design”.
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to add to Section 20.1 (d)(7) “f) Projects and activities associated with water-dependent uses such as boat yards, yacht clubs, and maritime schools.”

Motion: to add to Section 20.1 (d)(7) “g) Dredging, including maintenance dredging.”
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to change Section 20.2(d)(2) to read “ No new coastal revetments or hard coastal engineering structures of any type shall be constructed on a barrier beach.”
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to change in Section 23.1 (b) 3) b) “leaching system” to “leaching field”.
Vote: 5 - in favor; 0 – opposed. Motion passed.
Motion: to change Section 23.4 to read “ 1) Total coverage of any type shall not exceed 15% in residential zoned areas in the Buffer Zone to any Resource Area as defined in DWR 2.00(6). Coverage calculations shall include, but not be limited to, all structures, impervious driveways, impervious walkways, impervious roadways, decks, pools, tennis courts, and any other similar surfaces that cover the ground. The Commission may consider greater than 15% coverage on a lot where both the wetlands resource and the Buffer Zone are located substantially outside of the lot.
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to add to Section 23.6 (1) the words “and low” after the existing word “small”.
Vote: 5 – in favor; 0 – opposed. Motion passed.
Motion: to change Section 23.6 (8) to read “Railings and walkway shall be unobtrusive as possible and their construction shall be of such material, color, shade or tone as to blend in with the natural surroundings.”
Vote: 5 – in favor; 0 – opposed. Motion passed.
Mr. J.R. Kent, 1351 Tremont Street verbally proposed a revision to Section 23.6 (3) by adding the word “residential”. Ms. Kelley made a motion that was seconded.
Motion: to add the word “residential” before the existing word “property” in Section 23.6 (3).
Vote: 5 – in favor; 0- opposed. Motion passed.
Mr. Merry made a motion that was seconded.
Motion: to accept the rules and regulations as amended by the above-discussed motions.
Vote: 5 – in favor; 0 – opposed. Motion passed.
