The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, June 7, 2005 beginning at 7:30 p.m. Members present were Chairman Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Donald Merry, Joseph Messina, and Holly Morris. Joe Grady, Conservation Administrator was also present.
PH, DUXBURY CONSTRUCTION CO., 111 STAGECOACH RD., SEPTIC, SE 18-1314
Representing the applicant was Freeman Boynton. The proposed project is a septic system repair located within the buffer to bordering vegetated wetlands. The soil absorption system is located as far from the wetlands as possible. Ms. Kelley made a motion that was seconded to issue Orders of Conditions.
PM, SINNOTT, 77 DEPOT ST., PORCH, DORMER
The applicant, Angela Sinnott explained the project which was construction of a full dormer and a screen porch. The dormer is within the existing footprint of the house. The screen porch will be built on sonotubes. Ms. Hearn made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 7 – in favor; 0 – opposed. Motion passed.
PM, WOODRUFF, 41 BAY POND RD., POOL HOUSE
Representing the applicant was the contractor, Paul Roderick. The proposed project was to demolish two existing pool cabanas and construct a single cabana within the existing concrete apron for the pool. Mr. Merry made a motion that was seconded to issue a negative determination that a Notice of Intent is not required. The vote was 7 – in favor; 0 – opposed. Motion opposed.

Ms. Kelley made a motion that was seconded to continue the public hearing to July 12, 2005 at 7:45 p.m. The vote was 7 – in favor; 0 – opposed. Motion passed.
PAT LORING, CONSERVATION RESTRICTIONS
Ms. Loring discussed having members from the Open Space Committee monitor several of the conservation restrictions. Before the Open Space Committee begins the project, Ms. Loring wanted confirmation that the Commission would follow up any violations with enforcement. The Commission agreed.
LEITZES, 326 POWDER POINT AVE., 2ND FLOAT
Representing the applicant were Dr. Stanley Leitzes, his attorney Paul Driscoll, and Paul Brogna from Seacoast Engineering Co. Dr. Leitzes indicated that he has had the second float for 8 years and has had approval from the Harbormaster. Mr. Driscoll had questions regarding 310 CMR 9.07 and asked the Commission to extend the 30-day requirement in the enforcement order for removal of the float. Mr. Merry made a motion that was seconded to continue discussion until July 12, 2005. The vote was 7 – in favor; 0 – opposed. Motion passed.
CONT’D. PH/PM, TARKILN RD. REALTY TR., SOUTH ST., SE 18-1308, DELINEATION
Representing the applicant was Mark Casey of South Shore Survey Consultants, Inc. who updated the Commission on the wetlands field report done by Dr. Carr. Mr. Gene Orosz from 153 Buckboard Rd. reported on the Conservation Commission meeting in Kingston. He indicated a site visit by the Kingston Commission was scheduled for August 5, 2005 and the hearing was continued to August 16, 2005. Several of the abutters questioned whether the plan showed enough of the wetlands in the area. Mr. Casey agreed to revise the plan to show the riverfront areas and to show the wetlands within 100 feet of the property. The Commission asked the applicant to also show the wetlands on the Kingston side of the property on a separate plan. Dr. Gill made a motion that was seconded to continue this public hearing to July 26,
2005 at 7:45 p.m. The vote was 7 – in favor; 0 – opposed.
ADMINISTRATIVE MATTTERS
The Commission reviewed the draft minutes of the meeting on March 1, 2005. Dr. Gill made a motion that was seconded to approve the minutes of the meeting of 3/1/05, as written. The vote was 4- in favor; 0 – opposed; 3 – abstentions (Kelley, Messina, Morris). Motion passed.
