Conservation Comm. Minutes - 2005/08-23
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, August 23, 2005 beginning at 7:30 p.m.  Members present were Chairman Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry, and Holly Morris.  Joseph Messina was absent.  Joe Grady, Conservation Administrator was also present.  

PH, CONWAY, 683 FRANKLIN ST., POOL
Robert and Andrea Conway were present for the discussion.  The proposed project is construction of a swimming pool within an existing lawn area.  The project conforms to the regulations however no DEP file number had been issued.  Ms. Morris made a motion that was seconded to continue the public hearing to September 13, 2005 at 7:45 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, HYLAND, 181 MYRTLE STREET, ADDITION
The applicant, Douglas Hyland described the project which is to construct a two-car garage with family room over it.  The addition is located 86 feet from bordering vegetated wetlands within an existing lawn area.  The project conforms to the regulations but a DEP file number had not been issued.  Ms. Morris made a motion that was seconded to continue the public hearing to September 13, 2005 at 7:46 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, TOWN OFDUXBURY, MATTAKEESETT COURT, BOAT RAMP
The DPW Director, Tom Daley requested a continuation of the public hearing in order to meet with the Bay Management Commission, the Harbormaster,  and users of the boat ramp to better define the project.  Mr. Merry made a motion that was seconded to continue the public hearing to October 18, 2005 at 8:00 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D PH, DUXBURY FARMS, FRANKLIN ST., SE 18-1315
Representing the applicant were Attorney Robert Knapik and Jack O’Leary from Merrill Associates.  Also present for the discussion was the Town’s consultant on the project, Tom Sexton from Mainstream Engineering Co.  Mr. Grady summarized the issues from the last meeting concerning the drainage. The Commission reviewed correspondence from Merrill Associates dated August 22, 2005 in response to a review letter dated August 19, 2005 from Tom Sexton.  Mr. Grady asked if the applicant had moved forward with the certification of the vernal pool.  The applicant asked that it be a part of the Order of Conditions.  The Commission discussed nitrogen loading, limiting size of lawn areas and monitoring nitrate levels.  Mr. Knapik indicated the Homeowners Association would be responsible for maintenance of the roadway and the drainage system until such time the road is accepted by the Town.  Ms. Kelley made a motion that was seconded to issue Orders of Conditions subject to the conditions discussed in the August 19th letter from Mainstream Engineering and August 22th letter from Merrill Associates.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, SHEA, 435 BAY RD., SINGLE FAMILY DWELLING
The applicants John and Ann Marie Shea were present for the discussion. The proposed project is to demolish the existing dwelling and construct a new single family dwelling.  Mr. Grady reviewed the proposed plan and noted the applicant needs an accurate plan that clearly delineates the wetland flag locations in the field.  Mr. Grady also questioned the coverage calculation for the buffer zone.  Mr. Merry made a motion that was seconded to continue the public hearing to September 13, 2005 at 7:47 p.m.   The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION CO., 60 ELDER BREWSTER RD.
Representing the applicant was Freeman Boynton.  A revised plan was submitted that showed the proposed foundation conforming to the 50-foot setback.  The DEP file number had not been issued because of a computer problem.  Mr. Boynton asked if the Commission could close the hearing because the applicant has a time constraint for beginning construction.  Mr. Merry made a motion that was seconded to issue Orders of Conditions subject to receipt of the DEP file number.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

DINGLEY DELL, STREIBEL, ZONING BOARD OF APPEALS SPECIAL PERMIT
The Commission reviewed a special permit application for the reconstruction of Dingley Dell where a portion of the project is located in the Wetlands Protection Overlay District.  Mr. Butcher referred to sections 404.1 and 404.5 of the Zoning Bylaw.  Orders of Conditions have been issued on the proposed project.  Ms. Morris made a motion that was seconded to notify the Zoning Board of Appeals that the Commission believes the Orders of Conditions adequately protect the water quality and the proposed project can move forward as a special permit project.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PAYTON, 137 GURNET RD., SE 18-1106
Representing the applicant was Mark Casey of South Shore Survey Consultants, Inc.  Mr. Casey presented a revised plan that showed a drainage swale.  Mr. Casey explained the swale was to address a concern from the abutter about runoff onto his property.  Mr. Grady was concerned about channeling the water across the street, but Mr. Casey indicated that the swale could be softened.  The Commission approved the grade alteration as a field change and indicated the applicant need not formally amend the Orders of Conditions.

ADMINISTRATIVE MATTERS
The Commission reviewed a request for a Certificate of Compliance for SE 18-1307 (109 Abrams Hill)  Ms. Kelley made a motion that was seconded to issue a Certificate of Compliance for SE 18-1307.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed a request to pay the taxes on a land gift that has been donated to the Town but has not been finalized.  Ms. Kelley made a motion that was seconded to pay from the Conservation Fund the tax bill of $67.73 for the Mackenzie land gift parcel.  The vote was 6 – in favor; 0 – opposed.  Motion passed.
