Conservation Comm. Minutes - 2006/02-07

The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, February 7, 2006 beginning at 7:30 p.m.  Members present were Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry, and Holly Morris.  Samuel Butcher and Joseph Messina were absent.  Joe Grady, Conservation Administrator was also present.  Dr. Gill was Acting Chairman.

CON’T. PH/PM, DAHLEN, 154 WASHINGTON ST., SE 18-1344
Representing the applicant was Shawn Dahlen.  The applicant submitted a revised plan for the wetland delineation.  Ms. Kelley made a motion that was seconded to accept the wetlands delineation as shown on the revised plan and to issue a positive determination that any work within the jurisdiction of the Conservation Commission would require filing a Notice of Intent application.  The vote was 5 - in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION, 379 KING CAESAR RD., SE 18-1348
The DEP file number had been issued.  Ms. Hearn made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION, 26 KING CAESAR RD., SE 18-1351
The DEP file number had been issued.  Ms. Hearn made a motion that was seconded to issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH/PM, GIACHETTO, SUMMER ST., SE 18-1342
The applicant has requested a continuation of the hearing in order to revise the plan.  Ms. Hearn made a motion that was seconded to continue the public hearing to February 28, 2006 at 8:55 p.m.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PM, BAY FARM TR., BREWSTER COMMON
Representing the applicant was Rick Grady of Grady Consulting Co.  A revised plan was submitted showing the intermittent stream on the opposite side of the road.  The only work proposed within the buffer to the stream is a gravel way for emergency access and installation of a water main.  Mr. Merry made a motion that was seconded to issue a negative determination that a Notice of Intent is not required.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, FLEMMING, 408 BAY RD., SEPTIC, SE 18-1345
Representing the applicant were Joe Webby from Webby Engineering and Robert Flemming.  A revised plan was submitted.  The Commission discussed the matter of the driveway being located on town property and the dumping of wood chips on town property.  Dr. Gill asked for a plan showing the location of a barrier between the two properties.  Mr. Grady indicated that if the applicant plans to continue use of the driveway on town property then he needs to get permission from the Board of Selectmen.  Ms. Kelley made a motion that was seconded to accept the wetlands delineation and issue Orders of Conditions.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed a request for a Certificate of Compliance for construction of Deer Run subdivision roadway, SE 18-1085. Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance.  The vote was 5 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator updated the Commission on his meetings with the Board of Selectmen and the Finance Committee regarding Town Meeting articles.
